There was a misunderstanding in our office that the disturbance would be less than 150 if and I had to reeducate someone about that fact. The proposed disturbance is greater than 150 if and always has been. But I wanted to clarify the answer for my own general benefit because I am certain the question will arise again. I have contacted US Army Corps regarding the NWP and I'm waiting to hear back from them. I will complete my application based upon their response and incorporate that into the PCN Application. I'm a little confused as to which part of the Initial Interest Form that I should not have filled out. I do realize that I was mistaken in filling in the steam buffer disturbance (Brain Issues). But based upon my interpretation of the PCN, it appears that submittal to your office is required regardless of whether the proposed disturbance is greater than 150 if or not. Talk to you soon. The US Army Corps of Engineers determines which NW to use. Also, if they'll require mitigation. Please talk to them before talking to us as they are the lead agency. It was my understanding from your form that you had over 150 feet of impacts. Intermittent/perennial determinations must be confirmed by DWQ. Since the project is not in a buffered river basin, that portion of the initial interest form should not have been filled out. Also, is the current schedule of fees still $232/lf of disturbance? We have a proposed residential subdivision located in the Cape Fear Basin. It is not in a watershed protection district and we are only proposing to disturb the stream. So there are no buffers or other wetland impacts. Given that, would DWQ require anything more than the compensatory mitigation (ie, stormwater wetlands, level spreaders, etc.)? These questions are specifically for Rustica Oaks Subdivision and another consultant is telling our client things that just don't seem to match with my current understanding of the regulations.
