Box 5665 Statesville, NC 28687 April 22, 2011 Mr. Alan Johnson NCDENR Re: Request to Replace Sandboxes in Harbor Watch Subdivision Dear Alan, We appreciate you taking time from your busy schedule to meet with us and offer your suggestions concerning repair and/or replacement of the sandboxes located on Lake Norman in our neighborhood. As we discussed on April 13, 2011, our homeowners association would never have constructed sandboxes such as this along the water front. This entire area was constructed by the developer of our community and then the homeowners association inherited it from the developer and became responsible for it in 2000. This small marina area is the only amenity that Waterfront Properties constructed in our development. The only part of the marina area that is really usable is the dock and the boat launch. The sandboxes are unusable because of the unsanitary condition of the sand and the deterioration of the supporting timbers around the sandboxes. We would respectfully request that you review the following information and provide us with your guidance in correcting the existing problems that we are having with the marina area. We would request that you approve our request to (i) replace the rotting timbers now in place as the walls surrounding the sandboxes with standard blocks made by Belgard; (ii) replace the existing sand in the sandboxes with permeable pavers suitable for a picnic area; and (iii)'place a roof over the existing dock area in order to provide some type of shade. Your help and understanding with this project is greatly appreciated. Background: During the past few years our boat launch area has fallen into disrepair. Every year we face the same problems concerning the condition of the boat launch area in general and the sandboxes in particular. Every year we attempt to remedy the problems with a "quick fix" or "band aide." The Dock Committee is in agreement that our boat launch area needs a major overhaul and a permanent repair and/or modification to avoid facing this same problem year after year. The timbers forming the walls around the sandboxes are rotting and becoming unsafe. Every summer the sandboxes are infested with nests of yellow jackets, wasps, hornets, etc. and are unsafe as a play area for our children, as well as, a picnic area for our families. The area is also in need of a shaded area. This can be accomplished by construction of a roof over the sitting area of the existing dock.
