Please be advised that the Nationwide Permit is not valid until a 401 Water Quality Certification has been issued by the.Division. General Certifications have been issue by the Division for most of the Nationwide Permits, however, several of the General Certifications require written concurrence from the Division before the Nationwide Permit is valid. If you are utilizing Nationwide Permit # 26 and your fill activity is equal to or less than one-third (1/3) of an acre you are not required to obtain written concurrence. Otherwise please complete the attached form (except for conditions 15 and 16) and send six additional copies (a total of seven copies) so that the review of your request can be initiated. Based on the submitted plans, it appears that some wetlands will be impacted by this proposal, although the extent of possible impacts is not known. The proposed work may be authorized by our general permit for the installation of utility lines provided that it is constructed in conformance to the enclosed conditions. If the project meets these conditions, we will need three copies of the map showing the exact location of the work. Upon our receipt of these maps, we will authorize the work. INK /"?r'L Enclosed is a copy of our general permit No. 198100049 that authorizes the maintenance, repair and installation of aerial and subaqueous utility lines with attendant structures and the discharge of excavated or fill materials, within construction/access corridors, associated with utility line maintenance, repair and installation in navigable waters and waters of the United States in the State of North Carolina. Please be aware that authorization of the proposed project by this Department of the Army general permit would not relieve you of the responsibility to obtain any other required approvals.
