On behalf of the owner, Mr. Jim Little, please find attached a complete application and
supplemental information requesting written concurrence from the U.S. Army Corps of
Engineers (USACE) and the North Carolina Division of Water Quality (NC DWQ) seeking
approval for use of Nationwide Permit #14 and Water Quality Certification #3820. Certification
and written approval from the NC DWQ is being sought due to the use of NWP # 14 (instead of
NWP #39 due to 100 year flood) and not being able to abide by condition 14 of the certification.
The proposed impact is to lengthen the existing culvert to allow for a drive way to access the
property. The proposed culvert will be connected to the existing culvert, which is not buried to
DWQ specifications. During a site meeting with the NC DWQ, Polly Lespinasse of the
Mooresville Regional Office reviewed the existing culvert, agreed that condition 14 could not be
met, and that written correspondence from the NC DWQ would be required to connect the
proposed culvert to the existing. Please see below for project summaries and impact totals, as
well as attachments.

Intermittent stream runs perpendicular to NC Hwy 24/27. Very minimal road frontage dictates this as the only feasible access
to the property from the main thoroughfare. Any other access would involve large amounts of impact to the floodplain and
perennial stream.

Site to be improved as far away from onsite features as possible. Sedimnet and erosion control techniques will be utilized to
keep erosion to a minimum. No impacts other than the stream crossing proposes. Avoiding 478 feet of perennial stream and

This delineation/determination has been conducted to -identify limits of COE's Clean Water Act jurisdiction for the particular
site identified in this request. The delineation/determination may not be valid for the wetland conservation provisions of the
Food Security Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation in USDA
programs, you should request a certified wetland determination from the local office of the Natural Resources Conservation
Service, prior to starting work.
Placement of dredged or fill material within waters of the US and/or wetlands without a Department of the Army permit may

The site stream channels located on the property that exhibit indicators of ordinary high water marks The stream
channel on the property is Muddy Creek and an unnamed tributary to Muddy Creek which flows into the Rocky River
which flows into the Yadkin River which is a Section 10 navi able-in-fact waterway at Blewett Falls dam that ulitmatel
flows into the Atlantic Ocean.

Dear Mr. Fulton:
Polly Lespinasse and Michael Burkhard of the Division of Water Quality (DWQ) met with you on
March 3, 2011, in order to provide verification of a potential jurisdictional feature previously identified
by your consulting firm for the above referenced project. The feature was evaluated for applicability
to the mitigation rules set forth in [15A NCAC 2H .0506(h)]. Based on the site review DWQ identified
one (1) jurisdictional feature, an intermittent stream, located on the south side of the property,
parallel to NC 24/27. The determination was based on completion of the NCDWQ Stream
Identification Form and an evaluation of existing site conditions (presence of crayfish, macrobenthos
and base flow).
This letter only addresses the applicability to the mitigation rules and does not approve any activity
within buffers, Waters of the United States, or Waters of the State. Any impacts to wetlands, streams
and buffers must comply with 404/401 regulations, water supply regulations (15A NCAC 2B .0216),
applicable buffer rules, and any other required federal, state and local regulations. Please be aware
that even if no direct impacts are proposed to any protected buffers, sheet flow of all new stormwater
runoff as per 15A NCAC 2B .0250 is required.
Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local
Authority that a surface water exists and that it is subject to the mitigation rules may request a
determination by the Director. A request for a determination by the Director shall be referred to the

Individuals that dispute a determination by the DWQ or Delegated Local Authority that "exempts" a
surface water from the mitigation rules may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. Applicants are hereby notified that the 60-day statutory
appeal time does not start until the affected parties (including downstream and adjacent landowners)
are notified of this decision. DWQ recommends that the applicant conduct this notification in order to
be certain that third party appeals are made in a timely manner. To ask for a hearing, send a written
petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This determination is
final and binding unless you ask for a hearing within 60 days.
