Holiday Drive) in Warren County_ Heavy rains associated with Tropical Storm Alberto on June 14, 2006 (and repeat heavy rains on 07/05/06) have resulted in damage. an existing structure conveying an unnamed tributary to the Roanoke River (Lake Gaston) on SR 1410 (N. Holiday Drive) in Warren County. The existing pipe has separated on the outlet causing the overlaying roadway shoulder to collapse. The North Carolina Department of Transportation (NCDOT) proposes to reset the last two joints of this structure and to repair the associated roadway shoulder (Figures 1 - 2). Impacts to Waters of the United States The project crosses an intermittent stream, UT to the Roanoke River, [NCDENR-DWQ Index No. 23-(12), Best Usage Classification WS-V&B; HUC 03010106] in the Roanoke River Basin. The existing structure that conveys the creek is a 24-inch reinforced concrete pipe that is 40 feet long (see Photographs 1-2). This existing structure has disconnected. The NCDOT proposes to reset the last two joints and rebuild the roadway shoulder section. Rip rap will be used to armor the pipe end and associated fill slope above. During the construction of the project, the NCDOT proposes to temporarily dewater the work zone for approximately 2 days. This will involve the temporary placement of sandbags in the creek at the inlet of this structure and 25 feet downstream of construction. This downstream dewatering location was selected at where the blowhole ends and the normal stream width and elevation exists. To maintain water flow during construction, water upstream of construction will be temporarily pumped out by a hose and conveyed downstream of the construction activity where it will be allowed to filter through vegetation before flowing into the stream. Any effluent from the work area will be pumped to an upland area, over fifty feet away from the stream, within a cut over area where sediment can filter out of the water before reentering the stream, Once the stream Division 5, 2612 N. Permanent impacts at the site associated with the repair will involve no surface water fill, but only rip rap armoring not to exceed 1 OR along the banks at the pipe outlet. Temporary impacts will include the dewatering of 25 feet of stream. Riparian Buffer The project is located in the Roanoke River Basin. Therefore, construction will be completed without impacts to protected riparian buffers- Waters of the U.S. Mitigation Avoidance: All wetlands and surface waters not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. Minimization: The side slopes have been steepened to the extent possible at jurisdictional sites. Strict enforcement of sedimentation and erosion control Best Management Practices for the protection of wetlands and surface waters will be enforced during project construction. Continued coordination will occur with maintenance forces and the Environmental Officer during construction to minimize impacts to these sites. Compensatory Mit ag_tion: All compensatory mitigation requirements will be left to the discretion of the regulatory review agencies. Protected Species Plants and animals with federal classifications of Endangered, Threatened, Proposed Endangered and Proposed Threatened are protected under provisions of Section 7 and, Section 9 of the ESA. As of July 2006, there are two federally protected species listed for Warren County. They include dwarf wedgetnussel (Alasmidonta heterodon) and the Tar spinymussel (Elliptio steinstansana). The intermittent stream of the Roanoke River Basin at this project site is small and within the headwaters of it's system and does not provide suitable habitat for mussel fauna. Additionally, a review of the Natural Heritage Program database (last updated April 2006) revealed no occurrences of protected species within the project area. Therefore, based on lack of suitable habitat observed during the 07/13/06 site visit and the NHP database review, biological conclusions of No Effect have been rendered for each species. Summary The NCDOT proposes to repair the existing structure, by resetting the last two joints of pipe. Permanent impacts at the site associated with the repair will involve no surface water fill, but only rip rap armoring not to exceed l OR along the banks at the pipe outlet. Temporary impacts will include the dewatering of 25 feet of stream. The work zone will be dewatered for approximately 2 days. The materials used for dewatering will be removed after construction. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. if mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h-?o.enr.state.ne.us/newetlands/stffnfjde.htyni. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction.
