Mr. Anthony Roper, P.E. NCDOT, Division 1 113 Airport Drive Suite 100 Edenton, NC 27932 Dear Mr. Roper: You have our approval, in accordance with the attached conditions and those listed below, to excavate approximately 55,000 cubic yards of bottom material in Stumpy Point Bay for the purpose of deepening the COE Federal navigation channel. The dredging will take place between Channel Marker 10 and Channel Marker 8, a distance of approximately 4,000 - 5,000 ft. The project shall be constructed in accordance with your applications dated February 15, 2002, and November 21, 2005 for the purpose of maintaining a channel for ferry access to the Stumpy Point Emergency Ferry terminal. After reviewing your application, we have decided that these impacts are covered by General Water Quality Certification Number 3400. This certification corresponds to General Permit 1980000291 issued by the Corps of Engineers. This certification modifies the original to include impacts resulting from the deepening of the Federal Channel. All the authorized activities and conditions of the certification associated with the original Water Quality Certification dated April 1, 2002 and all subsequent modifications still apply except where superceded by this certification. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non- Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit issued by the US Army Corps of Engineers or the CAMA permit (this condition supercedes Condition 13 of General Certification 3400 issued on March 2003). This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the conditions listed in the attached certification. 1.) Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of Completion Form" to notify DWQ when all work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality upon completion of the project. 2.) All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 3.) A copy of this Water Quality Certification shall be posted on the construction site at all times. In addition, the Water Quality Certification and all subsequent modifications, if any, shall be maintained with the Division Engineer and the on-site project manager. 4.) There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this permit, other than those areas designated by the USFWS as disposal sites, without appropriate modification of this permit. Should waste or borrow sites be located in wetlands or stream, compensatory mitigation will be required since it is a direct impact from road construction activities. Michael F. The ferry division sent a request to extend the current CAMA major permit and include a one time maintenance dredging of the state channel and the turning basin. It was later discovered that we would need to get CAMA approval to dredging the Federal Channel, so I sent in a request to modify the CAMA permit to include the dredging of the Federal Channel. The original plans and the new plans outlying the federal channel are in this package. NCDOT was under the impression DCM would send the request to USACE and DWQ for your processing under the 291 process for CAMA major permits. The proposed maintenance dredging would take place within the authorized COE Federal navigational channel that allows commercial boat traffic within Stumpy Point Bay. The proposed dredging will begin at Marker # 10 and continue out to Marker # 8, which is approximately 4,000- 5000 it. This channel has shoaled in and would not function in the event, a Hatteras Class Ferry was needed to move traffic from the Rodanthe terminal to Stumpy Point terminal. This Federal Channel has an authorized depth of-10 below MLW. A bottom survey is provided with this request showing the channel depths within the concerned area. The volume of dredged material that will come out of the channel will be approximately 55,000 cubic yards. This material will be placed in the authorized COE dredge spoil site located on USFWS property. Included with this request are letters of approval from the COE and the USFWS to undertake the project. The permittee shall comply with all instructions applicable to this permit issued by the refuge officer in charge. The permittee shall take all reasonable precautions to prevent the escape of fires and to suppress fires and shall render all reasonable assistance in the supp-ession of refuge fires. 5. Rosponsidillty of Permittee The permlttee, by operating on the premises, shall be considered to have accepted these promises with all the facilities, fixtures, or improvements in their existing condition as of the date of this pemtit. At the end of the period specified or upon earlier termination, the permittee shall give up the premises in as good order and condition as when received except for reasonable wear, tear, or damage occurring without fault or negligence. The permlttee will fully repay the Service for any and all damage directly or indlrridly resulting from negligence or failure on his/her part, or the part of anyone of hisihor associates, to use reasonable care. 6, Revocation Policy This permit may be revoked by the Regional Director of the Service without notice for noncompliance with the terms hereof or for violation of general and/or spe .Mc. laws or regulations goveming National Wildlife Refuges or for nonuse. It is at all times subject to discretionary revocation by the Director of the Service. Upon such revocation the Service, by and through any authorized representative. may take possession of the said promises for its own and sole use, or may enter and possess the premises as the agent of the ponmittee and for his/her account. 7 Compliance Failure of the Service to insist upon a strict compliance with any of this permit's terms, conditions, and requirements shall not consldute a waiver or be considered as a giving up of the Servlce's right to tnereafter enforce any of the permit's terms, conditions, or requirements. 8. Within the period the permittee must also remove any other of his/her property Including his/her acknowledged share of products or craps grown, cut, harvested, stored, or stacked on the premises. Upon failure to remove any of the above items within the aforesaid period, they shall become the property of the United States. 10 Transfer of Privileges This permit is not transferable, and no privileges herein mentioned may be sublet or made available to any person or interest not mentioned in this permit. No interest hereunder may accrue though bon or be transferred to a third party without the approval of the Reglunal Director of the U.S. Fish and Wildlife Service and the permit shall not be used for speculative purposes. 11. Dare County, Stumpy Point Ferry Landing Field Investigation Report Page Two Project Setting The applicant's property is located at the end of pavement for Log Storage Road, SR 1164, which is located off US 264 near Lake Worth in the Stumpy Point Community, Dare County. The property is located on a man made basin off Stumpy Point Bay and is approximately 9,152 sq. ft. in area. The property has a shoreline approximately 133 ft. long that has a commercial grade wooden bulkhead at the normal water level (NWL). The property has an elevation that varies from 1.3 ft. to 4.6 ft. above NWL and has sandy soils. Vegetation on the property is thick and consists of wild cherry, honeysuckles, red bay, common reed and indigenous grasses and weeds. A dirt road runs through the property from north to south. Waterward of the bulkhead exists a 12 ft. wide dock that is approximately 104 ft. long. The adjacent property to the south is similar in natural characteristics and has a 200 ft. long shoreline dock. The property to the north is also similar in natural characteristics and has a wharf, an abandoned fish house and a shoreline bulkhead. The waters of Stumpy Point Bay are classified as SA by the Division of Environmental Management and are closed to shellfish taking. The water depth at the proposed development site is approximately 8 ft. Development Proposal in order to provide an emergency landing for the North Carolina Department of Transportation ferry system for the evacuation of Hatteras Island when NC 12 becomes inaccessible during and after major storm events, the applicant proposes to construct a ferry dock at the site. Approximately 74 ft. of the existing dock and 55 ft. of the existing bulkhead will be removed, the upland area behind the removed bulkhead will be excavated to a depth of 7 1/2' below NWL and a new 100 ft. long sheet pile bulkhead will be installed in three legs, one 45 ft. long, one 38 ft. long and one 17 ft. long. The design will allow the ferry to dock at an angle for easier maneuvering in the basin. A 20 ft. wide steel sheet metal ramp will be installed with "I" beams for a lift gantry. An asphalt approach driveway will be constructed to access the ramp. Tile driveway will be created by placing fill material along the proposed route from the existing grade to a final elevation of approximately 8.4 ft. A 30 ft. long retaining wall is proposed along the north side to keep the fill material in place. Four dolphin clusters are proposed. Anticipated Impacts The excavation of the docking area will result in approximately 1334 sq. ft. of Estuarine Shoreline Area of Environmental Concern (AEC) being impacted and changed to Public Trust Dare County, Stumpy Point Ferry Landing Field Investigation Report Page Three Area/Estuarine Waters AECs. Approximately 370 cu yd of material will be removed from below the normal water level and approximately 185 cu yds of material will be removed from above the normal water level. Tile spoil material from the excavated area will be used for fill to construct the asphalt driveway at the ramp of the ferry dock entrance. Tile construction of the 20 ft. wide ramp will result in the shading of approximately 600 sq. ft. of Public Trust Area/Estuarine Waters AECs; however, the removal of 74 ft. of the existing 12 ft. wide dock will result in the unshading of 840 sq. ft. of Public Trust Area/Estuarine Waters. Approximately 500 sq. ft. of Estuarine Shoreline AEC will be covered by asphalt. An undetermined area of basin bottom will be disturbed during the construction of the dolphin clusters. It is anticipated that the entire site will be disturbed during the construction of the docking facility. The impervious coverage within the Estuarine Shoreline AEC is 500 sq. ft. This amount represents 6% impervious coverage within the AEC. Temporary water turbidity will occur during construction. The proposed ferry dock will occur within riparian areas of adjacent and nearby properties. The prop wash from the ferry docking will cause turbidity, bottom scour, and possible bulkhead damage. PROJECT DESCRIPTION: The site of this.proposal is the western shore of Stumpy Point Bay, approximately 1400 feet north of the U.S. Army Corps of Engineers dredged channel leading to the Lake Worth Drainage Canal, on Log Storage Road, SR 1164, at Lake Worth, near the community of Stumpy Point, in Dare County. The general purpose of the project is to construct an emergency ferry terminal to be used in the event of a hurricane, closure of the Oregon Inlet Bridge or other emergency. The NCDOT owned site is approximately 7.39 acres and is bisected by Log Service Road, SR 1164. The site is bordered by Highway 264 on the west, coastal marsh on the north, Stumpy Point Bay on the east, a dredge spoil property with a fishing but to the southeast and a commercial crab shedding operation and docks to the southwest. The southeast corner of the property has previously been filled with 1 to 4 feet of dredge spoils. Soils on this property are classified as Psamments, (previously filled or disturbed) by the NC Soil Conservation Service. Approximate elevations on the parcel range between 1.3 feet and 7.3 feet above NWL. Predominant vegetation on and adjacent to this site is Phragmites communis, Spartina patens, Distichlis spicata, Juncus roemerianus and myrtles. A narrow fringe of Coastal Wetlands (0-8 feet wide) exists along the approximately 800 feet of shoreline. The shallow bottom adjacent to the property is sandy with shell fragments. No evidence of shellfish or SAV beds was noted. The waters of Stumpy Point Bay are classified as SA at the project site by the North Carolina Division of Water Quality. The project is at the northernmost boundary of an area closed to the harvesting of shellfish for consumption, and is not designated as Primary Nursery Area by the North Carolina Division of Marine Fisheries. The Dare County Land Use Plan designates the project area as Community, with all CAMA Areas of Environmental Concern designated as Conservation. The proposal is to construct an emergency landing for the NCDOT ferry system to facilitate the evacuation of Hatters Island in the event NC 12 or the Oregon Inlet Bridge is made impassable or the regular ferry routes are interrupted. Constructing this project would include extending the existing shoulders of Log Storage Road, SR 1164, to a combined road and shoulder width of 80 feet. The additional shoulder width would be paved with gravel and used as waiting lanes. A 45 foot wide by 200 foot long paved access drive would be installed between SR 1164 and the dock/ramp. A 60 foot by 100 foot parking area south of the access drive would create parking for employees, fuel trucks and service vehicles. A 6 foot wide by 25 foot long dock would be installed south of the ramp to allow access to any ferry docked next to the ramp. A 120 foot long steel bulkhead would be constructed just above the NWL and rip rap may be installed at each end. The area landward of the bulkhead would be filled to bring the access driveway elevation to that of the ferry dock/ramp. A 30 foot wide steel sheet pile prop wash deflector would be installed under the ramp immediately in front of the bulkhead. The 17 foot wide dock/ramp would begin 5 feet landward of the bulkhead and extend 30 feet water ward of the bulkhead. Eleven dolphins (9- 19 piling clusters), with 48"-60" diameters, would be installed adjacent to the dock/ramp. One turning pile cluster of 25 piles centered on the north border of the turning basin would be installed. A 300 foot wide turning basin would be dredged 350 feet water ward of the ramp. The turning basin would be centered at the ramp. A channel 100 feet wide and 1,400 feet long would be dredged between the southeast corner of the turning basin and the USACOE dredged channel connecting to the Lake Worth Drainage Canal. ANTICIPATED IMPACTS: As proposed, the construction of waiting lanes paved with gravel on SR 1164 would be kept within the existing shoulder fill slopes and would result in the filling of no 404 type wetlands. The installation of the proposed access drive and bulkhead from SR 1164 to the dock/ramp and filling landward of the proposed bulkhead would result in approximately 2,178 square feet of 404 type wetlands and 480 square feet of Coastal Wetlands being filled and the filling of 3750 square feet of Coastal Shoreline AEC. The gravel paved 60 foot by 100 foot parking area located on the existing dredge spoil pile, would impact 6000 square feet of high ground. The 17 foot wide dock/ramp extending 30 feet water ward of the bulkhead would create 510 feet of shading impacts to Estuarine/Public Trust Waters AECs. The 6 foot by 25 foot dock south of the ramp would create approximately 90 feet of shading impacts. Water depth in the proposed turning basin and proposed connecting channel averages 3.0 feet. Dredging the 100 X 1400 foot channel and 300 X 350 foot turning basin to an average depth of 8.0 feet would be performed with box cuts and require the excavation of approximately 43,760 cubic yards of material from below NWL and would impact 245,000 square feet of shallow estuarine bottom. Approximately 3,375 square feet of the 35,168 square feet of built upon or paved surface will be inside the Estuarine Shoreline AEC (less than 10 %). A minimal amount of dredged material would be used to backfill landward of the proposed bulkhead. The remainder of the dredge spoils would be deposited in the USACOE approved USFWS Alligator River National Wildlife Refuge spoil site on the southwest shore of Stumpy Point Bay. NC DOT has reduced the estuarine system excavation and fill impacts associated with this proposal by installing the bulkhead at NWL, installing the parking area, waiting lanes and most of the access drive on high ground and minimizing the facilities as much as feasible. Mitigation for 404 type wetland impacts is to be coordinated with the USACOE and other appropriate resource agencies. There is a high probability of turbidity expected during the construction of the dock/ramp, installation of dolphins and dredging. The NC DOT has proposed to use design standards for sensitive watersheds and standard NC DOT BMP's to minimize these impacts. The primary use of this site will be for an emergency ferry landing. PROJECT DESCRIPTION: The site of this proposal is the western shore of Stumpy Point Bay, approximately 1400 feet north of the U.S. Army Corps of Engineers dredged channel leading to the Lake Worth Drainage Canal, on Log Storage Road, SR 1164, at Lake Worth, near the community of Stumpy Point, in Dare County. The general purpose of the project is to construct an emergency ferry terminal to be used in the event of a hurricane, closure of the Oregon Inlet Bridge or other emergency. The NCDOT owned site is approximately 7.39 acres and is bisected by Log Service Road, SR 1164. The site is bordered by Highway 264 on the west, coastal marsh on the north, Stumpy Point Bay on the east, a dredge spoil property with a fishing but to the southeast and a commercial crab shedding operation and docks to the southwest. The southeast corner of the property has previously been filled with 1 to 4 feet of dredge spoils. Soils on this property are classified as Psamments, (previously filled or disturbed) by the NC Soil Conservation Service. Approximate elevations on the parcel range between 1.3 feet and 7.3 feet above NWL. Predominant vegetation on and adjacent to this site is Phragmites communis, Spartina patens Distichlis spicata, Juncus roemerianus and myrtles. A narrow fringe of Coastal Wetlands (0-8 feet wide) exists along the approximately 800 feet of shoreline. The shallow bottom adjacent to the property is sandy with shell fragments. No evidence of shellfish or SAV beds was noted. The waters of Stumpy Point Bay are classified as SA at the project site by the North Carolina Division of Water Quality. The project is at the northernmost boundary of an area closed to the harvesting of shellfish for consumption, and is not designated as Primary Nursery Area by the North Carolina Division of Marine Fisheries. The Dare County Land Use Plan designates the project area as Community, with all CAMA Areas of Environmental Concern designated as Conservation. The proposal is to construct an emergency landing for the NCDOT ferry system to facilitate the evacuation of Hatters Island in the event NC 12 or the Oregon Inlet Bridge is made impassable or the regular ferry routes are interrupted. Constructing this project would include extending the existing shoulders of Log Storage Road, SR 1164, to a combined road and shoulder width of 80 feet. The additional shoulder width would be paved with gravel and used as waiting lanes. A 45 foot wide by 200 foot long paved access drive would be installed between SR 1164 and the dock/ramp. A 60 foot by 100 foot parking area south of the access drive would create parking for employees, fuel trucks and service vehicles. A 6 foot wide by 25 foot long dock would be installed south of the ramp to allow access to any ferry docked next to the ramp. A 120 foot long steel bulkhead would be constructed just above the NWL and rip rap may be installed at each end. The area landward of the bulkhead would be filled to bring the access driveway elevation to that of the ferry dock/ramp. A 30 foot wide steel sheet pile prop wash deflector would be installed under the ramp immediately in front of the bulkhead. The 17 foot wide dock/ramp would begin 5 feet landward of the bulkhead and extend 30 feet water ward of the bulkhead. Eleven dolphins (9- 19 piling clusters), with 48"-60" diameters, would be installed adjacent to the dock/ramp. One turning pile cluster of 25 piles centered on the north border of the turning basin would be installed. A 300 foot wide turning basin would be dredged 350 feet water ward of the ramp. The turning basin would be centered at the ramp. A channel 100 feet wide and 1,400 feet long would be dredged between the southeast corner of the turning basin and the USACOE dredged channel connecting to the Lake Worth Drainage Canal. ANTICIPATED IMPACTS: As proposed, the construction of waiting lanes paved with gravel on SR 1164 would be kept within the existing shoulder fill slopes and would result in the filling of no 404 type wetlands. The installation of the proposed access drive and bulkhead from SR 1164 to the dock/ramp and filling landward of the proposed bulkhead would result in approximately 2,178 square feet of 404 type wetlands and 480 square feet of Coastal Wetlands being filled and the filling of 3750 square feet of Coastal Shoreline AEC. The gravel paved 60 foot by 100 foot parking area located on the existing dredge spoil pile, would impact 6000 square feet of high ground. The 17 foot wide dock/ramp extending 30 feet water ward of the bulkhead would create 510 feet of shading impacts to Estuarine/Public Trust Waters AECs. The 6 foot by 25 foot dock south of the ramp would create approximately 90 feet of shading impacts. Water depth in the proposed turning basin and proposed connecting channel averages 3.0 feet. Dredging the 100 X 1400 foot channel and 300 X 350 foot turning basin to an average depth of 8.0 feet would be performed with box cuts and require the excavation of approximately 43,760 cubic yards of material from below NWL and would impact 245,000 square feet of shallow estuarine bottom. Approximately 3,375 square feet of the 35,168 square feet of built upon or paved surface will be inside the Estuarine Shoreline AEC (less than 10 %). A minimal amount of dredged material would be used to backfill landward of the proposed bulkhead. The remainder of the dredge spoils would be deposited in the USACOE approved USFWS Alligator River National Wildlife Refuge spoil site on the southwest shore of Stumpy Point Bay. NC DOT has reduced the estuarine system excavation and fill impacts associated with this proposal by installing the bulkhead at NWL, installing the parking area, waiting lanes and most of the access drive on high ground and minimizing the facilities as much as feasible. Mitigation for 404 type wetland impacts is to be coordinated with the USACOE and other appropriate resource agencies. There is a high probability of turbidity expected during the construction of the dock/ramp, installation of dolphins and dredging. The NC DOT has proposed to use design standards for sensitive watersheds and standard NC DOT BMP's to minimize these impacts. The primary use of this site will be for an emergency ferry landing. Box 1000 Washington, North Carolina 27889-1000 IN REPLY REFER TO March 28, 2002 Regulatory Division APR 4 2002 '. i Action ID No. 200210350 WETLANDS GROUP V'tiTEi; UALITY S[CTIG'' Mr. Doug Huggett Division of Coastal Management North Carolina Department of Environment and Natural Resources 1638 Mail Service Center Raleigh, North Carolina 27699-1638 Dear Mr. Huggett: Reference the application of the North Carolina Department of Transportation (NCDOT) for a Department of the Army (DA) permit to develop a new ferry terminal, including the excavation of a 300-foot-long by 350-foot-wide by 8-foot-deep ferry basin, a 100-foot-wide by 1400-foot-long by 8-foot-deep access channel, the construction of a parking pad, waiting lanes, dock, ramp, bulkhead, and dolphins, on property located off State Road 1164, adjacent to Stumpy Point Bay, near the Community of Stumpy Point, in Dare County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. In addition, we have completed our coordination procedures with the National Marine Fisheries Service and have resolved their concerns regarding project impacts to Essential Fish Habitat and related fishery resources. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the permit application and plans dated February 15, 2002, which are a part of this permit. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. OF -%. -2- 1-The permittee will place approximately 68,000 bushels of replacement oyster shell within Stumpy Point Bay to compensate for impacts to EFH and shellfish habitat. The specific locations will be coordinated through the North Carolina Division of Marine Fisheries and the National Marine Fisheries Service. 4. The permittee will restore approximately 0.33-acre of previously impacted wetlands on the site to compensate for impacts to freshwater and emergent wetlands. These areas will be planted with suitable marsh plant species. The remaining wetlands on the site will be placed in preservation. 5. The permittee will increase the size of the proposed culvert under the access drive to allow additional passage for fish and wildlife resources using the wetland areas on the site. 6. In order to protect EFH and related fishery resources, no excavation or filling will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the North Carolina Division of Coastal Management and the U.S. Army Corps of Engineers, through coordination with the North Carolina Division of Marine Fisheries and the National Marine Fisheries Service. 7. All excavated materials will be confined landward of the mean high water (MHW) elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. 8. The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. 9. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. 10. Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosion and siltation. 11. No vegetated wetlands will be excavated or filled outside of the authorized areas. 12. Excavation will not exceed - 8 feet below the elevation of mean low water (MLW). w -3- 13. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands are not authorized. 14. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 15. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work, which may be caused from existing or future operations undertaken by the United States in the public interest. 16. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 17. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. 18. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 19. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge.
