Subject: DWR 20200734 - Westminster Solar - Additional Information Request
On June 5, 2020, the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project, with the appropriate fee received on June 9, 2020. The Division
has determined that your application is incomplete and cannot be processed. The application is on hold until the
following items are addressed:
1. Please update the Impact Table to reflect each individual temporary and/or permanent impact for all impacts
associated with Stream Impacts 1 and 2.
2. Please provide a site plan with proposed layout for solar arrays and associated infrastructure as an overlay
including jurisdictional features. Please also enumerate all wetland and stream impacts on the site plan and
clearly label impacts (Wetland / Stream Impact 1, etc.). [15A NCAC 02H .0502(g)]
3. As indicated under Item C.3.g (Page 13) of the USACE PCN Complete Help File "The stream impact length should
be measured along the centerline of the stream. When proposing a culvert, the impact length is generally
greater than the length of the culvert since the existing stream usually has some sinuosity (curvature)." Please
verify or correct the stream impact length as indicated on the PCN form. [15A NCAC 02H .0502(b)]
4. The plan proposes a concrete end wall for both crossings. End walls are considered a permanent impact when
they are placed within the streambed or banks. All permanent impacts associated with head walls must be
accounted for in the impact table. Please revise the impact table to include the end walls if these impacts have
not been accounted for. [15A NCAC 02H .0506(b)(2) and (b)(3)]
5. Please provide justification for use of rip rap dissipater pads at the culvert outlet in the streambed. Provide the
existing and proposed longitudinal profile and channel cross-section dimensions showing channel depth and rip
rap. Include in the cross-section dimensions a detail showing the provisions for aquatic life passage. Include in
your response justifications and calculations that discuss the need for the specified length of the dissipater pads
in the application. [15A NCAC 02H .0506(b)(2) (b)(3)]
6. All temporary streambank disturbances will require stabilization. Please provide a detail and discuss how
streambanks will be stabilized. The Division does not allow the use of any matting containing plastic netting or
mesh. Please specify a matting free of plastic netting or mesh and an appropriate seed mix free of non-native
exotic seed. [15A NCAC 02H .0506(b)(2) and (b)(3)]
7. Stream Impact on Exhibit 1 shows a proposed 36" RCP Culvert to be buried 6" below existing grade. Condition 11
in DWR's Water Quality Certificate 4135 requires that placement of culverts and other structures in waters and
streams must be below the elevation of the streambed by one foot for all culverts with a diameter greater than
48-inches, and 20 percent of the culvert diameter for culverts having a diameter less than or equal to 48 inches,
to allow low flow passage of water and aquatic life. Provide justification if the proposed culvert installations
cannot meet this condition. [15A NCAC 02H .0506(b)(2) and (c)(2)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received by August 23, 2020, the
Division will be unable to approve the application and it will be returned.
