a. Construction of the project as described in the mitigation plan;
b. Site inspection conducted by US Army Corps of Engineers.
The Nationwide Permit 27 verification for this project, issued on October 20, 2010, requires
that as-built plans must be provided within 60 days of completion of the authorized work. The
final as-built plan was provided on April 21, 2011. Based on the site inspection, review of the
as-built plans, and your letter dated April 20, 2011, we have determined that the total stream
mitigation units (SMUs) at the site is 4,487, which is 31 less than the 4,518 SMUs projected in
the approved mitigation plan and MBI. As such, the credits released upon completion of Task 2,
will be adjusted to account for the difference between the projected amount in the
MBI/mitigation plan and the as-built plans.

Dear Ms. Allden:
This correspondence is in reference to the Cripple Creek Stream and Wetland Mitigation
Bank you are developing located east of Roney-Lineberry Road, north of Woodbrooke Drive,
south of Deep Creek Church Road and west of North Fonville Road, in northeast Alamance
County, North Carolina, within the Cape Fear River Basin, Hydrologic Unit Code (HUC)
03030002. The purpose of this letter is to confirm the release of credits from this Bank upon
completion of Task 2, as described in General Provision 19, of the Mitigation Banking
Instrument (MBI) for this project.
Pursuant to the Mitigation Banking Instrument (MBI) entitled, Cripple Creek Stream and
Wetland Mitigation Bank, dated December 1, 2009, fifteen percent (15%) of the Bank's total
restoration credits shall be available for sale immediately upon completion of all of the
following:
By copy of this correspondence, we confirm that you have satisfied the above requirements and
668.4 linear feet of SMUs, 0.96 riparian wetland mitigation units (rWMU) and 0.2175 non-
riparian wetland mitigation units (nrWMU) constituting 15% of the Bank's total restoration
credits are now available for sale. To date, 30 percent of the total credits (1,346.1 SMUs, 1.92
rWMUs and 0.435 nrWMUs) have been released. Our records indicate that 677.7 SMU and 0.75
rWMUs have been debited from the Bank. Therefore, the current total amount of credits
available is 668.4 SMUs, 1.17 rWMUs and 0.435 nrWMUs. Please confirm these totals on your
mitigation bank ledger.
