The purpose of this letter is to advise you of the importance of'the Permit and the liabilities in the event o failure to comply with the terms and conditions of the Permit. If you have not already done so, it is suggested that you thoroughly read the Permit. Of particular importance are Pages 4, 5 and 6. Pages 4, 5 and 6 set forth the effluent limitations and monitoring requirements for your discharge. Your discharge must not exceed any of the limitations set forth. The section headed "Monitoring Requirements" describes the measurement frequencies, sample types and sampling locations. Upon commencement of your discharge (or operation), you must initiate the required monitoring. The monitoring results must be entered on reporting forms furnished or approved by this Agency. For new permits/facilities, the Division may supply an initial small Mock of these forms; however, if you fail to receive the fonns, please contact this office as quickly as possible. Any changes in operation of wastewater treatment facilities, quantity and type of wastewater being treated or discharged, expansions and/or upgrading of wastewater treatment facilities must be permitted or approved by this Agency. To maintain compliance with discharge limitations, proper operation and maintenance of a wastewater treatment facility and the development of a process control program are essential. For those facilities having chlorine tablet disinfection, please be advised that chlorine tablets approved for wastewater treatment use must be used; swimming pool tablets are not approved. Also, be advised that DWQ staff need to have access to the facility's discharge point into the ` receiving stream; please maintain a loath along the outfall line to facilitate that access, Failure to comply with the terms and conditions of an NPDESPermit subjects the Perittee to enforcement action pursuant to Section 143-1.6 of the North Carolina General Statutes. A civil penalty of up to $25,000 per violation (and/or criminal penalties) may be assessed for such violations. If you find at any time that you are unable to comply with the terms and conditions of the Permit, you should contact this Office immediately. A Special Order by Consent (S}C) may be necessary while pursuing action to obtain compliance. As a final note, an NPDES Permit is normally issued fora five-year period. Permits are not automatically renewed, Renewal requests mint be submitted to this Agency no later than days prior to expiration. Please make note of the expiration date of your Permit. This date is set forth on Page I of the Permit. Also note that NPDES Permits are not automatically transferable. Permit NCO031038 EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A. (3.) ACUTE TOXICITY MONITORING (ANNUAL) The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document ; EPA/600 - 90/027 entitled "Methods for Measuring ` the Acute Toxicity of Effluents to Freshwater and Marine Organisms"" The monitoring shah be performed as a Fathead Minnow (Pimephates pro etas) 4-hour static test. Effluent samples for self - monitoring purposes must be obtained below all waste treatment. The permittee will conduct one test annually, with the annual period beginning in January of the calendar year of the effective date of the permit. The annual test requirement must be performed and reported by June ` 30. If no discharge occurs by dune 30, notification will be made to the Division by this date. Toxicity testing will be performed on the next discharge event for the annual test requirement. The parameter code for this test is TAE6C. All. toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Flow -Me-a-sm-r-e-M —ents Appropriate flow measurement devices and methods consistent with accepted scientific practices shall be selected and used to ensure the accuracy and reliability of measurements of the volume of monitored discharges. The devices shall be installed, calibrated and maintained to ensure that the accuracy of the measurements is consistent with the accepted capability of that type of device. Devices selected shall be capable of measuring flows with a maximum deviation of less than 10% from the true discharge rates throughout the range of expected discharge volumes. Flow measurement devices shall be accurately calibrated at a minimum of once per year and maintained to ensure that the accuracy of the measurements is consistent with the accepted capability of that type of device. The Director shall approve the flow measurement device and monitoring location prior to installation. Once -through condenser cooling water flow monitored by pump logs, or pump hour meters as specified in Part I of this permit and based on the manufacturer's pump curves shall not be subject to this requirement 4. ItaIT-w-ccd-ur-ems Test procedures for the analysis of pollutants shall conform to the EMC regulations (published pursuant to NCGS 143-215.63 et. seq.), the Water and Air Quality Reporting Acts, and to regulations published pursuant to Section 304(g), 33 USC 1314, of the Federal Water Pollution Control Act (as Amended), and 40 CFR 136; or in the case of sludge use or disposal, approved under 40 CFR 136, unless otherwise specified in 40 CFR 503, unless other test procedures have been specified in this pennit [40 CFR 122.41]. To meet the intent of the monitoring required by this permit, all test procedures must produce minimum detection and reporting levels that are below the permit discharge requirements and all data generated must be reported down to the minimum detection or lower reporting level of the procedure. If no approved methods are determined capable of achieving minimum detection and reporting levels below permit discharge requirements, then the most sensitive (methodwith the lowest possible detection and reporting level) approved method must be used. 5. P—MUM&LIAMM89 The Clean Water Act provides that any person who falsifies, tampers with, or knowingly renders inaccurate, any monitoring device or method required to be maintained under this permit shall, upon conviction, be punished by a fine of not more than $10,000 per violation, or by imprisonment for not more than twtoy sper violation, or by both. CATAWBA River Basinwide Water Quality plan (Sub Basin 03-08-13 This Subbasin is in the Southern Outer Piedmont ecoregion and contains the Sugar Creek watershed, a portion of Lake Wylie and much of the City of Charlotte metropolitan area. This is the most heavily urbanized region of the basin and the state, and its population is expected to increase over 30% by 2010. Only 52% of the Subbasin is forested - the smallest percent of any of the basins. Use support ratings in Subbasin 03-08-34 were assigned for aquatic life, fish consumption, recreation and water supply. All water supply waters are Supporting on an evaluated basis based on reports from DEH regional water treatment plant consultants. FILE REVIEW Notices of Violation (NOVs) NOV-2004-LV-0005 was issued on January 8, 2004 for a Benzene limit violation in April 2003. The Mecklenburg Regional Office issued a "Notice of Deficiency" on June 3, 2004 for failure to report Aquatic Toxicity testing on the May 2003 Discharge Monitoring Report (DMR). The facility submitted an amended DMR with the Aquatic Toxicity results. Whole Effluent Toxicity (WET) Test. Division records indicate that this facility has passed its annual acute toxicity test (>100) for four years, from 2000 through year 2004. DMR Review DMRs were reviewed from February 2003 through April 2005. Discharges from 001 were consistent with only November 2004 being reported as "No Discharge". The monthly flow rate was 0.0661 MGD. The highest daily flow occurred in September 2004 at 0.204609. Total suspended solids during this time averaged 4.61 mg/L with a maximum of 8.0 mg/L. The average oil and grease concentration was <5.0 mg/L with a maximum concentration of <5.0 mg/L. The average Turbidity during this time averaged 8.94 ntu with a high value of 33 ntu. The facility has passed its acute toxicity test during this permitting cycle. SITE INSPECTIONS Facility Inspection Correspondence files from 2001-2005 were reviewed. On 2-28-05 Mecklenburg Regional office conducted a site inspection and submitted a NPDES Staff Report and Recommendation report, which indicated that the facility has been in compliance during these inspections. The MRO staff report also stated that it was deferring action relating to the sampling site request from the permittee to the NPDES Unit. On June 3, 2005, the Mecklenburg County Water Quality Program conducted a site inspection and reported that the facility appeared well operated and maintained and that the facility and outfall are visually inspected daily by facility staff to ensure proper operation and safety. The permittee' shall report to the central office or the appropriate regional office any noncompliance which may endanger health or the environment. Any information shall be provided orally within 24 hours from the time the permittee became aware of the circumstances. A written submission shall also be provided within days of the time the permittee becomes aware of the circumstances. The written submission shall contain a description of the noncompliance, and its cause; the period of noncompliance, including exact elates and times, and if the noncompliance has not been corrected, the anticipated time it is expected to continue; and steps taken or planned to reduce, eliminate, and prevent reoccurrence of the noncompliance. The following shall be included as information -which must be reported within 24 hours under this paragraph: (1) Any unanticipated bypass which exceeds any effluent limitation in the permit. Other Information Where the permittee becomes aware that it failed to submit any relevant facts in a permit application, or submitted incorrect information in a permit application or in any report to the Director, it shall promptly submit such facts or information, 9. Persons reporting such occurrences by telephone shall also file a written report in letter form within 5 days following first knowledge of the occurrence. 10. Because the original CHAP was prepared by a different consultant, Engineering -Science's modified plans, specifications and calculations, signed and sealed, have been enclosed as an addendum to the CAP. Although the basic design has remained the same, please note that there have been several changes in details'from the initial submittal. The most notable is a different air' stripper model, resulting from additional available data and higher allowable design effluent concentration based can limits set in the general permit application. This also resulted in the elimination of one train of vapor phase carbon treatment. One other change is the location of the discharge point. Instead of dicharging directly into the upper pored, CPC would like to discharge directly into the unnamed stream below this pond. The discharge would still be 'routed through the large pond on the northern end of the property, The discharge point and stream routing e illustrated in drawings contained in the CAP addendum. Lead analyzes for the trench and` recovery well are included in the sampling data previously submitted with the initial application submittal. Beath are below the detection limit of 0.005 mg/ . All available sampling data, collected for design purposes, is included as appendices in the CAP addendum. This includes the additional data from ft - , RW-3 and RW-4 (formerly GW-1, GW-2 and W- . Lead was detected at 14 mg/l in a composite sample from these wells.' By-product disposal will consist of free product from the oil/water separator, iron solids from the iron removal filter, and spent carbon. The recovery wells have only a sheen of product so no significant amount is expected to be collected. Any product that does accumulate will be returned to the pipeline system. Sampling indicates that iron concentrations are relatively low, so again no significant amount is expected. Iron win be disposed of off site at a permitted disposal facility.
