Your application for an NPDES permit renewal to discharge treated wastewater into Clear
Creek from a proposed wastewater treatment facility ;to be located on NCSR 3102, northeast of
Charlotte, was received on September 24 1991. Our Mooresville Regional Office has performed a
site investigation, and the Division has completed its review of the permit application,
15A NCAC 213 .0201(c)(1) of the North Carolina Administrative Code; requires that each
applicant for an NPDES permit or NPDES permit expansion or renewal to discharge treated waste
will document an effort to consider non -discharge alternatives. In that regard, and in particular, as
a result of adverse public response, the Division requested that you submit an Alternatives Analysis
as outlined in 1A NCAC H .0105(c)(2). This request was made by letter dated February 20,
1992 and a response was requested by April 30,;192 (copy enclosed). No response was received
from Hath-Hill Enterprises.
At this time, the Division is sending your permit application to public notice stating our
intent to deny your application for a NPDES permit renewal.

quality within the State of North Carolina, 15A NC".AC 213 .02 1(c)(1) rewires that each applicant
for an NPDES permit or NPI ES permit expansion or renewal to discharge treated waste will
document an effort to consider non -discharge alternatives. In that regard, and in particular, as a
result of adverse public response, the Division requests that you submit an Alternatives Analysis as
outlined in 15A NCAC 2H .1 1 5(c)(2) (enclosed).
Please address dais issue by April 30, 1992. If this info cation has not been received by
April 30, 1992, the Division will proceed to deny the subject NP:I ES permit renewal request.

topography is:gently rolling with slopes from 2-8%. The flood
plain is hard'to determine at the proposed plant location,;
however, there did not appear to be much of a flood plain
present.

treatment' is Mill unknown at this time.
5. Sludge Handling and Disposal Scheme: The engineer has stated
that the permittee will receive permission From the Charlotte
Mecklenburg Utility Department to deposit sludge in their
sewer system. The permitt e should submit such information
before the issuance of the `Authorization to;Construct.
