Davis and wife, Dorothy B. Davis, of Oriental, Pamlico
County, North Carolina, hereinafter called 'Declarants," do,
hereby covenant and agree to and with all other persons,
firms or corporations now owning or hereafter acquiring as
owners any lot or parcel of land in the area designated or
located in or near the Town of Oriental, Pamlico County,
North Carolina, known as Lots 1 through 8 and 10 through 15,
as shown on map entitled PLAN OP OTTER CREEK SUBDIVISION,
dated June 6, 1986, and recorded in Plat Cabinet A, Slide
21-7 , of the Pamlico County Registry: said lots are hereby
subjected to the following covenants and restrictions and to
the use thereof, running with the land by whomsoever owned:
1. These covenants are to run with the land and
shall be binding on all parties and persons claiming under
them until January 1, 2006, at which time said covenants
shall be automatically extended for successive periods of
ten years unless by vote of a majority of the then owners of
the lots, it is agreed to change said covenants in whole or
in part. `
2. If the parties hereto or any of them or their
heirs, successors, or assigns, shall violate or attempt to
violate any of the covenants herein, it shall be lawful for
any other person or persons owning any real property situated
in said development or subdivision to prosecute any proceeding
at law or in equity against the person or persons violating
or attempting to violate any such covenants and either to
prevent him or them from so doing or to recover damages or
other dues for such, violation except the party of the first
part is specifically excluded from any liability for damages.
3. Invalidation of any one of these covenants by
judgment or court order shall in no wise affect any other of
the provisions which shall remain in full force and effect.

THIS WARRANTY DEED, made and entered into this 11th day
of August, 2003, by and between JAMES K. DAVIS and wife, DOROTHY
B. DAVIS, hereinafter called "grantors", and CHARLES H. HOLTON,
III and wife, DINA A. HOLTON, Post Office Box 811, Oriental,
North Carolina 28571, hereinafter called "grantees";

That grantors, for and in consideration of the sum of
ten dollars and other good and valuable considerations to them in
hand paid, the receipt of which is hereby acknowledged, have
bargained and sold, and by these presents do bargain, sell and
convey to the said Charles H. Holton, III and wife, Dina A.
Holton and their heirs and assigns, a certain lot or parcel of
land in Number Five (5) Township, Pamlico County, North Carolina,
particularly described as follows:

by Herbert J. Nobles, Jr., Registered Land Surveyor,
dated April 28, 2003, entitled "SURVEYED FOR CHARLES
HOLTON", copy of which is attached hereto and
incorporated herein by reference.
Said lot is conveyed subject to Restrictive Covenants
dated July 8, 1986, recorded in Book 239 at page 294,
Pamlico County Registry, as amended by instrument dated
December 9, 1986, recorded in Book 242 at page 227,
said registry, and to the Subdivision Street Disclosure

page 291, said registry.
