There are a few problems with the documents we received that are keeping us from treating this as simply a "courtesy copy." First, the impacts listed are as follows: 65 linear feet of intermittent stream - piped; 180 linear feet of intermittent stream - regarded; total impacts 245 feet. As stated in GC 3821, impacts greater than 150 linear feet (temporary or permanent) require written approval. If they have listed the impacts incorrectly, please work with these folks to have them revise their application and resubmit it so the PCN accurately reflects the temporary and permanent impacts. If the total impacts do not trigger written approval, then we can process a new and correct PCN as a "courtesy copy." Also, please make sure they include an agent authorization as the gentleman that filled out the application is not the owner of the property. Second, I understand your point that we do not require a PCN for restoration of sediment impacts. The difference here is that the culvert is fill, which triggers the 404 and the 401. We would not issue a 401 for putting sediment in the stream, so while they are both impacts, the permitting trigger is different. Finally, there was no stormwater management plan including with the documents we received. The City of Albemarle is not a "certified" local government, so they will need to submit their stormwater management plan to us for review. If you have any questions, please give me a call. This is little different than sediment in the stream that we handle all the time and we require it to be removed. In those case we require NO pcn for the stream to be restored. At this site, the hard impact is the culvert, the remainder is the stream restored. I asked that the "restoration" be included for clarification so "we" would have information. Thus the purpose of the "courtesy" copy, which is an informational copy. PDF a copy and I will take a look. There is not 245 If hard/permanent impact. The application was to get the culvert permitted (less than 150, no written approval required) Check with Karen. I'm not going to compromise myself and set something up that according to the PCN is not courtesy. They can submit a corrected PCN if what you say is correct. Just working with the customer to get the hard impact permitted and the remainder of the temporary impact "restored". This gives us a copy to check up on at a later time and gets it in the system. It's also an after the fact permit request.
