The project was originally permitted in 2007 under Action ID No. SAW-2007-0659-344. Part of the project was constructed as planned and mitigation paid for all the previously permitted impacts; however, due to lack of funding the project was not completed and the impacts previously authorized were never used. The original design has changed, which will require additional culvert length at three previously permitted sites and the relocation of a section of a roadside stream. Funds have been allocated for this project, and NCDOT would like to perform these activities in 2011. am enclosing a PCN, pipe installation detail, photographs, a marked county map and USGS topographic map. The culverts will be installed slightly below the existing streambed elevations where bedrock is not encountered to minimize impacts to aquatic habitats; however, all three of the proposed culvert extension/replacements will be perched due to the steep topography of the area. The North Carolina Natural Heritage Program was checked prior to the original construction. There were no records of threatened and endangered species in the database. There have been no new records discovered within this watershed since the original permit was issued. The impacts from extending three culverts should be minimal. The best management practices will be used to minimize and control sedimentation and erosion on this project. If the planned devices are not functioning as intended, they will be replaced immediately with better devices. The rock silt screens and other erosion control devices will be in place prior to pipe culvert construction and will remain in.nlace until the project is stabilized. Impacts to Waters of the United States Pine Tree Cove Creek (DWQ Class C; Tr.) at site 8, the unnamed tributary of Pine Tree Cove Creek at site 5 and the unnamed tributary of Jonathans Creek at site 9 are all shown on the USGS topographic map as perennial. All three streams have well-defined channels with cobble, gravel and sand substrate. The channels lack vegetation. Pine Tree Cove Creek flows approximately 1M64 to J n, thCreek. The unnamed tributary of Pine Tree Cove Creek at site 5 flows e?y ?%p atel0 nitles to Pine Tree Cove Creek. The unnamed tributary of Jonathans Creek flows approximately 0.9 miles to Jonathan Creek. Jonathan Creek flows approximately 12 miles to the Pigeon River. The Pigeon River meets the definition of a Traditional Navigable Water. For these reasons, we believe that the unnamed tributaries of Jonathans Creek and Pine Tree Cove Creek and Pine Tree Cove Creek are Relatively Permanent Waters and are under the jurisdiction of the U.S. Army Corps of Engineers. In order to complete construction, it will be necessary to impact waters of the United States in the French Broad River Basin.
