APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Holder:
Alan W. Klimek, P.E. Director
Division of Water Quality
January 23, 2006
DWQ# 06-0092
Catawba County
You have our approval, in accordance with the attached conditions and those listed below, to permanently
impact 21 linear feet (If) (6 If for culvert fill, 10 If for rock ladder construction, and 5 If for inlet stabilization using
riprap).of an unnamed tributary (intermittent stream) to Henry Fork River. The impacts are proposed in order
to replace a deteriorating culvert as described in your application received by the Division of Water Quality
(DWQ) on January 17, 2006. The location of the project is State Road 1176 (Bethel Church Road) in Catawba
County. After reviewing your application, we have determined that this project is covered by Water Quality
General Certification Number 3404. This certification corresponds to Nationwide Permit 14 issued by the U.S.
Army Corps of Engineers (USACE). Please note that you should get any other federal, state or local permits
before proceeding with your project, including those required by (but not limited to) Sediment and Erosion
Control, Non-Discharge, and Water Supply Watershed regulations.
This approval is valid solely for the purpose and design that you described in your application (unless modified
below) and will expire with the associated USACE 404 permit unless otherwise specified in the Water Quality
Certification. Should your project change, you must notify the DWQ in writing and you may be required to
submit a new application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project
(now or in the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear
feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h)(6) and (7). For this
approval to remain valid, you must adhere to the conditions listed in the attached certification and those listed
below:
Due to the perched pipe condition at the outlet end of the proposed culvert, DWQ will not require the burial of
the culvert in the streambed at the outlet end of the pipe. However, the rock ladder shall be installed in such
a manner that the original stream profiles are not altered (i.e., the depth of the channel must not be reduced
by a widening of the streambed). A representative from the North Carolina Department of Transportation
(NCDOT) environmental staff shall be present on site during the construction of the rock ladder to provide
guidance to the NCDOT Maintenance Personnel and/or selected contractor.
2. All structures shall be ipstalled in such a manner that the original stream profiles are not altered (i.e., the
depth of the channel must not be reduced by a widening of the streambed). Design and placement of
culverts and other structures including temporary erosion control measures shall be installed in such a
manner that the original stream profiles are not altered (i.e., the depth of the channel must not be reduced by
a widening of the streambed).

Existing stream dimensions (including pattern and profile) are to be maintained above and below locations of
each culvert. The applicant may be required to provide evidence that the equilibrium has been maintained, if
requested in writing by the DWQ.
3. Riprap must not interfere with thalweg performance and aquatic life passage during low flow conditions.
4. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full
compliance with all specifications governing the proper design, installation, and operation and maintenance of
such BMP in order to protect surface water standards:
a. The design, installation, operation, and maintenance of the sediment and erosion control measures
must be such that they equal, or exceed, the requirements specified in the most recent version of
the North Carolina Sediment and Erosion Control Manual.
The devices shall be maintained on all construction sites, borrow pit sites, and waste pile (spoil)
projects, including contractor-owned or leased borrow pits associated with the project.
b. For borrow pit sites, the erosion and sediment control measures must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina Surface
Mining Manual.
c. The reclamation measures and implementation of these measures must be in accordance with the
requirements of the Sedimentation Pollution Control Act.
5. Heavy equipment must be operated from the banks rather than in the stream channel, when possible, in
order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.
6. Temporary dewatering sites must be restored to pre-existing conditions unless more natural geomorphic
conditions can be provided.
7. No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened.
8. The dimension, pattern and profile of the stream above and below the crossing should not be modified.
Disturbed floodplains and streams should be restored to natural geomorphic conditions.
9. All mechanized equipment operated near surface waters must be regularly inspected and maintained to
prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
10. All work shall be performed during low or normal flow conditions.
11. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to
surface waters is prohibited.
12. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable,
they shall be removed and the natural grade restored within 30 days after the Division of Land Resources has
released the project.
13. The North Carolina Department of Transportation (NCDOT) and its contractors and/or agents shall not
excavate, fill or perform mechanized land clearing at any time in the construction or maintenance of this
project within waters and/or wetlands, except as authorized by this Certification, or any modification to this
Certification (e.g., no work shall occur outside of the footprint of the plans provided).
A
Page 3
In addition, there shall be no excavation from or waste disposal into jurisdictional wetlands or waters
associated with this Certification without appropriate modification. If this occurs, compensatory mitigation
may be required since it is a direct impact from road construction activities.
14. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of
Completion" form to notify DWQ when all work included in the 401 Certification has been completed. Please
include photographs upstream and downstream of the structure to document correct installation.
15. Continuing Compliance. NCDOT shall conduct its activities in a manner so as not to contravene any state
water quality standard [including any requirements for compliance with section 303(d) of the Clean Water Act]
and any other appropriate requirements of state and federal law. If DWQ determines that such standards or
laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal
law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate
and modify this certification to include conditions appropriate to assure compliance with such standards and
requirements in accordance with 15 A NCAC 2H.0507(d)., Before codifying the certification, DWQ shall notify
NCDOT and the USACE, provide public notice in accordance with 15A NCAC 2H.0503, and provide
opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall
be provided to NCDOT in writing, shall be provided to the USACE for reference in any permit issued pursuant
to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714
Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless
you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If
you have any questions, please telephone Polly Lespinasse in the Mooresville Regional Office at 704-663-
1699.
Sincerely,
for Alan W. Klimek, P. E.

SUBJECT: North Carolina Department of Transportation (NCDOT), SRI 176, Bethel Church
Road, Unnamed Tributary Henry Fork River, Catawba County
NCDOT proposes to replace a deteriorated pipe with another pipe on SRI 176. Biologists with
the North Carolina Wildlife Resources Commission are familiar with habitat values in the area.
These comments are provided in accordance with the provisions of the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North Carolina
Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). Removal of the existing
bridge will not impact waters.
The project will replace a 44-foot long, 48" CMP with a 50-foot, 60" CMP. Due to specified site
restrictions and intermittent flows from an upstream pond, NCDOT proposes to install the pipe
on existing pipe grade. This maintains a perched pipe condition. In an effort to provide aquatic
life passage, NCDOT proposes to install a rock ladder instead of burying the pipe a foot (12").
Based on NCDOT's evaluation, we will not object to the project as proposed with the stipulation
that piping and/or culverting will be accomplished with state-of-the-art crossing methodologies if
site conditions change significantly when the pipe is replaced in the future.
Thank you for the opportunity to review and comment on this project during the early planning
stages. If you have any questions regarding these comments, please contact me at 336/769-9453.

SUBJECT: Pipe replacement, SR 1176, Catawba County
Dear Mr. Lund:
The North Carolina Department of Transportation proposes to replace a deteriorating pipe on SR 1176,
Bethel Church Road in Catawba County. The pipe was repaired in October 2005 after storm events
caused a partial pipe collapse. The pipe is a 44-foot long, 48" CMP that will be replaced with a 50400t,
60" CMP. The existing pipe is perched approximately 7 feet. To reconnect the upstream and
downstream elevation, the new pipe would be on >10% slope; therefore, we propose to place the new
pipe in a perched condition on a moderate slope (-4%) and construct a 5-10 foot "rock ladder" for
aquatic passage and energy dissipation. The rock ladder will be constructed from Class R or shot-rock
sized rock. Riprap will be utilized on the embankment at the inlet and outlet of the pipe for structure
stabilization. The soil texture found in the upstream channel is a wetter soil type; therefore, there is
concern that headcutting could occur if the pipe is buried the required one foot depth. We propose to
place the pipe inlet at streambed grade. Due to the existing site conditions, NCDOT requests a waiver
from the Regional Condition 2(b)(e) permit depth specification, for the construction of this project.
The scope of the work will result in a total of 16 feet of permanent fill/rock impact to the UT to Henry
Fork River, which is classified as Class C waters by the Division of Water Quality.
SR 1176 is not considered a rural or urban arterial, nor is the project located within 1/2 mile of a critical
watershed area. Hazardous spill basins are not required. Enclosed is the NCDOT hazardous spill basin
checklist.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The pipe is to be installed in a perched condition due to the extreme slope (>10%) that would
result in reconnecting the upstream and downstream elevations. This extreme slope would cause
additional downcutting and stream destabilization. A rock ladder will be constructed at the pipe
outlet to facilitate aquatic passage and also will provide evergy dissipation from the flashy storm
flows that occur due to the upstream pond. (The pond has no outlet pipe and simply overflows
when capacity is reached). Due to the soil texture found in the upstream channel, it is possible
that if the pipe is buried one foot below streambed elevation, headcutting could occur: therefore,
the pipe inlet will be placed at streambed grade.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.ne.us/ncwetlands/strm%zide.html.

Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
MITIGATION NOT ANTICIPATED
2. Mitigation may also be made by payment into the.North Carolina Wetlands Restoration
Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at
(919) 733-5208 to determine availability and to request written approval of mitigation prior
to submittal of a PCN. For additional information regarding the application process for the
NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wrp/index.htm. If use of
the NCWRP is proposed, please check the appropriate box on page three and provide the
following information:
Amount of stream mitigation requested (linear feet):
Amount of buffer mitigation requested (square feet):
Amount of Riparian wetland mitigation requested (acres):
Amount of Non-riparian wetland mitigation requested (acres):
Amount of Coastal wetland mitigation requested (acres):
IX. Environmental Documentation (required by DWQ)_
Does the project involve an expenditure of public (federal/state) funds or the use of public
(federal/state) land?
Yes ® No ?
If yes, does the project require preparation of an environmental document pursuant to the
requirements of the National or North Carolina Environmental Policy Act (NEPA/SEPA)?
Note: If you are not sure whether a NEPA/SEPA document is required, call the SEPA
coordinator at (919) 733-5083 to review current thresholds for environmental documentation.
Yes ? No
If yes, has the document review been finalized by the State Clearinghouse? If so, please attach a
copy of the NEPA or SEPA final approval letter.

X. Proposed Impacts on Riparian and Watershed Buffers (required by DWQ)
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
required state and local buffers associated with the project. The applicant must also provide
justification for these impacts in Section VII above. All proposed impacts must be listed herein,
and must be clearly identifiable on the accompanying site plan. All buffers must be shown on a
map, whether or not impacts are proposed to the buffers. Correspondence from the DWQ
Page 6 of 9
Regional Office may be included as appropriate. Photographs may also be included at the
applicant's discretion.
Will the project impact protected riparian buffers identified within 15A NCAC 2B .0233
(Meuse), 15A NCAC 2B .0259 (Tar-Pamlico), 15A NCAC 2B .0250 (Randleman Rules and
Water Supply Buffer Requirements), or other (please identify )?
Yes ? No [ If you answered "yes", provide the following information:
Identify the square feet and acreage of impact to each zone of the riparian buffers. If buffer
mitigation is required calculate the required amount of mitigation by applying the buffer
multipliers.

If buffer mitigation is required, please discuss what type of mitigation is proposed (i.e., Donation
of Property, Conservation Easement, Riparian Buffer Restoration / Enhancement, Preservation or
Payment into the Riparian Buffer Restoration Fund). Please attach all appropriate information as
identified within 15A NCAC 2B .0242 or.0260. NA
XI. Stormwater (required by DWQ)
Describe impervious acreage (both existing and proposed) versus total acreage on the site.
Discuss stormwater controls proposed in order to protect surface waters and wetlands
downstream from the property.
There will be no increase in impervious acreage._ __Appropriate erosion and sedimentation control
measures will be in place during the pipe replacement.
XII. Sewage Disposal (required by DWQ)
Clearly detail the ultimate treatment methods and disposition .(non-discharge or discharge) of
wastewater generated from the proposed project, or available capacity of the subject facility.
