Dear Ms. Beckwith:
The North Carolina Department of Transportation (NCDOT) is in the process of reconstructing
the subject secondary road. The project was originally permitted in 2007 under Action ID No.
SAW-2007-0659-344. Part of the project was constructed as planned and mitigation paid for all
the previously permitted impacts; however, due to lack of funding the project was not completed
and the impacts previously authorized were never used. The original design has changed, which
will require additional culvert length at three previously permitted sites and the relocation of a
section of a roadside stream. Funds have been allocated for this project, and NCDOT would like
to perform these activities in 2011.
am enclosing a PCN, pipe installation detail, photographs, a marked county map and USGS
topographic map. The culverts will be installed slightly below the existing streambed elevations
where bedrock is not encountered to minimize impacts to aquatic habitats; however, all three of
the proposed culvert extension/replacements will be perched due to the steep topography of the
area.
The North Carolina Natural Heritage Program was checked prior to the original construction.
There were no records of threatened and endangered species in the database. There have been
no new records discovered within this watershed since the original permit was issued. The
impacts from extending three culverts should be minimal.
The best management practices will be used to minimize and control sedimentation and erosion
on this project. The construction foreman will review all erosion control measures dailyto

ensure'sWimentation and erosion is being controlled effectively. If the planned devices are not
functioning as intended, they will be replaced immediately with better devices. The rock silt
screens and other erosion control devices will be in place prior to pipe culvert construction and
will remain in.nlace until the project is stabilized.
Impacts to Waters of the United States
Pine Tree Cove Creek (DWQ Class C; Tr.) at site 8, the unnamed tributary of Pine Tree Cove
Creek at site 5 and the unnamed tributary of Jonathans Creek at site 9 are all shown on the USGS
topographic map as perennial. All three streams have well-defined channels with cobble, gravel
and sand substrate. The channels lack vegetation. Pine Tree Cove Creek flows approximately
1M64 to J n, thCreek. The unnamed tributary of Pine Tree Cove Creek at site 5 flows
e?y ?%p atel0 nitles to Pine Tree Cove Creek. The unnamed tributary of Jonathans Creek
flows approximately 0.9 miles to Jonathan Creek. Jonathan Creek flows approximately 12 miles
to the Pigeon River. The Pigeon River meets the definition of a Traditional Navigable Water.
For these reasons, we believe that the unnamed tributaries of Jonathans Creek and Pine Tree
Cove Creek and Pine Tree Cove Creek are Relatively Permanent Waters and are under the
jurisdiction of the U.S. Army Corps of Engineers. In order to complete construction, it will be
necessary to impact waters of the United States in the French Broad River Basin. Specifically,
NCDOT is requesting to extend three culverts and relocated a roadside stream as listed below:

with the construction project outlined above. By copy of this letter, I am asking Mr. David
McHenry, Mountain Region Coordinator, of the North Carolina Wildlife Resources
Commission (NCWRC) to comment directly to you concerning the 404 Nationwide Permit
request.
Also, by copy of this letter, I am requesting authorization under Section 401 of the Clean Water
Act from the North Carolina Department of Environment and Natural Resources (DENR),
Division of Water Quality (DWQ). In addition, I am asking Mr. McHenry and Ed Ingle,
Roadside Environmental Field Operations Engineer (NCDOT), to comment directly to me
concerning this permit request.

The topography is steep along the road which has single family houses. The road serves more or less a linear
subdivision. The vegetation is forested but interrupted by landscaping for homes.

The purpose of the project is to bring the narrow secondary road up to minimal secondary road standards.

This permit covers the final part of construction that was not completed when funding ran out. The road will be widened
by excavation. Pipes will be installed to carry live water and for drainage. The road will be graveled and then paved.
Equipment includes track hoes, bulldozers, dump trucks, various hand tools, sandbags, pumps and diversion pipe.

project was completed and the permit expired in June 20, 2009. The design has changed from what was planned
originally and this permit only Includes the additional new impacts. All the impacts applied for in 2007 were mitigated via
the in lieu fee mitigation program. NCDOT is seeking reauthorization of the approved impacts in 2007 plus those within
this PCN.
