Z_6Z-///Z The Division of Environmental Management (DEM) received a letter from the Corps of Engineers (COE) stating that your project qualified for a Nationwide Permit. Please be advised that the Nationwide Permit is not valid until a 401 Water Quality Certification has been issued by the Division. General Certifications have been issue by the Division for most of the Nationwide Permits, however, several of the General Certifications require written concurrence from the Division before the Nationwide Permit is valid. If you are utilizing Nationwide Permit # 26 and your fill activity is equal to or less than one-third (1/3) of an acre you are not required to obtain written concurrence. Otherwise please complete the attached form (except for conditions 15 and 16) and send six additional copies (a total of seven copies) so that the review of your request can be initiated. BOX 1890 WILMINGTON, NORTH CAROLINA 28402-1890 IN REPLY REFER TO Regulatory Branch June 15, 1992 Action ID. 199202412, Nationwide Permit No. 26 Mr. Sam Frye Route 1 Aberdeen, North Carolina 28315 Dear Mr. Frye: u t s 1992 Reference the April 16, 1992, meeting between Mr. Jerry Hall of the Moore County Soil Conservation Service and Mr. Jeff Richter of my staff concerning your proposed construction of a pond on a tributary of Horse Creek, on S.R. 1103 about 0.7 mile from NC 5 near Aberdeen, Moore County, North Carolina. Based upon information provided by Mr. Hall and that gathered during the onsite inspection, Mr. Richter has determined that the proposed pond site is located in the headwaters of the tributary, but will involve impacts to approximately 2 acres of wetlands subject to our regulatory jurisdiction, pursuant to Section 404 of the Clean Water Act. As a result, your proposed work in wetlands may qualify for Federal authorization pursuant to nationwide permit (33 CFR 330.5(a) (26)) (NWP 26). Please complete the enclosed pre-discharge notification (PDN) form and submit it to this office. A copy of this PDN must also be furnished to the North Carolina Division of Environmental Management (DEM) as an application for a Section 401 Water Quality Certification. The Section 401 Certification is required to validate NWP 26 in the State of North Carolina; therefore, it must be received from DEM before work which may be authorized by NWP 26 can begin.
