JAY ZIMMERMAN k, . � June 24, 2016 Michelle Haas City of Charlotte 600 E 4th S Charlotte, NC 28202 Subject: NPDES Electronic Reporting Requirements Myrtle % Morehead Storm Grain project NPDES Permit number: NCO08 443 Dear NPDES Permittee; The U.S. Environmental Protection Agency (EPA) recently published the National Pollutant Discharge Elimination System (NPDES) Electronic Reporting Rule, The rule requires NPDES regulated facilities to report information electronically, instead of filing written paper reports. The rule does not change what information is required from facilities. It only changes the method by which information is provided (i.e., electronic rather than paper -based). EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their key milestones, are: • Phase 1 --Starting on December 21, 2016, regulated entities that are required to submit Discharge Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently reporting your D R data electronically using eDMR then you simply need to continue reporting in the same way as you are now. The key change is that, starting on December 21, 201, electronicreporting of DMRs will be required, instead of voluntary. • Phase 2 —Starting on December 21, 2020, regulated entities that are required to submit certain other NPDES reports will begin submitting these reports electronically. Reports covered in the second phase include Notices of Intent to discharge in compliance with an NPDES general permit, Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports. Incorporating Electronic Reporting Requirements into NPDES Permits The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic reporting requirements Into NPDES permits beginning December 21, 2015. Under the new rule, the electronic reporting process supersedes the paper reporting process, According to our files, your NPDES permit became effective after November 2013, and should contain the requirement to electronically report your Discharge Monitoring Reports using NC DWR`s eDMR system. By July 18, 2016, EPA must identify and publish on its web site and in the Federal Register a listing of initial recipients by state and by NPDES data group. Once available, you can use EPA's web site to find out or determine the initial recipient of your electronic submission, NC DWR has submitted a request to EPA to be the initial recipient for the following NPDES data groups: 1. Discharge Monitoring Reports; 2. General Permit Reports [Notices of Intent to discharge (NOls),- Notices of Termination (NOTs)]; 3. Pretreatment Program Reports; and 4. I understand that the City of Charlotte has or will request that this pipe be covered when it is not in use for dewatering. Sand bags at Sanders deatering site which were used to channelize flow to drop basin have burst open and sand has collected in sediment trap. I'understand that the City of Charlotte has or will arrange for the sand to be removed from the sediment trip and the sand bags will be repaired or replaced. I noted in the November 24 2015 correspondence that the treatments systems operated normally during the reporting period and I have no reason to suspect that the concentrations of target analytes specified by the permit i were exceeded. Copies of analytical results for sample` collected at Outfalls 001 and 053 on this date are attached; Since no modification to the treatment systems occurred between the time samples were collected in September 2015 and November 2015 1 the analytical results for the November 10, 2015 suggest that no I exceedances of permit limits occurred in October 2015, Carbon adsorption is the treatment method used at both systems. The fact that no VOCs or TSS were detected in the November 1, 2315 samples is indicative that carbon breakthrough has not occurred." I had scheduled collection of effluent samples for laboratory analyses for October 7, 2015, At the time of the site visit on that date,; no water was flowing into the treatment system which discharges to Outfall 003. After collecting samples for pH measurement, I noted that there was insufficient water remaining in system to collect samples for analyses by a commercial laboratory. The water level in the transfer tank had fallen to the invert of the inlet line for the discharge primps. I intended to collect effluent samples at the treatment systems later in October 2015, but for some reason I did not remember to do so. I have set up reminders on my office computer which automatically open up on the 1501 of each month for me to verify that effluent samples have already been taken for that month. As indicated by this response, the violations occurred due to human error, Furthermore, it is unlikely that the concentrations of target analytes specified by the � permit exceeded limits in October 2015 based upon the analytical results of samples collected in early -November 2015 and the nature of the treatment units at this project location. I have taken steps to prevent this oversight from reoccurring in the future. Each GAC unit contains approximately 1,000 pounds of carbon, The City took steps to further evaluate the issue including the collection and analyses of influent samples to each of the GAC units on March 25, 2015, The results indicate that the influent to the first GAC unit contained low levels of PCE (.O µgll) and the influent to the second GAC contained PCE at concentrations 11 pg11 which is below the monthly average limit for this parameter (3.3 p11). Copies of these results are attached. Based upon review of this data, the City believed there was capacity in the 2,000 pounds of carbon to continue to adsorb PCE and prevent exceedanes of the permit limit, Upon receipt of the May 7, 2015 analytical results which indicated that the PCE limit was exceeded, the ;City took immediate steps to rectify the issue. These results were received on May 1, 205 and on May 22, 2015 one GAC unit was taken offline and the carbon was replaced and hydrated. On May 27, 2015, the second GAC vessel was taken offlne and the carbon was replaced and hydrated. The carbon replacement was done in two steps in order for the treatment system remain operational. PCE has not been detected in effluent samples collected since the carbon was replaced in May 2015. Conclusions As indicated by this response, the City has taken prompt actions to mitigate PCE issue. (Nesco Environmental) prepared this correspondence to document an unanticipated bypass of the treatment system for the referenced NPDE S Permit and Qutfall referenced above. A notification of this incident was forwarded to Mr. Michael Parker of your agency by email on December 25, 2014. During the evening of December 22, 2014, the North Carolina Department of Transportation (NCDOT) contacted Bradshaw Construction Corporation (Bradshaw) regarding an overflow of a holding tank at the treatment plant. Bradshaw is a contractor who is performing excavation and tunneling activities near £Jutfall No. 001. Bradshaw has been subcontracted by the Prime/General Contractor (Sanders Utility Construction Company, Inc.[Sanders]) to perform certain aspects of the project. Based upon review of internal email correspondence, Nesco Environmental understands that Freddie Young of Sanders visited the site sometime before 3:14 PM. Evidently, the generator which powers the treatment system was not running for some reason. Electrical power was evidently being supplied to the sump pump which was installed in the excavation shaft and water was pumped into a 2,100-gallon holding tank which eventually overflowed. Mr. Young deactivated the sump pump during his visit so water would not continue to overflow the flank. During the period between December 16, 2014 and December 23, 2014, water was extracted at a rate of approximately 2.61 gallons per minute (gpm). Taking the average flow rate of 2.61 gpm and multiplying it by 389 minutes, a volume of 1,015 gallons is calculated. The holding tank has approximately 840 gallons of capacity above the set point where the pumps actuate. Subtracting 1,133 gallons by 840 gallons, a volume of 175 gallons is calculated. used upon the foregoing, Nesco Environmental concludes that no more than 175 gallons of untreated ground water bypassed the treatment plant and was discharged without treatment. Samples of the water being extracted from project excavation were collected on November 26, 2014 and again on January 5, 2015. The November 26, 2014 samples were analyzed for selected metals, volatile organic compounds (VOCs), and semi -volatile organic compounds (SVOCs). The January 5, 2015 samples were analyzed for VOCs and SVOCs. With the exception of barium, metals were not detected in the November 26, 2014 samples. Barium was detected at a concentration 49.4 micrograms per liter (tag/1) in the November 26, 2014 samples which is less than the North Carolina surface water standard of 1,000 Pg/L With the exception of chloroform, VOCs were not detected in the samples collected on either November 26, 2014 or January 5, 2015, Chloroform was detected at a concentration of 2.0 pg/l in the samples collected on both dates. The most restrictive (i.e., lowest) North Carolina surface water standard for chloroform is 5.6 pg/1. SVOCs were not detected in the samples collected on either November 26, 2014 or January 5, 2015. It should be noted that the NPDES permit requires monitoring of the effluent for pH and total suspends solids and neither of these parameters were monitored in the influent during the November 26, 2014 or January 5, 2015 sampling events. Figure 3 in Appendix A is a proposed remedial system schematic. Three stormwater drains have been approved as outfalllocations. Two additional outfall locations are proposed and may he used depending the final location of the systems. That is, the goal of the project is limit flooding during major storm events, which, especially in urban settings, present significant contributions to adverse surface water quality conditions. The routing of the drain in its large diameter, downstream segment as proposed will aid the project schedule and limit the number of flood events affecting headwaters of the drainage during the planning and construction phases. Please note that the project design includes methods to seal the drain against impacted groundwater; incursion across intervals affected by groundwater impact. Other possible project routes would also be affected by subsurface environmental impact and would also require some degree of dewatering fluid treatment by NPDES permitting, given the urban setting of the project. In conclusion, the proposed NPDES permit will allow construction of a drainage improvement that will ultimately serve to increase water quality. Because of the extensive :nature of the construction, the project schedule is anticipated to extend beyond the current permit termination date of June 30, 2015.
