Dear Mr. Williams:
I appreciate the time that you and the other members of the Interagency Review Team spent at the
Cripple Creek site on April 12, 2011. As follow up, please find enclosed a hard copy of the Baseline
Monitoring Report/As--Built Baseline Report for the Cripple Creek Stream & Wetland Mitigation
Bank (SAW- 200701188) as well as a hard copy of the full-size As-Built Survey.
We have made a couple of revisions to this document since our walk through. The primary change is
in the surveyed stream mitigation units (SMUs) produced on-site. The draft report provided on-site
indicated that the project produced 99 fewer SMUs than described in the Mitigation Banking
Instrument (MBI) and Mitigation Plan (4,419 as compared to 4,518). After looking carefully at the
As-Built survey, it was noticed that the surveyor had not included the full length of streams at the
ends of the tributaries. Our surveyor, John Rudolph, has corrected this error. The correct As-Built
yield of stream mitigation units is 4,487 SMUs (31 less than the 4,518 in the 14111) as shown in the
attached documentation.
The draft report showed that vegetative plot 3 did not have a sufficient number of planted trees.
Additional trees were planted in the area of plot 3 and the monitoring plot now has a baseline count
of 16 stems (Table 6).
Based on the completion of the As-Built documentation, which shows that the Cripple Creek Stream
& Wetland Mitigation Bank, has (as a baseline) 4,487 SMUs, 6.4 riparian wetland mitigation units
(rWMUs), and 1.45 nonriparian mitigation units (nrWMUs), and IRT inspection Task 2 of the Credit
Release Schedule has been completed. As such, I respectfully request that a release of 15 percent of
credits be approved by the IR'I'. I understand that this Task 2 credit release shall be adjusted to
account for the shortfall of stream units between the MBI and the As-Built, thus the credit release

should be 668.4 SMUs, 0.96 rWWs, and 0.22 nrWMUs. The revised credit release schedule is
shown below:

I have also provided herein. a copy of the 2010 ledger for the Cripple Creels Stream & Wetland
Mitigation Bank as the Annual Report for the Cripple Creek Bank as required by the terms of the
IVIBI. As shown on the ledger, the initial credit release was approved by the IRT on February 4, 2010.
One -transaction occurred in July of 2010 wherein all 677.7 of the available SMUs and 0.75 r\VMUs
were sold to provide compensatory mitigation for impacts to streams and wetlands in the
development of Alarnance Crossing (Corps Action ID # 200703073201). At the end of 2010, the
credit balance for the Bank was 0 SMUs, 0.21 rWM[_Ts, and 0.22 nrWMUs.
As a last point, it was noted during the April 12 walk through that the Bank area appears to
encompass a greater area of potential wetland hydrology than was shown in either the Nitigation
Plan or As-Built document. Restoration Systems will install an additional monitoring well within this
area not currently classified as wetland restoration and Nvill continue to monitor the hydrology and
vegetation. The monitoring results and any potential additional wetland credits will be described in
the Year 1 Monitoring Report, which will be submitted no later than December 31, 2011.
In addition to this hard copy transmittal, I will provide electronic copies of these materials for
