The project shall be constructed in accordance with your application dated May 30, 2006, received June 9, 2006. After
reviewing your application, we have decided that these impacts are covered by General Water Quality Certification
Number 3404. This certification corresponds to the Nationwide Permit 14 issued by the Corps of Engineers. In addition,
you should acquire any other federal, state or local permits before you proceed with your project including (but not
limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will
expire with the accompanying 404 permit.
This approval is valid solely for the purpose and design described in your application (unless modified below). Should
your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must
be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions.
If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the
future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and
(7). For this approval to remain valid, you must adhere to the conditions listed in the attached certification as well as the
following:
Additional Conditions:
Placement of culverts and other structures in waters, streams, and wetlands shall be placed below the elevation of the
streambed by one foot for all culverts with a diameter greater than 48 inches, and 20 percent of the culvert diameter for
culverts having a diameter less than 48 inches, to allow low flow passage of water and aquatic life. Design and placement
of culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may
result in dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the above
structures. The applicant is required to provide evidence that the equilibrium is being maintained if requested in writing by
DWQ. If this condition is unable to be met due to bedrock or other limiting features encountered during construction,
please contact the NC DWQ for guidance on how to proceed and to determine whether or not a permit modification will
be required.
If concrete is used during construction, a dry work area should be maintained to prevent direct contact between curing
concrete and stream water. Water that inadvertently contacts uncured concrete should not be discharged to surface waters
due to the potential for elevated pH and possible aquatic life and fish kills.
During the construction of the project, no staging of equipment of any kind is permitted in waters of the U.S., or protected
riparian buffers.
The dimension, pattern and profile of the stream above and below the crossing should not be modified. Disturbed
floodplains and streams should be restored to natural geomorphic conditions.
The use of rip-rap above the Normal High Water Mark shall be minimized. Any rip-rap placed for stream stabilization
shall be placed in stream channels in such a manner that it does not impede aquatic life passage.
All work in or adjacent to stream waters shall be conducted in a dry work area. Approved BMP measures from the most
current version of NCDOT Construction and Maintenance Activities manual such as sandbags, rock berms, cofferdams
and other diversion structures shall be used to prevent excavation in flowing water.
Heavy equipment shall be operated from the banks rather than in the stream channel in order to minimize sedimentation
and reduce the introduction of other pollutants into the stream.
All mechanized equipment operated near surface waters must be regularly inspected and maintained to preven
contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
No rock, sand or other materials shall be dredged from the stream channel except where authorized by this certification.

Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is
prohibited.
The permittee and its authorized agents shall conduct its activities in a manner consistent with State water quality
standards (including any requirements resulting from compliance with §303(d) of the Clean Water Act) and any other
appropriate requirements of State and Federal law. If DWQ determines that such standards or laws are not being met
(including the failure to sustain a designated or achieved use) or that State or federal law is being violated, or that further
conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification.
All fill slopes located in jurisdictional wetlands shall be placed at slopes no flatter than 3:1, unless otherwise authorized
by this certification.
A copy of this Water Quality Certification shall be posted on the construction site at all times. In addition, the Water
Quality Certification and all subsequent modifications, if any, shall be maintained with the Division Engineer and the on-
site project manager.
The outside buffer, wetland or water boundary located within the construction corridor approved by this authorization
shall be clearly marked by highly visible fencing prior to any land disturbing activities. Impacts to areas within the
fencing are prohibited unless otherwise authorized by this certification.
Upon completion of the project, the NCDOT Division Engineer shall complete and return the enclosed "Certification of
Completion Form" to notify DWQ when all work included in the 401 Certification has been completed.
Native riparian vegetation must be reestablished within the construction limits of the project by the end of the growing
season following completion of construction.
There shall be no excavation from, or waste disposal into, jurisdictional wetlands or waters associated with this permit
without appropriate modification. Should waste or borrow sites be located in wetlands or streams, compensatory
mitigation will be required since that is a direct impact from road construction activities.
Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
Sediment and erosion control measures shall not be placed in wetlands or waters unless otherwise approved by this
Certification. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be
removed and the natural grade restored upon completion of the project.
This approval will expire with the accompanying 404 federal permit. This condition supercedes condition No. 19 in
General Certification No. 3404.

If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699. This certification and its conditions are final and binding unless you ask for a hearing. This letter
completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

Subject: Notification for Nationwide Permit 14 (Minor Road Crossing)

Culvert Replacement SR -2023 (Holiday Rd)-Harnett County
State Project Number: 6C.043023
The North Carolina Department of Transportation (NCDOT) has scheduled to grade, drain, base
and pave SR-2023 (Holiday Rd) in Harnett County. Total project length is 0.39 mile. The
roadway will be widened from 16 feet to 20 feet and stabilized grass shoulders (6 foot) will be
provided. This project will require the replacement of one (1) wet cross line as shown below:

Construction of this project will require impacts to waters of the United States in the Cape Fear
River Basin. Crossing 41 will convey an UT to Lower Little River (C). The Hydrologic
classification unit for this area is 03030004. The Lower Little River is classified as 303(d) water,
located in the subbasin 03-06-14 with an assessment unit of (18-23-24). This area has a standard
violation of low pH, with an unknown source.
Wetland #1 was identified at Sta. 01+50 with marginal hydrology. This area is very close to the
60-foot right-of-way. Minimal impacts are expected: approximately 65.36 ft2 (0.0015 Ac.)
Red Maple and Sweetgum dominated the shrub stratum. Due to a recent timber clearing
operation, the dominant tree species have not reach the 3" DBH necessary for trees. Grantham
(Gr) soil was mapped in this area according to the Harnett County Soil Survey (MRCS). Soils

46 here are poorly drained an often form in Coastal Plain sediments. The soil profile was a close
match for the described soil unit.
Crossing #1 is situated at Sta. 07+73. This channel is an intermittent UT to the Lower Little
River that is conveyed by the existing 24 LF 18" RCP. While the culvert is functioning properly,
it will be extended during construction. The tributary area of the UT consists of forested
uplands/wetlands that have recently endured a logging operation.
Wetland #2 will have minimum impacts along this section, 1044.33 ft2 (0.0239 Ac.) wetlands
will be impacted. This area also was dominated by red maple/sweetgum shrub stratum. All
species were less than 3" DBH. The soils were saturated to within 12 inches and secondary
indicators were noted. Grantham soil was mapped in this area.
The improvements to SR-2023 will impact upon 20 LF of streams and 0.025 acres of Non-
Riverine wetlands. At the culvert crossing, sidecast spoil material located both upstream and
downstream will be removed. The removal will open up the channel area, and reduce outlet
velocities while improving the aesthetic value of the crossing.
RESOURCE STATUS
In general, there will be minor impacts proposed as a result of the culvert replacement along SR-
2023 (Holiday Rd.) in Harnett County. Twenty (20) linear feet of stream impacts are expected,
along with 0.025 acre of wetland impacts. Jurisdictional Wetlands were observed within the
NCDOT right-of-way. A Nationwide Permit #14 / NCDENR 401 WQC 3404 is required for the
project.
Endangered Species: Plants and animals with Federal classification of Endangered (E) or
Threatened (T) are protected under provisions of Section 7 and Section 9 of the Endangered
Species Act of 1973, as amended. As of January 29, 2003, the U.S. Fish and Wildlife Service
lists four federally protected species for Harnett County.

A biological conclusion of "No Effect" was reached for all species during the May 23, 2006
survey for protected species. Protected species were not identified, nor, was the general habitat
for each species identified.
REGULATORY APPROVALS
Application is hereby made for a Department of the Army Nationwide Permit 14 / NCDENR 401
WQC 3404 as required by the above-described activities.
The National Register was reviewed in addition to conducting a field view of the project for
significant historic features.
The project impacts are minor in nature and should not remove or degrade existing water quality
uses. Pipe sizes proposed are the minimum necessary to create a safe highway while
accommodating the 25-year design storm. There is no record within the NCDOT District 2
Office (Harnett County) that the road experiences floods overtopping. By utilizing the erosion
control measures, downstream water quality standards will be protected. All appropriate BMP's
will be utilized during construction.
Attached is a Preconstruction Notification Form, plan sheets, marked county road map, quad
location map and photographs.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are

at the time of this application: Existing 20 foot gravel/dirt road with maintenance limits
60 foot in width. Surrounding land use is rural/forested.

10. Describe the overall project in detail, including the type of equipment to be used: In
bringing SR-2023 (Holiday Rd.) up to current safety standards, i.e. 20 foot Paving w/6
foot stabilized shoulders and 3:1 side slopes within a 60 foot right-of-way. The existing
culverts are severely deteriorated with corrosion and must be replaced. Impacts will be
minimized as much as possible. The culverts will be replaced utilizing a track-hoe
excavator. While front end loaders will place fill material. Eventually a motor grader
will finish grade the project prior to paving.
11. Explain the purpose of the proposed work:_ By Statue, NCDOT is required to Pave all
unpaved Secondary Roads. To ensure that the roadway meets current safety standards,
the road will be paved to a width of 20 feet, 6 foot grass shoulders will be installed on
each side and 3:1 side slopes will be provided within the 60 foot right-of way.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,.

VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. The applicant must also
provide justification for these impacts in Section VII below. All proposed impacts, permanent
and temporary, must be listed herein, and must be clearly identifiable on an accompanying site
plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a

delineation map, whether or not impacts are proposed to these systems. Wetland and stream
evaluation and delineation forms should be included as appropriate. Photographs may be
included at the applicant's discretion. If this proposed impact is strictly for wetland or stream

listing or description, please attach a separate sheet.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts.. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The current culverts are severely deteriorated and must be replaced. The proposed
culverts have been lenl?thened a total of 20LF to meet current safety standards
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors

including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/newetlands/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Mitigation will be provided by EEP via quarterly report.
Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at
(919) 733-5208 to determine availability and to request written approval of mitigation prior
to submittal of a PCN. For additional information regarding the application process for the
NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wrp/index.htm. If use of
the NCWRP is proposed, please check the appropriate box on page three and provide the
