The rule requires NPDES regulated facilities to report information electronically, instead of filing written paper reports. The rule does not change what information is required from facilities. it only changes the method by which information is provided (i,e., electronic rather than paper -based): EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their key milestones, are: • Phase 1—Starting on December 21, 2016, regulated entities that are required to submit Discharge Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently reporting your DMR data electronically using eDMR, then you simply need to continue reporting in the same way as you are now. The key change is that, starting on December 21, 2016, electronic reporting of DMRs will be required, instead of voluntary, • Phase 2 —Starting on December 21, 2020, regulated entities that are required to submit certain other NPDES reports will begirt submitting these reports electronically, Reports covered in the second phase include Notices of Intent to discharge in compliance with an NPDES general permit, Sewer Overflow/'Bypass Event Reports, and a number of other NPDES program reports. Incorporating Electron e Reporting Requirements into NPDES permits The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic reporting requirements into NPDES permits beginning December 21, 2015. Permittees are required to electronically submit the required NPDES information to the appropriate initial recipient, as determined by EPA. By July 18, 2016, EPA must identify and publish on its web site and in the Federal Register a listing of initial recipients by state and by NPDES data group. Once available, you can use EPA's web site to find out or determine the initial recipient of your electronic submission. NC DR has submitted a request to EPA to be the initial recipient for the following NPDES data groups: 1. Discharge Monitoring Reports; 2. General Permit Reports [Notices of Intent to discharge (NOls); Notices of Termination (NOTs)]; 3. Pretreatment Program Reports; and 4. FLOW MEASUREMENT: Flow measurement is accomplished by multiplying the known flow rate from the discharge pipe by the discharge duration, Based on the current permit, this is an acceptable flow measurement method. LABORATORY: Chemical analysis of effluent samples and acute toxicity testing is performed by Environmental Science Corp., (NC Laboratory Certification #375 & #041). Environmental Science Corp. was not evaluated asp of this inspection, EFFLUENT/RECEIVING WATERS: Outfall 001 consists of a riprap-lined ditch, which flows to an unnamed tributary to Gum Branch, which is a Class WS-IV water in the Catawba River Basin. The facility was not discharging at the time of the inspection. SELF -MONITORING PROGRAM: Monthly monitoring reports were reviewed for the period June 2014 through May 2011. The reports indicate that the facility was in compliance with permit effluent limits during this period. However, the permittee was flagged by the Division's Compliance database for not monitoring the effluent fro?utfall 001 for EPA 625 analyses in the last half of 2011. A review of the noted DMRs found that an EPA parameter code is not notated on the top of the DMR coal when the EPA 625 analyses were reported. The Division's data entry staff does not enter any data unless it has a corresponding EPA parameter code; this generated the monitoring violation. A permit renewal application had been submitted. A permit renewal application was submitted February 2010. The new permit is currently under review by the Division n of Water Quality. Until the new permit is issued the facility should continue to operate under the requirements of the expired permit. The permit authorizes the discharge of stormwater/wastewater from Outfall 001 The current permit lists the NPDES treatment works as consisting of a waste holding tank and a bermed area with flow siphon and hand -operated discharge valve. The permit properly describes the facility and appears adequate for the wastewater being discharged. The certification classification for NCO021962 requires that the facility have an operator in responsible charge (OiRC) with a Grade 1 Physical Chemical Water Pollution Control System (PC-1) certification. The facility is staffed (ORC and back-up) with personnel that possess the appropriate operator certification. RECORDS/REPORTS: Discharge Monitoring Reports (D d laboratory analytical reports were reviewed for the period November 2002 through March 2004. The reports appeared to be properly completed. All data, reports, operational logs, and manifests were readily available at the facility. The records were clear, organized, and well maintained; no discrepancies were noted. FACILITY SITE REVIEW: The runoff from the covered fueling rack and manifold areas flows through two oil/water separators, an equalization tank, an air stripper, two carbon filters, then flaws to a holding tank. The facility contracts US Filter, Inc. to haul the fueling rack wastewater from the holding tank off -site for treatment and disposal. All of the NPDES treatment works for this waste stream remain intact at the facility. The storm water collected in the aboveground storage containment basins is visually inspected d can be manually released through Outfall 001.If deemed necessary, this storm water can be routed through an oil/water for prior to discharge at Outfall 001. The facility has ailed a spray irrigation system (Permit No. WQ0019911) to discharge the storm ter from the aboveground storage tank containment basin. The spray .irrigation system has been in operation since February2002. Any product collected by the oil/water separators is transferred to a holding tank and eventually hauled tiff -site by US Filter, Inc.. All of the major components of the facility treatment works were in service and appeared o be operating properly at the time of the inspection. FLOW MEASURENWNT: Flow measurement is accomplished by multiplying the known flow rate from the discharge pipe by the discharge duration. Based on the current permit, this is an acceptable fltr measurement method. LABORATORY: Chemical analysis of effluent samples was performed by Severn Trent Laboratories, (NC Laboratory Certification #395). Severn, Trent Laboratory was not evaluated under this inspection. EFTLUEITT /RECEIVING WATERS.- Outfidl 001 consists of a riprap-lined ditch, which flows to an unnamed tributary to Gum Branch, which is a Class WS-lV water in the Catawba River Basin. Mr. Utke escorted Mr. Klemm to the areas where the cleanup effort had been conducted. These included observing the location of the original release, walking the drainage feature through a wooded area and onto the Colonial Pipeline property, and observing the areas where underfloor dams had been constructed and absorbent booms had been deployed. Photographs were taken to document the cleanup effort. The photographs were taken as close as possible to the previous photographs taken during the cleanup effort. A copy of the photographs are attached. The general observation of the cleanup was very good. There was no remaining visible flowing sheen on the water surface, the unerflow dams had been removed and the areas re -seeded with grass, and the absorbent booms and pads had been removed and disposed. A key observation in the stream on the Colonial Pipeline property was the existence of aquatic life including multiple schools of small minnows, tadpoles and frogs, and small bluegill sunfish. Approximately 83 5 gallons of mixed gasoline/diesel fuel was released from a Process Contact Water P ) tank on April 21, 2003. The fuel mixture entered a drainage feature which flowed to an unnamed tributary of Gum Branch. Gum Branch was not affected by the release. The 835 ,gallon estimate should represent a fair approximation of the release as it was contained within the unnamed tributary, Virtually all the product was recovered utilizing absorbent pads and vacuum trucks with the aid of flushing the drainage ditch and creek with uncontaminated stormwater stored in the onsite containment area. Disposal of the recovered crater and fuel was manifested by HAZ-MAT Transportation and Disposal of Charlotte, North Carolina. The manifests indicate disposal of a total of 885 gallons of water and product of which 835 gallons were reported as product. A total of drums of absorbent pads and booms were manifested for disposal by A&D'Environmental of High Point, North Carolina. . The spilled occurred on April 21", 2003 and was discovered at approximately 4:00 PM. Recovery efforts were initiated immediately and were completed by the afternoon of April 3 The cause of the spill was an overfilled PW tank. . The spill entered a drainage ditch and flowed to an unnamed tributary of Gum Branch on the adjacent Colonial Pipeline Company property. The release was contained within the unnamed tributary and did not affect Gum Branch. Gum Branch eventually flows to the Catawba River. . According to the Self -Monitoring section of the NOV, there were three exceptions listed as deficient. As a background reference, CITGO received a spray irrigation permit number WQ0019911 dated January 7, 2002 to discharge tank farm storm water through a spray irrigation process. The intention of this system and permit was to completely eliminate any discharges through the existing NPDES outfall; permit number NC0021962. The issuance of the spray irrigation permit was expected during the latter part of 2001 but was not received until January of 2002. We did not anticipate any NPDES discharges in 2002, Because of the delay in issuance, it was necessary to discharge through the NPDES systern for two days in January. At the time, all normal monthly discharge parameters were sampled as per permit requirements. Unfortunately, the annual requirement for acute toxicity was not taken. • The Division of Water Quality has already issued a Notice of Violation regarding the Toxicity requirement. We discussed this situation with Mr. Kevin Bowden, and Mr. Jimmy Overton issued the NOV dated May 30, 2003. 1 have enclosed a copy for your review. • The MTBE was properly sampled during January, but was not included on the January report. The level was non -detect and I have included a copy of the lab report for your review and consideration. • There was an ETA method 624/625 sample taken for the spray irrigation permit in June of 2002. This sampling is from the exact same strearn as the NPDES permit and was reported as required for the spray irrigation permit. I have included a copy for your review and consideration, As you can see by the documentation we have provided, the only item required by the NPDES permit that we failed to provide the agency was the toxicity test for 2002. In past years the toxicity test has always been within state standards, and we have no reason to believe it would not have been within standards during our one time discharge in 2002.
