Dear Dr. Thorpe: Dee Freeman Secretary This letter is in regards to the General 401 Water Quality Certification issued for R-5185 authorizing stream and wetland impacts associated with the widening of US 401 from the intersection of NC 210 to just north of SR 1426 in Harnett County. Condition 2 of the certification, shall be replaced with the following revised condition language: Compensatory mitigation for 154 linear feet of impact to streams is required. We understand that you have chosen to perform compensatory mitigation for impacts to streams through the North Carolina Ecosystem Enhancement Program (EEP), and that the EEP has agreed to implement the mitigation for the project. CEP has indicated in a letter dated December 13, 2011 that they will assume responsibility for satisfying the federal Clean Water Act compensatory mitigation requirements for the above-referenced project, in accordance with the North Carolina Department of Environment and Natural Resources' Ecosystem Enhancement Program In-Lieu Fee Instrument signed July 28, 2010. Please attach a copy of this letter with any copies of the original Water Quality Certifications and any subsequent modifications. All other conditions written into the previous Water Quality Certification for this project still applies, except where superseded by this correction.
