Sullins Dee Freeman Governor Director Secretary May 3, 2011 Wal-Mart Real Estate Business Trust Attn: Mr. Steve Mitchael, Director of Design 2001 SE I Oh Street Bentonville, AR 72716 Subject Property: Wal-Mart Store No. 3036-00, Yanceyville APPROVAL OF STORMWATER MANAGEMENT PLAN (SMP) Dear Mr. Howell: DWQ #: EXP 11-0189v2 Caswell County The Express Review of the Division of Water Quality (DWQ) has reviewed your SMP application dated April 1, 2011 received on April 25, 2011 and additional information received on April 28, 2011 along with supporting information including site grading and drainage plans, stormwater best management practice (BMP) design calculations and operation and maintenance (O & M) agreement for the subject development in Caswell County. The DWQ approves the SMP to meet the 401 Water Quality Certification SMP Condition when issued by the Winston-Salem Regional Office of the DWQ. This approval is for the purpose and design described in your SMP and 401 applications. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this approval letter and is thereby responsible for complying with all conditions. This approval requires you to follow the conditions listed in the 401Water Quality Certification for your project (when issued by DWQ) and the following additional conditions listed below: The SMP approved by this office consists of a wet detention pond BMP, all associated stormwater conveyances, inlet and outlet structures, the grading and drainage patterns depicted on plan sheets dated April 20, 2011 and April 27, 2011 (PE's and RLA's sealed dates), and wet detention basin O & M agreement signed and dated March 22, 2011 by Mr. Carl Muller (Vice President, Real Estate). The approved SMP must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. The stormwater management structures shall have maintenance access and at least a 10-foot drainage easement on each side to allow for the ability to maintain the structures, and to perform corrective actions. The stormwater easements shall be recorded to provide protection of the structures from potential alterations by future property owners. 2. Operation and Maintenance of BMP: Maintenance activities for the proposed BUT must be performed in accordance with the O&M agreement referenced in condition 1 above. The O & M agreement must transfer with the sale of the property or transfer of ownership/responsibility for the BMP facility.
