McAdams has revised the attached permit application in response to the comments provided below. In addition to
addressing these comments, the application and impact maps have also been revised to add temporary impacts
required to construction the retaining wall and culvert through the site and adjust the quantity of impact resulting from
the riprap dissipator below W. Cabarrus Street. The riprap dissipator had to be revised to meet the design requirements
for the 25-year storm required by the City of Raleigh. McAdams' response to each comment is provided below.
1) The PCN requested authorization under NWP 12 and NWP 39. Impacts listed in the PCN include 61 linear feet of
permanent stream channel impacts for installation of a rip rap dissipater pad and 17 linear feet of temporary
stream channel impacts for constructions of the rip rap dissipater pad.
a. There are no listed impacts that would result from utility line activities, therefore it is unclear the need
for authorization under NWP 12.
The request for NWP 12 was removed from the application.
b. Per NWP 39 Regional condition 4.1.1, discharges in perennial streams, intermittent streams and
wetlands for stormwater management facilities are prohibited. It appears that the proposed rip rap
dissipater pad functions as a part of the stormwater management facilities for the site and does result in
a discharge in a perennial stream, therefore it is unclear if the project could be verified under NWP 39. 1
have attached NWP 39 and its conditions for your review.
The riprap dissipator is necessary for replacement of the culvert under W. Cabarrus Street. McAdams'
Stormwater Impact Analysis report indicates that the post -development impervious area is less than
the pre -development impervious area. Therefore, stormwater treatment and detention are not
required for this redevelopment project. Peak flow from the proposed project equals the existing
peak flow. Although the stormwater from the proposed project discharges to this culvert system, it is
a small percentage of the flow from the 140-acre drainage area upstream of the proposed project as
shown on the attached Drainage Area Map. The riprap dissipator is necessary to provide bank
stabilization and dissipate the energy of flow from the upstream drainage area as well as the
stormwater discharge from the proposed project making the impact eligible for NWP 39.
c. It appears as though the proposed project could potentially be permitted under NWP 18. 1 have
attached NWP 18 and its conditions for your review.

d. Please advise under which NWP the project should proceed under and provide any additional
information that is needed to verify the permit. For example, if the applicant wishes to request
authorization under NWP 18, please provide the quantity of discharged material below the plane of the
ordinary high water mark.

2) Impact Map Exhibit (IM-2 Rosengarten Impact Map) lists impact S1 as "No Loss". Can you please describe the
why the proposed impact results in no loss of aquatic function? For example, will the riprap be installed to
match preexisting contours and elevations?
This dissipator pad will be imbedded in the stream channel to maintain the stream channel dimension
through the riprap pad as shown in the attached cross-section resulting in permanent, no loss impact.
3) In cases where the district engineer determines that the activity may have the potential to cause effects to
properties listed, or eligible for listing, in the National Register of Historic Places, the activity is not authorized,
until the requirements of Section 106 of the National Historic Preservation Act (NHPA) have been satisfied.
According to HPOWEB (http://gis.ncdcr.gov/hpoweb/) accessed on 12/11/2020, the project area is within or in
close proximity to the Old Fourth Ward District (WA4082) listed as SL. Additionally the project is within close
proximity to other mapped historic resources. The Corps has initiated consultation with SHPO but have not
received a response to date.
We are working to retain Archaeological Consultants of the Carolinas and Richard Grubb & Associates, Inc. to
assist with SHPO consultation. We request an email indicating the permit area of the project to assist in this
consultation.

I have reviewed the PCN for the above referenced project and need the following questions/comments
addressed prior to issuance of the permit verification.

The project area is currently developed with commercial, light industrial, residential and institutional uses. There are five structures present within the project area on the north side of
W. Cabarrus Street, including a women’s shelter, a non-profit that serves at-risk youth and Clancy & Theys Construction company. A perennial stream flows along the west side of
Rosengarten Alley on the south side of W. Cabarrus Street. There is an existing headwall within the buffer on the west side of the channel. The subject property vicinity is a densely
developed urban area with residential, commercial, office and industrial uses. Please refer to the attached USGS Location Map (Figure 1), Web Soil Survey Map (Figure 2A), Wake
County Soil Survey Map (Figure 2B) and Subject Property Aerial Map (Figure 3) for more information on the project setting.

The purpose of the project is to develop the property with the necessary infrastructure to provide suitable building areas for a planned mixed-use development in Raleigh.
The project consists of a high-density, mixed-use development, including roads, driveways, parking areas, utilities, stormwater infrastructure and amenities. The proposed project
includes the replacement of a culvert under W. Cabarrus St. that will result in permanent and temporary impacts to Stream S1 on the south side of W. Cabarrus St. The replacement of
an existing sanitary sewer line along Rosengarten Alley will result in Neuse Riparian Buffer impacts. The limits of disturbance for the sewer line replacement includes 5,584 SF of existing
impacts to Zones 1 and 2 of the Neuse Buffer. The existing impacts include Rosengarten Alley and the homes along the east side of the alley. The attached Overall Impact Map (Figure
5) depicts the overall project plan view, and Inset 1 shows the details of the existing and proposed impact areas. Heavy equipment typical for road construction, utility installation and
grading will be used to construct the proposed project such as track hoes, bulldozers, dump trucks and graders.

E. Impact Justification and Mitigation
Impacts due the the sanitary sewer replacement were minimized by conducting the replacement work largely within a previously impacted portion of the
buffer. In areas where the sewer line runs parallel to the stream, the impacts are at least 10 feet from the stream bank. Stream impacts due to the
sewer replacement were avoided by utilizing an aerial crossing at the southern end of the project area. The replacement of a culvert under W.
Cabarrus St. will result in stream and buffer impacts to Stream S1. Impacts from the culvert replacement were minimized by not extending the culvert.
Permanent, no loss riprap impacts will be necessary to properly stabilize Stream S1 on the downstream side of the culvert. A temporary impact to
Stream S1 is required for installation of the riprap dissipater pad. There is an existing retaining wall directly adjacent to Stream S1 that will be replaced
with a head wall within Zone 1 of the buffer. This head wall is necessary to protect the existing structure to the west of the stream. Photos of the
existing retaining wall are attached for reference.
A Sediment and Erosion Control Plan for the project will be developed and approved by City of Raleigh Stormwater, and the project will comply with the
supplementary NPDES Construction Stormwater Permit (NCG010000).

are at least 10 feet from the stream bank. Stream impacts due to the sewer replacement were avoided by utilizing
an aerial crossing at the southern end of the project area.
Replacement of the culvert under W. Cabarrus St. will result in stream and buffer impacts to Stream S1. Impac ts
from the culvert replacement were minimized by not extending the culvert. The proposed riprap dissipator below
W. Cabarrus Street is necessary to properly stabilize Stream S1. This dissipator pad will be imbedded in the stream
channel to maintain the stream channel dimension through the riprap pad as shown in the attached cross -section
resulting in permanent, no loss impact. A temporary impact to Stream S1 is required for installation of the riprap
dissipator pad.
McAdams’ Stormwater Impact Analysis report indicates that the post-development impervious area is less than
the pre-development impervious area. Therefore, stormwater treatment and detention are not required for this
redevelopment project. Peak flow from the proposed project equals the exis ting peak flow. Although stormwater
from the proposed project discharges to this culvert system, it is a small percentage of the flow from the 140 -acre
drainage area upstream of the proposed project as shown on the attached Drainage Area Map. The riprap
dissipator is necessary to provide bank stabilization and to dissipate the energy of flow from the upstream
drainage area as well as stormwater discharged from the proposed project.
There is an existing retaining wall directly adjacent to Stream S1 that will be replaced with a head wall within Zone
1 of the buffer. This head wall is necessary to protect the existing structure to the west of the stream. Photos of
the existing retaining wall are attached for reference.
To construct the retaining wall on the north side of the project and new culvert through the site, the small section
of daylighted stream and adjacent wetland will need to be impacted for construction access. The stream and
wetlands’ pre-construction contours will be restored. A riparian seed mix and black willow live stakes will be
planted to stabilize and revegetate the wetlands.
