Y f . 1 1 5 2002 Mr. Clement Riddle Clearwater Environmental Consultants, Inc. 300 North Main Street Hendersonville, North Carolina 28792 Subject: Corporate Technology Center and Town Square at Biltmore Park 401 Certification Application Review DWQ Project No. 02-1389 Buncombe County Dear Mr. Riddle: I have reviewed the application submitted for a 401 Water Quality Certification and have visited the sites for proposed stream and wetland impacts associated with the development. You are requesting to fill approximately 1492 linear feet of streams and 0.24 acres of wetlands. Of the 1492 feet of streams you are proposing to mitigate for the stream loss by providing 841 linear feet of onsite mitigation, 230 linear feet accepted by the Wetlands Restoration Program and 6,488 linear feet of stream preservation. As you know the Division of Water Quality will only accept up to 10% of the total impacts for mitigation because preservation does not replace the aquatic life losses. Based on this review an additional 271 linear feet of stream mitigation are needed to replace the stream losses associated with this project. However, should you choose to reduce the impacts by avoidance, then the mitigation requirements would be reduced. Also, any streams used for mitigation reference reach purposes will need to be approved by the Division as well as the mitigation plan including the list of trees, shrubs and other vegetation used for mitigation and plantings in the stormwater ponds. The information listed above is needed before the Division of Water Quality can issue a 401 Water Quality Certification. Until this information is received and approved, we are placing this project on hold due to incomplete information in accordance with 15A NCAC 2H :0507 (h) and are notifying the Corps of Engineers by copy of this letter.
