GOVERNOR SECRETARY April 8, 2011 Ms. Lori Beckwith, NCDOT Regulatory Project Manager U.S. Army Corps of Engineers 151 Patton Avenue, Room 208 Asheville, NC 28801-2714 Subject: Nationwide 14 Permit Application US 19 Business, Valley River Avenue Cherokee County 110 33 30 State Project No. 14C.020031 (DWQ Minor Permit Fee $240) Dear Ms Beckwith: The North Carolina Department of Transportation (NCDOT) is proposing to improve a section of US 19 Business in Cherokee County. This proposal entails constructing a sidewalk with curb and gutter and improving drainage. Funds have been allocated for this project, and NCDOT would like to perform these activities in the 2011 construction season. I am enclosing a pipe installation detail, photographs, a marked county map and USGS topographic map. We propose to extend one culvert with high density polyethylene pipe (HDPE). This site will be temporarily de-watered and then rehabilitated by installing an HDPE liner within the existing culvert. Stone will be used for bedding material to support the pipe and an endwall will be constructed at the outlet. The North Carolina Natural Heritage Database was checked for records of federally threatened and endangered species. There are no records listed in the database for the immediate vicinity of the culvert. There are records for the sicklefin redhorse (Moxostoma sp.), a federal candidate species, within the Valley River that is approximately 1500 feet downstream of the project. This project is limited in scope and consists of the extension of one pipe for a small unnamed tributary of the Valley River to facilitate the construction of curb and gutter and a sidewalk. Impacts should be minimal. 'US 19 Business Curb & Gutter 2 April 8, 2011 The project is along an existing highway corridor and commercial shopping area that has been previously disturbed. The best management practices will be used to minimize and control sedimentation and erosion at this site. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion is being controlled effectively. If the planned devices are not functioning as intended, they will be replaced immediately with better devices. The rock silt screens and other erosion control devices will be in place prior to pipe culvert construction and will remain in place until the project is stabilized. Impacts to Waters of the United States The unnamed tributary to Valley River (DWQ Class C; Tr.) has a well-defined channel, but is not shown on the USGS topographic map. The channel substrate of the stream is composed primarily of gravel, sand and silt. The unnamed tributary flows into Valley River approximately 1500 feet downstream. The Valley River meets the definition of a Traditional Navigable Water. For these reasons, we believe that the unnamed tributary to Valley River is a Relatively Permanent Water and is under the jurisdiction of the U.S. Army Corps 6f Engineers. In order to make the needed safety improvements to US 19 Business, it will be necessary to impact waters of the United States in the Hiwassee River Basin. Specifically, NCDOT is requesting to extend one culvert in an unnamed tributary to Valley River.
