APPROVAL of 401 Water Quality Certification with Additional Conditions

You have our approval, in accordance with the attached conditions and those listed below, to permanently
impact 100 linear feet (If) (for additional culvert length, drop box and inlet riprap stabilization) and to temporarily
impact 60 If (for temporary cofferdams) of an unnamed tributary to the South Fork Catawba River* to replace
an existing, deteriorating culvert as described in your application received by the Division of Water Quality
(DWQ) on May 15, 2006. The location of the project is Highway 27 in Lincoln County. After reviewing your
application, we have determined that this project is covered by Water Quality General Certification Number
3404. Please note that you should get any other federal, state or local permits before proceeding with your
project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and
Water Supply Watershed regulations.
This approval is valid solely for the purpose and design that you described in your application (unless modified
below) and will expire with the associated USACE 404 permit unless otherwise specified in the Water Quality
Certification. Should your project change, you must notify the DWQ in writing and you may be required to
submit a new application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project
(now or in the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear
feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h)(6) and (7). For this
approval to remain valid, you must adhere to the conditions in the attached certification and those listed below:
1. Design and placement of culverts and other structures including temporary control measures shall be
installed in such a manner that the original stream profiles are not altered (i.e., the depth of the channel must
not be reduced by a widening of the streambed). Existing stream dimensions (including pattern and profile)
are to be maintained above and below locations of each culvert. The applicant may be required to provide
evidence that the equilibrium has been maintained, if requested in writing by the DWQ.
2. Riprap must not interfere with thalweg performance and aquatic life passage during low flow conditions.
3. Heavy equipment must be operated from the banks rather than in the stream channel, when possible, in
order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.
4. Temporary dewatering sites must be restored to pre-existing conditions unless more natural geomorphic
conditions can be provided.

5. No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened.
6. The dimension, pattern and profile of the stream above and below the crossing should not be modified.
Disturbed floodplains and streams should be restored to natural geomorphic conditions.
7. All -mechanized equipment operated near surface waters must be regularly inspected and maintained to
prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
8. All work shall be performed during low or normal flow conditions.
9. Discharging hydroseeding mixtures and washing out hydroseeders and other equipment in or adjacent to
surface waters is strictly prohibited.
10. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full
compliance with all specifications governing the proper design, installation, and operation and maintenance of
such BMP in order to protect surface water standards:
a. The design, installation, operation, and maintenance of the sediment and erosion control measures
must be such that they equal, or exceed, the requirements specified in the most recent version of
the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all
construction sites, borrow pit sites, and waste pile (spoil) projects, including contractor-owned or
leased borrow pits associated with the project.
b. For borrow pit sites, the erosion and sediment control measures must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina Surface
Mining Manual.
c. The reclamation measures and implementation of these measures must be in accordance with the
requirements of the Sedimentation Pollution Control Act.
11. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable,
they shall be removed and the natural grade restored within 30 days after the Division of Land Resources has
released the project.
12. The North Carolina Department of Transportation (NCDOT) and its contractors and/or agents shall not
excavate, fill or perform mechanized land clearing at any time in the construction or maintenance of this
project within waters and/or wetlands, except as authorized by this Certification, or any modification to this
Certification (e.g., no work shall occur outside of the footprint of the plans provided). In addition, there shall
be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this
Certification without appropriate modification. If this occurs, compensatory mitigation may be required since it
is a direct impact from road construction activities.
13. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of
Completion" form to notify DWQ when all work included in the 401 Certification has been completed. Please
include photographs upstream and downstream of the structure to document correct installation.
14. Continuing Compliance. NCDOT shall conduct its activities in a manner so as not to contravene any state
water quality standard [including any requirements for compliance with section 303(4) of the Clean Water Act]
and any other appropriate requirements of state and federal law. If DWQ determines that such standards or
laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal
law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate
and modify this certification to include conditions appropriate to assure compliance with such standards and
requirements in accordance with 15 A NCAC 2H.0507(d).

Before codifying the certification, DWQ shall notify NCDOT and the USACE, provide public notice in
accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A
NCAC 2H.0504. Any new or revised conditions shall be provided to NCDOT in writing, shall be provided to
the USACE for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also
become conditions of the 404 Permit for the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714
Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless
you ask for a hearing.

Pipe replacement on Highway 27-Lincolnton, Lincoln County
The North Carolina Department of Transportation proposes to replace a deteriorating pipe on
Hwy 27 in Lincolnton in Lincoln County. The road shoulder above the streampipe collapsed and
stormwater dropbox and pipe located on the road shoulder was nearing collapse; therefore, this
was considered an emergency project and construction commenced immediately. The new pipe
was installed using the boring/jacking method due to its location on a major highway and the
amount of fill above the existing pipe. The existing 150 foot, 30" pipe was replaced with a 177-ft
long, 42" steel pipe. A staging area for the boring machine is located on the bank at the pipe
outlet. This area will bed seeded and stabilized upon projection completion. The site is located in
an urban area; therefore, trash/debris and possible fill had been placed in the stream immediately
upstream of the pipe causing the existing pipe inlet to be buried -4 feet below the existing
upstream streambed elevation. It was necessary to excavate the upstream area to locate the pipe
inlet and also to remove a large amount of trash and debris. The type of soil found in this area
necessitated that 50 feet of disturbed upstream channel be rock lined to provide stabilization. The
embankment above the rock was either matted or seeded/mulched (refer to enclosed sketch). The
old pipe was perched approximately 4 feet and a large scour area had formed at the pipe outlet.
The new pipe was bored in a new location and due to the limiting work area, it was necessary to
perch the new pipe. The scour hole at the old pipe outlet will be filled and stabilized. Per DWQ
request, a drop box catch basin will be utilized at the new pipe outlet to dissipate energy from the
perched stream pipe and from a stormwater discharge pipe. A short pipe section will extend from
the drop box in alignment with the downstream channel. The reconstruction of the failing road
embankment will include the regrading of the area at the stream dropbox to "hide" the dropbox
from view and provide an aesthetically pleasing view at the request of the adjacent property
owner.

NCDOT requests a waiver from the Regional Condition 2(bxe) permit depth specification, for the
construction of this project due to the existing site condition and the necessity to utilize the
downstream mstream dropbox structure. Downstream temporary cofferdams are being utilized to
provide erosion/sediment control during project construction. Upon project completion, the area
impacted by the temporary cofferdam will be restored to pre-project conditions. The total scope
of the work will result in a 100 feet of permanent impacts and 60 feet of temporary impacts to an
unnamed tributary to South Fork Catawba River, which is classified as a WS-IV watershed by the
Division of Water Quality
The project is located on a rural/urban arterial; however, it is not located within lh mile of any
critical watershed; therefore, hazardous spill basins are not required. Enclosed is the hazardous
spill basin checklist. This office has conducted a GIS and field survey for the project and is
recommending a finding of "no effect" for T&E species and historical structures.
I have enclosed a pre-construction notification for a NW#14, sketches of planned activities, and
location maps relative to the project.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate 'USGS Topographic Quad Map and NRCS Soil Survey with the property

feet and had a large scour area was located at the pipe outlet. The new pipe was bored in a
new location and due to the limiting work area, it was necessary to perch the new pipe. The
scour hole at the old nine outlet will be filled and stabilized. Per DWQ request, a drop box
catch basin will be utilized at the new pine outlet to dissipate energy. A second short nine
will extend from the drop box in alignment with the downstream channel. An upstream storm
flow pine from Highway 27 will discharge onto the rock used at the inlet for structure
stabilization A downstream stormflow pine will discharge into the drop box at the pipe
outlet The staging area for the boring machine will be seeded and stabilized, as well as the
disturbed downstream bank. The reconstruction of the failing road embankment will include
the regrading of the area around the stream dropbox to "hide" the dropbox from view and
provide an aesthetically pleasing view at the reguest of the adjacent property owner. The
installation will be accomplished with the use of backhoe and boring machine.
11. Explain the purpose of the proposed work: The purpose of the proposed work is to replace
a deteriorating pipe to reconstruct an adeguate road shoulder for the safety of the travelling
public and to repair a stormwater dropbox and pipe.

VI. Proposed Impacts to Waters of the United States/Waters of the State

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Due to the location of the pipe on a major hi hway, the new pipe was installed using the boring
and jacking method to reduce traffic disruption. The staging area will be seeded and stabilized.
The existing, site conditions determined the elevation at which the new pipe was bored. A drop
box was utilized at thep M outlet rather than downstream bank armoring to provide energy
dissipation of flow during storm events (the area is an urban area with "flashy" stormflows. The
stream is a small urban stream with little aquatics.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
httv://h2o.enr.state.nc.us/newetlands/strmgide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
AU mitigation required by USACE will be provided in accordance with guidelines outlined
in the USACE letter of 9/1/04 from Mr. Ken Jolly to Dr. Gregory Thorpe.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at
(919) 733-5208 to determine availability and to request written approval of mitigation prior
to submittal of a PCN. For additional information regarding the application process for the
NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wrp/index.htin. If use of
the NCWRP is proposed, please check the appropriate box on page three and provide the
following information:
