REQUEST FOR MORE INFORMATION
Dear Mr. Radmon:
On October 24, 2003, the Division of Water Quality (DWQ) received our application dated October 24, 2003 to impact
0.19 acres of wetlands, 201 feet of stream and 24,778 square feet (ft) of protected riparian buffers to construct the
proposed residential subdivision. The DWQ has determined that your application was incomplete and/or provided
inaccurate information as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the
additional information requested below, we will have to move toward denial of your application as required by 15A NCAC
2H .0506 and 2B .0233(8) and will place this project on hold as incomplete until we receive this additional information.
Please provide the following information so that we may continue to review your project.
Additional Information.
1. Wetland Impact # 2 (Design) - It appears that the triple culvert design proposed will not provide for adequate
aquatic life passage at low stream flow. Also, it appears that you are proposing to relocate the stream flow into the
wetland. Please provide additional information clearing showing how you will provide aquatic life passage, how you
will not destabilize the stream and how you will not alter the flow of the stream or wetland.
2. Diffuse Flow - All constructed stormwater conveyance outlets shall be directed to flow in a diffuse manner at non-
erosive velocities through the entire protected stream buffers without re-concentrating. If this is not possible it may
be necessary to provide stormwater facilities that are considered to remove nitrogen. Please provide a stormwater
management plan for this project. The plan shalt specify all stormwater discharge points, plan details, and
calculations to indicate that diffuse flow through the protected buffers or nitrogen removal as described above will
be achieved.'
3. Wetland Impact #f2 (No Practical Alternatives) -. You stated in your letter that "if the impacts are not approved
Durham will allow the use of a cul-de-sac in this location". As such, it appears that there is a practical alternative
that avoids the need for this crossing and it's associated impacts. Please provide additional justification as to why
this crossing cannot be avoided. A letter from the City of Durham justifying the need for the crossing may be
helpful.
Please respond within three weeks of the date of this letter by sending this information to me in writing and Mr. Steve
Mitchell of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no
longer want to pursue this project and we will consider the project as withdrawn.
