The project shall be constructed in accordance with your application dated October 20, 2006, received in the Fayetteville
Regional Office on October 31, 2006. After reviewing your application, we have decided that these impacts are covered by
General Water Quality Certification Number 3404. This certification corresponds to Nationwide Permit No. 14 issued by the
US Army Corps of Engineers. In addition, you should acquire any other federal, state or local permits before you proceed
with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed
regulations. This approval will expire with the accompanying 404 permit. (This condition supercedes Condition No. 19 of
GC 3404 as issued in March of 2003.)
This approval is valid solely for the purpose and design described in your application (unless modified below). Should your
project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given
a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total
wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future)
exceed 150 linear feet, compensatory mitigation may be required as described in 15A N*CAC 2H .0506 (h) (6) and (7). For
this approval to remain valid, you must adhere to the conditions listed in the attached, certification.
Condition(s) of Certification:
Placement of culverts and other structures in waters, streams, and wetlands shall be placed below the elevation of the
streambed by one foot for all culverts with a diameter greater than 48 inches, and 20 percent of the culvert diameter for
culverts having a diameter less than 48 inches, to allow low flow passage of water and aquatic life. Design and placement of
culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result
in dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the above structures. The
applicant is required to provide evidence that the equilibrium is being maintained if requested in writing by DWQ. If this
condition is unable to be met due to bedrock or other limiting features encountered during construction, please contact the
NC DWQ for guidance on how to proceed and to determine whether or not a permit modification will be required.
If concrete is used during construction, a dry work area should be maintained to prevent direct contact between curing
concrete and stream water. Water that inadvertently contacts uncured concrete should not be discharged to surface waters
due to the potential for elevated pH and possible aquatic life and fish kills.
During the construction of the project, no staging of equipment of any kind is permitted in waters of the U.S., or protected
riparian buffers.
The dimension, pattern and profile of the stream above and below the crossing should not be modified. Disturbed
floodplains and streams should be restored to natural geomorphic conditions.
The use of rip-rap above the Normal High Water Mark shall be minimized. Any rip-rap placed for stream stabilization shall
be placed in stream channels in such a manner that it does not impede aquatic life passage.
All work in or adjacent to stream waters shall be conducted in a dry work area. Approved BMP measures from the most
current version of NCDOT Construction and Maintenance Activities manual such as sandbags, rock berms, cofferdams and
other diversion structures shall be used to prevent excavation in flowing water.
Heavy equipment shall be operated from the banks rather than in the stream channel in order to minimize sedimentation and
reduce the introduction of other pollutants into the stream.
In instances where heavy equipment must be operated within the stream channels, its usage shall be minimized.
All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination
of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
No rock, sand or other materials shall be dredged from the stream channel except where authorized by this certification.

Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is
prohibited.
The permittee and its authorized agents shall conduct its activities in a manner consistent with State water quality standards
(including any requirements resulting from compliance with §303(d) of the Clean Water Act) and any other appropriate
requirements of State and Federal law. If DWQ determines that such standards or laws are not being met (including the
failure to sustain a designated or achieved use) or that State or federal law is being violated, or that further conditions are
necessary to assure compliance, DWQ may reevaluate and modify this certification.
All fill slopes located in jurisdictional wetlands shall be placed at slopes no flatter than 3:1, unless otherwise authorized by
this certification.
A copy of this Water Quality Certification shall be posted on the construction site at alyimes. In addition, the Water Quality
Certification and all subsequent modifications, if any, shall be maintained with the Division Engineer and the on-site project
manager.
The outside buffer, wetland or water boundary located within the construction corridor approved by this authorization shall
be clearly marked by highly visible fencing prior to any land disturbing activities. Impacts to areas within the fencing are
prohibited unless otherwise authorized by this certification.
Upon completion of the project, the NCDOT Division Engineer shall complete and return the enclosed "Certification of
Completion Form" to notify DWQ when all work included in the 401 Certification has been completed.
Native riparian vegetation must be reestablished within the construction limits of the project by the end of the growing season
following completion of construction.
There shall be no excavation from, or waste disposal into, jurisdictional wetlands or waters associated with this permit
without appropriate modification. Should waste or borrow sites be located in wetlands or streams, compensatory mitigation
will be required since that is a direct impact from road construction activities.
Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect surface
waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained
in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and
Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such
that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites,
and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Suuface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
Sediment and erosion control measures shall not be placed in wetlands or waters unless otherwise approved by this
Certification. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be
removed and the natural grade restored upon completion of the project

If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within
60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 1508 of
the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C.
27699. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the
review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please contact

Culvert Replacement SR-1521 (Norris Rd.) (Bladen County)

The North Carolina Department of Transportation (NCDOT) has scheduled to grade, drain, base
and pave SR-1521 (Norris Rd.), in Bladen County. Total project length is 3.12 miles. The
roadway will be widened from 16 feet to 20 feet and stabilized grass shoulders (6 foot) will be
provided. This project will require the replacement of one (1) wet cross line as shown below:

Stream Crossing 91 is located at Sta. 137+20. Currently, there is a 32 LF 24" RCP that conveys
the UT to Colly Creek. The contributing drainage area is comprised of forested and agricultural
fields. The UT is an excavated ditch that has pererulial flow. The existing culvert will be

removed and a 52 LF 30" RCP will be installed. Additionally, the outfall channel will be "are 45
linear feet.
Wetland Crossing #1 is located at Sta. 26+60-33+00. The wetlands along the right side of the
roadway are basically a small pocket of wetlands under power lines. Deep rutting by utility
company equipment was observed. In order to obtain the minimum roadway section, 365 ftz or
0.008 acres of wetlands must be impacted.
Wetland Crossing #2 is located between Sta. 67+00-76+00 along both sides of the project. An
existing NCDOT Bridge and a triple 48" CMP overflow convey Colly Creek under SR-1521.
Red maple, gallberry, and wax myrtle dominated the wetlands with giant cane appearing along
the edges. Croatan soils (Hydric) were verified along with wetland hydrology. In order to obtain
the minimum roadway section, 951 ftz or 0.022 acres of wetlands will be impacted.
Total Wetland Impacts = 0.030 Ac.
Non-riverine Impacts = 0.008 Ac.
Riverine Impacts = 0.022 Ac.
Construction of this project will require impacts to waters of the United States in the Cape Fear
River Basin. Crossing #1 will convey an UT to Colly Creek (C;Sw) within the 03030006 HU,
Subbasin 03-06-18/03-06-20.
RESOURCE STATUS
In general, there will be minor impacts proposed as a result of culvert replacement along SR-
1521 (Norris Rd) in Bladen County. Forty-five (45) linear feet of stream impacts (20 LF of
culvert extension and 25 LF of stream clean out) and 0.030 acres of Jurisdictional Wetlands
within the NCDOT right-of-way. A Nationwide Permit #14/ NCDENR 401 WQC 3404 is
required for the project.
Endangered Species: Plants and animals with Federal classification of Endangered (E) or
Threatened (T) are protected under provisions of Section 7 and Section 9 of the Endangered
Species Act of 1973, as amended. As of January 29, 2003, the U.S. Fish and Wildlife Service
lists three federally protected species for Bladen County.

all or a significant portion of its range).

A biological conclusion of "No Effect" was reached for all species during the September 20,
2006 survey for protected species. Protected species were not identified, nor, was the general
habitat for each species identified.
REGULATORY APPROVALS
Application is hereby made for a Department of the Army Nationwide Permit 14 / NCDENR 401
WQC 3404 as required by the above-described activities.
The National Register was reviewed in addition to conducting a field view of the project for
significant historic features.
The project impacts are minor in nature and should not remove or degrade existing water quality
uses. Pipe sizes proposed are the minimum necessary to create a safe highway while
accommodating the 25-year design storm. There is no record within the NCDOT District 3
Office (Bladen County) that the road experiences floods overtopping. By utilizing the erosion
control measures, downstream water quality standards will be protected. All appropriate BMP's
will be utilized during construction.
Attached is a Preconstruction Notification Form, plan sheets, marked county road map, quad
location map and photographs.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are

at the time of this application: Existing 20 foot dirt road with maintenance limits 45
foot in width. Surrounding land use is rural residentaUforested.

10. Describe the overall project in detail, including the type of equipment to be used: In
bringing SR-1521 up to current safety standards, i.e. 20 foot paving w/6 foot stabilized
shoulders and 3:1 side slopes within a 60 foot right-of-way. NCDOT must impact 45
linear feet of UT to Colly Creek and 0.030 Acres of Wetlands. The existing culvert has
end section damage and must be replaced. Impacts will be minimized as much as
possible; 3:1 side slopes are required due to the sandy soils found in this area. The
culvert will be replaced utilizing a track-hoe excavator. While front end loaders will
place fill material. Eventually a motor grader will finish grade the project prior to
paving.
11. Explain the purpose of the proposed work: By Statue, NCDOT is required to pave all
unpaved Secondary Roads. To ensure that the roadway meets current safety standards,
the road will be paved to a width of 20 feet, 6 foot grass shoulders will be installed on
each side and 3:1 side slopes will be provided within the 60 foot right-of way.

If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and

certifications or other useful information. Describe previously approved wetland, stream and

V. Future Project Plans
Are any future permit requests anticipated for this project? If so, describe the anticipated work,
and provide justification for the exclusion of this work from the current application.
VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. The applicant must also
provide justification for these impacts in Section VII below. All proposed impacts, permanent

and temporary, must be listed herein, and must be clearly identifiable on an accompanying site
plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a
delineation map, whether or not impacts are proposed to these systems. Wetland and stream
evaluation and delineation forms should be included as appropriate. Photographs may be
included at the applicant's discretion. If this proposed impact is strictly for wetland or stream
mitigation, list and describe the impact in Section VIII below. If additional space is needed for
listing or description, please attach a separate sheet.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The existing culvert is severely deteriorated and must be replaced.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/stn-ngide.litml.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
