Fish Factory Associates, LLC Page Two 9. PROJECT DESCRIPTION The project is located at 4907 Fish Factory Road, adjacent to the Atlantic Intracoastal Waterway (AI W W), in Southport, Brunswick County. To find the project site travel south on US Highway l 7 to NC Highway 133 South. Travel approximately 22 miles south on NC-133 to Dosher Cutoff SE/ NC-133.Turn onto Dosher Cutoff and then turn right at Southport-Supply Rd. SE/ NC-133. Travel approximately 0.8 mile and turn left onto NC-133. Travel approximately T .3 miles and turn left onto Fish Factory Road. The site is located at the terminus of Fish Factory Road on the right. The 0.30 acre lot is bordered by single-family residences to the west and the South Harbor Village Marina to the east. The property consists of a highground area occupied by a building serving as a restaurant, surrounded on three sides by coastal and §404 wetlands. Riprap separates the highground portion of the property from the wetlands. Vegetation adjacent to the riprap consists mainly of Yaupon (Ilex vomitoria), Groundselbush (Bacchuris halimifolia), Salt Meadow Hay (Spartina patens), Sea Oxeye (I3orrichia frutescens) and Wax Myrtle (Myrica cerifera). The vegetation then transition waterward to Spikegrass (Distichlis spicata), Salt Meadow Hay (Spartina patens) and Black Needlerush (Juncos roemerianus), which then transitions further waterward to Salt Marsh Cordgrass (Spartina alterniflora). State permit # 31-99 was issued to South Harbour Village Associates, LLC on June 28, 2006 for the construction of 5 slips in the same location as the proposed docking facility, which was permitted as an extension of South Harbour Marina. However, due to the proposed change in access (from Fish Factory Associates, LLC property, rather than South Harbour Village Associates, LLC dock), it was determined that the structure would require a new permit application. The applicant subsequently made further changes including the addition of another ~ boat slips for a total often. The waters of the A1WW, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish. PROPOSED PROJECT The applicant is proposing to construct a ] 0-slip docking facility consisting of a pier, measuring 1 1 S in length by 6' in width, with a ramp leading to a floating dock in alignment with the pier, which would also measure 1 15' in length by 6' in width. Four finger piers measuring 18' in length would extend from the west side of the pier, to create 6 slips. Three would measure 4' in width. The 4°i and most waterward finger pier would measure ~~ in width. A handrail is proposed on the north side of the northernmost finger pier to prevent usage ul the area acijaccnt to the ramp as a boat slip. Four slips would be designated alongside the float. Twelve tie pilings are also propuscd on the eastern side of the float, six of which would be located on the edge of the riparian corridor. The application states that the water depths range from -2.6' Mean Low Water (MLW) on the northern side of the proposed dock to a depth of -] 0' NLW at the southernmost extent. Additionally, the applicant proposes to construct 77' of elevated boardwalk connecting the upland portion of the property to the pier. The proposed structure would provide docking space for a total often vessels. 10. ANTICIPATED IMPACTS The proposed pier system construction would incorporate 2,070 sq. ft. of Estuarine Waters and Pubic: Trust Area and would shade approximately 990 square feet of coastal and 404 wetlands. Page Three proposed structure would extend approximately 147' from the edge of marsh, which exceeds the'/4 width rule, but the pier would be located within 200' of longer piers and would not exceed 1 /3 the width of the waterbody. The application states the structure would be located a distance of 9.33' from the U.S. Army Corps of Engineers 80' setback. Submitted by: Heather Coats Date: 04/16/07 Office: Wilmington Project Narrative CAMA Major Permit Proposed Boating Facility Brunswick County Fish Factory Associates, LLC, Applicant The applicant proposes construct a new ~115'x 6' pier (beyond NHW line), approximately 77' of elevated connecting boardwalk, one 115' floating dock spine, three 4'x18' floating fingers and one 5'x18' floating finger creating ten boat slips on their property located at 4907 Fish Factory Road, Brunswick County, North Carolina. The property is located on the Atlantic Intracoastal Waterway. The total linear length of the shoreline is 77.59 feet, allowing for a total of 310.36 s.f. of fingers. There is no dredging or wetland fill proposed. None of the proposed structures will extend beyond the existing pier line, into the channel, or more than 6' wide over coastal wetlands. The proposed boating facility is located within 15 feet of the adjacent riparian corridor line to the east, a signed waiver is attached. There is a maximum of 10 slips proposed. A hand rail will be constructed on the landward side of the finger pier adjacent to slip one. There is no additional upland development proposed. Existing man-made features on the tract include a two story building functioning as a restaurant and associated utilities, rip rap and walkways. Vegetation on the tract consists of native trees, shrubs, and grasses along with landscaped areas.
