The NCDWQ letter stated that a buffer restoration plan would be required. The Town subsequently hired my firm to steer the Town back into compliance; and on March 3`" we met with Ms. Lauren Witherspoon (NCDWQ Regional Office) for a buffer determination and discussion of the Town's overall plans in this area, which included a future plan to construct a footbridge across the subject stream. Consequently, Ms. Witherspoon recommended that the Town submit an overall plan to, A) Restore the buffer, with plantings in Zone 1, and grass in Zone 2; and B) Seek authorization for the impacts of the footbridge. After our meeting onsite, I discussed the project needs that were explained to me by the Mayor (Linwood Parker) with my boss (Danny Smith) and the DWQ Director (Colleen Sullins). I explained (as it was explained to me) that the site property east of the stream would be used as a type of farmers market to enhance the Town of Four Oaks; that an African American community was west of this property, beyond the stream, and that this community not be isolated from the Town; and provide a welcoming view of the Town when traveling on 301. It was also my understanding that the way the Town would meet these goals was by removing vegetation along the stream (already performed which is a buffer violation); removing vegetation along a ditch and excavating a small pond west of the stream (not yet performed); build a berm on the property east of the stream (not yet performed); and construct a footbridge across the stream (not yet performed). During the site visit I explained that a footbridge across the stream would require a buffer authorization (or approval from DWQ); that removing vegetation along the ditch and small pond would be permissible since I determined that it was not Subject to the Buffer Rules but the US Army Corps of Engineers be contacted in regards to whether this area was a wetland; and that building a berm on the property east of the stream was exempt from the buffer rules as long it was atleast 30 feet away from the top-of-bank of the stream and that is was vegetated by atleast grass. We also discussed the requirements to replant the buffer (15t 30 feet) along the eastern side of the stream. DWQ requires that 2 hardwood tree species be planted at a density of 320 trees per acre (surviving at the end of three years). However, Mr. Parker indicated that this was not in line with the Town's goals and that he would prefer that only shrubs be planted and at most 4 trees. In addition, he indicated that the Town would want to be able to maintain this area to ensure that the view of the Town was not impeded. I indicated that DWQ could not authorize the maintenance of this area (with the exception of nuisance vegetation which is Exempt from the buffer rules) and that this was the authority of the Environmental Management Commission. I also explained that I could not make an exception to the planting requirements but that I would discuss with my boss to determine if he was able to. Per my discussion with Danny Smith, DWQ will allow you to submit a planting plan when you apply for the buffer authorization for the foot bridge. This planting plan can consist of shrubs if you prefer. However, we would like for you to use the list of plants in the Riparian Buffer Guidelines. I had attached a copy of the document (Exotic Species Guidelines) that contains a list of nuisance vegetation (a list is in the Table of Contents) that can be manually removed (not by weed eater or any other mechanized equipment) from the buffer.
