We understand that by installing the rip-rap at the existing bed surface elevation that mitigation will not be required for the additional impacts caused by the rip-rap dissipater, therefore, mitigation will only be required for permanent impacts (81 linear feet) from the replacement and realignment of the 48" CMP. However, I don't see any drawings or notes that discuss or show the placement of the rip rap dissipation pad as discussed during our site visit. We typically request that the top of the rip rap be placed so that it is at the same elevation of the existing channel bed. This allows for aquatic passage and also doesn't impound flow, both of which are conditions of the nationwide permit. Also, if it is placed in this manner we don't have to require mitigation for the impacts as they shouldn't cause a loss of water or stream channel, i.e, the water should flow on top of the stone. Please let me know if I have missed this information in the drawings or provide a drawing/plan that indicates the rip rap will be placed this way. Please call if you have any questions. Thanks. With regards to your comments concerning the riprap dissipater, we have had conversations with DLR. It is our hope that we may communicate further with you as DLR wasn't firm in their understanding of our application. It is our understanding that since we will not be discharging from a point source into a stream, but instead replacing an existing pipe within a stream and burying that pipe per the 401 standard condition, rip-rap dissipation would not be necessary. In order to ensure that the conditions of the 401 will be met, I need: * a detail sheet for the dewatering/pump around sequence - and be sure it includes a statement that all areas will be restored to natural conditions upon removal of the dewatering measures (they have to match the natural stream depth/width) * have you verified that DLR is not going to require a riprap dissipater pad at the end of your culvert (this would mean potentially more impacts than from the pipe alone) * if they do require a riprap pad, I'll need a detail on the installation to ensure that the riprap is installed so that the top of the riprap is at the same elevation as the bed of the stream. * A profile of the pipe to show that the pipe is buried per our 401 standard condition If you have any questions just let me know.
