The Division of Environmental Management (DEM) received a
letter from the Corps of Engineers (COE) stating that your
project qualified for a Nationwide Permit. Please be advised
that the Nationwide Permit is not valid until a 401 Water Quality
Certification has been issued by the Division. General
Certifications have been issue by the Division for most of the
Nationwide Permits, however, several of the General
Certifications require written concurrence from the Division
before the Nationwide Permit is valid.

Dear Mr. Murray:
Reference your recent submittal of plans to Mr. Jeff Richter of my staff
concerning on-going development at 2 Combers Road on Figure Eight Island in
New Hanover County, North Carolina.
On August 12, 1992, Mr. Richter conducted an onsite inspection of this lot
and delineated two small areas of wetlands subject to our regulatory
jurisdiction. Enclosed are copies of 2 Wetland Determination Forms, providing
specific information obtained at stations on your property. The data on these
forms support the delineation of wetlands on your site.
Mr. Richter noticed that although the wetland areas have been partially
surrounded by silt fence, recent rains have apparently resulted in the
deposition of material in these areas. Should the owner's plans include
filling part or all of these areas, or leaving the eroded material in the
wetlands, Department of the Army authorization is required. Our Nationwide
Permit No. 18 authorizes the placement of up to 25 cubic yards of fill in
wetlands provided that the enclosed conditions can be met and concurrence from
the North Carolina Division of Environmental Management is obtained. Also
enclosed is a permit application for your use. The same form is to be used
for both the Corps of Engineer's authorization and the North Carolina Division
of Environmental Management's 401 Water Quality Certification. You may wish
to contact Ms. Tere Barrett of the North Carolina Division of Coastal
Management at telephone [phone] to discuss the need for further State
authorization.
