Charlotte, NC 28202 Re: Notification of Surface Water Results Former Amoco Terminal No. 254 Charlotte, Mecklenburg County, North Carolina URS Project No. 38436235 Dear Ms. Linden and Mr. McCulloch: The purpose of this letter is to notify the NCDENR Division of Water Quality and Mecklenburg County Land Use and Environmental Services of the results of a sampling event performed at the Former Amoco Terminal No. 254 (the Site) in Charlotte, Mecklenburg County, North. Carolina. URS performed surface water sampling of the drainage northwest of the subject site on December 8, 2005 during the semiannual groundwater sampling event. The drainage is a tributary of Gum Branch, which is classified as Class WS-IV waters. The locations of the samples are shown on Figure 1. The analytical results are shown on Table 1. The results for samples SW-1 and SW-3 are consistent with the March 3, 2005 results for these locations, which were previously reported to you both. However, the results for SW-2 on December 8, 2005 had anomalous results, including a reported benzene concentration of 1,250 ug/L. After evaluating the laboratory results, URS performed a confirmation sampling event on February 6, 2006. Surface water samples were collected from the same locations as the previous sampling events, as shown on Figure 1. The February 2006 resampling FAILED TO CONFIRM the presence of benzene in the surface water. URS believes that an error occurred that resulted in the reporting of a false result for benzene in the SW-2 sample from December 8, 2005; although URS has not been able to identify the source of the error. Your request states the groundwater remediation system covered by this permit is not operating, and therefore the site no longer requires coverage under the general permit. In accordance with your request, NPDES General Permit NCG510436 is rescinded, effective immediately. Please be advised that this permit rescission is based wholly upon your statement that the activities which would require general permit coverage at the site have ceased or been eliminated. Division staff has not visited the site to obtain independent verification. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will he certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. This Certificate of Coverage is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983. The Division has decided to cover outfall 005 at the Williams Energy Ventures terminal, for which you retain responsibility, under the General Permit for Groundwater Remediation (NCG51OOOO). Issuance of this Certificate of Coverage (NCG51O436) terminates the previous coverage for this outfall (005) under NPDES pei mit NCOOO5185. If operation of the remediation system at the site has been suspended, remediation activities at the site should resume immediately. The effluent limitations and monitoring requirements on page A. (3) of the General Permit apply to the subject facility. This outfall had a history of BOD effluent limit violations. The transfer of pen >it NCOOO5185 was delayed while the Division evaluated more recent BOD data from outfall 005. Based on the absence of any BOD violations (and a non-detection of BOD in all samples) in 1999, coverage under the General Permit was approved. Please note that the Mecklenburg County Department of Environmental Protection (MCDEP) and other local interest groups still consider BOD to be an issue in the Paw Creek watershed. The Division will closely monitor BOD data from all permitted sites in the Paw Creek area to determine if this parameter should be limited in future permits. If your facility experiences future problems with BOD, coverage under the General Permit may be denied and a new individual NPDES permit may be required for this outfall. The Division commends you on your improvements at the site, and urges you to take all steps necessary to prevent any recurrence of BOD standard violations. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to request an individual permit by submitting an individual permit application.
