All riparian buffers impacted by the placement of temporary fill or clearing activities shall be restored to the preconstruction contours and revegated. Maintained buffers shall be permanently revegetated with non-woody species by the end of the growing season following completion of construction. For the purpose of this condition, maintained buffer areas are defined as areas within the transportation corridor that will be subject to regular DOT maintenance activities including mowing. The area with non-maintained buffers shall be permanently revegetated, with native woody species. before the next growing season following completion of construction.. 2.. During the construction of the project, no staging of equipment of any kind is permitted in waters of the. U.S., or protected riparian buffers. 4. The dimension, pattern and profile. of the stream above. and below the crossing should not be modified. Disturbed floodplains and streams should be restored to natural geomorphic conditions. 5. Heavy equipment shall be operated from the banks. rather than in the stream channel in order to minimi e sedimentation and reduce the introduction of other pollutants into the stream 6. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 7. No rock, sand or other materials shall be dredged from the stream channel except where authorized by this certification. 8. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is prohibited. 9. The permittee and its authorized agents shall conduct its activities in a manner consistent with State water quality standards (including any requirements resulting from compliance with §303(d). of the Clean Water Act) and any other appropriate requirements of State and Federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that State or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification. A copy of this Water Quality Certification shall be posted on the construction site at all times. In addition, the Water Quality Certification and all subsequent modifications, if any, shall be maintained with the Division Engineer and the on-site project manager. 11. The outside buffer, wetland or water boundary located within the construction corridor approved by this authorization shall be clearly marked by highly visible fencing prior to any land disturbing activities. Impacts to areas within the fencing are prohibited unless otherwise authorized by this certification. 12. Upon completion of the project, the NCDOT Division Engineer shall complete and return the enclosed "Certification of Completion Form" to notify DWQ when all work included in the 401 Certification has been completed. 13. Native riparian vegetation must be reestablished within the construction limits of the project by the end of the growing season following completion of construction. 14. There shall be no excavation from, or waste disposal into, jurisdictional wetlands. or waters associated with this permit without appropriate modification. Should waste or borrow sites be located in wetlands or streams, compensatory mitigation will be required since that is a direct impact from road construction activities. 15. Erosion and sediment control practices must be in full compliance with all specifications. governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed,. installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual.. b. The design, installation, operation, and maintenance of the sediment and erosion control measures. must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c., For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act.. 16. Sediment and erosion control measures shall not be placed in wetlands or waters unless otherwise approved by this Certification. WBS Element 5B.209211 The North Carolina Department of Transportation (NCDOT) proposes to remove debris from the Neuse River for protection of the existing bridge structure and to place rip rap along the river banks for streambank stabilization at the Bridge No. 240 crossing on SR 2509 (Mial Plantation Road) in Wake County (Figures 1 - 3). Impacts to Waters of the United States Bridge No. 240 was constructed by the NCDOT in 1959. A recent bridge inspection noted excessive debris dammed against the interior bents which is forcing water towards the river banks and contributing to scouring around the bents and unstable streambanks, especially along the south side of the river (see photographs). The bridge crosses the Neuse River [NCDENR-DWQ Index No. 27-(20.7), Best Usage Classification C NSW; HUC 03020201] (Figure 3) in the Neuse River Basin. The NCDOT proposes to remove the debris from the river by using a `john boat' so the crews can connect cables to the logs and then use an excavator to drag the material onto the north bank. Where the crew will use chain saws to cut the material into pieces small enough to be loaded into dump trucks and hauled off site. The NCDOT also proposes to place approximately 100 linear feet of Class I or Class II rip rap along the south streambank of Neuse River to provide long-term stability. It is not anticipated that the debris removal process will cause damage to the north bank, but we are requesting rip rap armoring for both sides of the river just as a precaution. If the north bank remains stable we'll only add rip rap to the south bank. Permanent stream impacts at the site include 100 linear feet of rip rap along the south bank (and possibly along the north bank) of the Neuse River. Please note that wetland areas associated with the unnamed tributary just west of our construction zone will not be impacted by the proposed activity. Division 5, 2612 N. Duke Street, Durham, NC 27704 Phone: (919) 560-6081 Fax: (919) 560-3371 V Riparian Buffer s Activity at this site involves riparian impacts along the Neuse River and along an unnamed tributary to the Neuse River. The Neuse River is depicted on the most recent version of the Clayton (USGS 1964, 1988) topographic.quadrangle (Figure 1) as well as the Wake County Soil Survey (USDA-SCS, 1970) (Figure 2). However this UT is only depicted on the soil survey. Access is necessary to reach the streambanks along both sides of the river. A construction zone is shown on Figure 3 depicting the maximum area needed to remove the debris and stabilize the stream banks with rip rap. We don't anticipate disturbing this entire area, however we've included this as impacts so that we are certain the requested permits will cover our proposed activity,-Please note that overhead utility lines and a private concrete driveway on the east side of the bridge require that we access the riparian areas from the west side of SR 2509. Along the south side of the river, NCDOT can drive right off the west roadway shoulder to truck in the rip rap for the south bank stabilization. However due to steep fill slopes along the north bridge approach, NCDOT has to find a safer access to the north bank. The City of Raleigh has agreed to allow NCDOT to use their dirt road (approximately 0.4 mile N of the bridge site) to access our site. NCDOT will. drive in this existing road and follow it along the extremities of the farm fields to the SE corner of the field (recently in corn) shown on Figure 3. NCDOT would then use an excavator to track through the woods from this field towards the bridge. We could clear only the minimum space necessary to create a path large enough for dump trucks to travel in and out of the construction zone. This path will be constructed out of No. 57 stone and/or rip rap as necessary. NCDOT requests that this stone material be left in place as a permanent access. This path would be seeded and mulched and allowed to develop in non-woody ground cover, but maintained from becoming established with mature trees. NCDOT feels that a permanent access is required at this site for protection of the existing structure by facilitating routine debris removal. Any other riparian areas disturbed during the proposed activity but not serving as a permanent path or not already within the maintained buffers surrounding the bridge will be revegetated. Temporary erosion control measures will be installed as required within the permitted buffer footprint. Riparian impacts at this site total a maximum of 7,015 square feet in Zone 1 and 6,001 square feet in Zone 2 (totaling 100 linear feet of riparian buffer impacts). Based on the impacts to the riparian buffer at this site, this streambank stabilization and protection of existing structure is ALLOWABLE. Waters of the U.S. Mitigation Avoidance: All surface waters not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. Minimization: Strict enforcement of sedimentation and erosion control Best Management Practices for the protection of wetlands and surface waters will be enforced during project construction. Continued coordination will occur with Bridge Maintenance forces and the Environmental Officer during construction to minimize impacts to these sites. $i Compensato , Mitigation: Compensatory mitigation requirements is not required for this project. Protected Species Plants and animals with federal classifications of Endangered, Threatened, Proposed Endangered, and Proposed Threatened are protected under provisions of Section 7 and Section 9 of the ESA. As of September 2006, there are four federally protected species listed for Wake County. They include bald eagle (Haliaeetus leucocephalus), red-cockaded woodpecker (Picoides borealis), dwarf wedgemussel (Alasmidonta heterdon), and Michaux's sumac (Rhus michauxii). This area along the Neuse River does not provide suitable foraging habitat for the bald eagle. The dense stands of hardwood surrounding this site do not offer suitable forging or nesting habitat for red- cockaded woodpecker. The roadway shoulders along this section of Mail Plantation Road are heavily maintained, eliminating the possibility for Michaux's sumac to exist in this area. No impacts to mussel habitat or mussel fauna are proposed with this debris removal and bank stabilization activity. Additionally, a review of the Natural Heritage Program database (last updated July 2006) revealed no occurrences of protected species within the project area. Therefore, based on lack of suitable habitat observed during the September 2006 site visits and the NHP database review, biological conclusions of No Effect have been rendered for each species. Summary Permanent stream impacts at the site include 100 linear feet of rip rap along the south bank (and possibly the north bank) of the Neuse River. Riparian buffer impacts at this site total a maximum of 7,015 square feet in Zone 1 and 6,001 square feet in Zone 2 (totaling 100 linear feet of riparian buffer impacts). Application is hereby made for a Department of the Army Section 404 Nationwide Permit (NWP) 13 and NCDENR-DWQ Section 401 Water Quality Certification (WQC) No. 3495 and riparian buffer authorization for above- described activity. An automated payment procedure has been implemented between the NCDOT and NCDWQ. This procedure will enable the Division to apply for the 401 WQC without submitting a check for this permit application. This new procedure will provide payment to the NCDWQ by charging the permit application fee of $200.00 directly to the appropriate NCDOT WBS element 513.209211. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of Page 5 of 8 aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing.
