I just spoke to Amy Euliss about the fee issue. We were waiting on an estimate of stream impact length from the quarry
yesterday and to ensure expedited permit package delivery, estimated the impact length as 150 ft. We met with the
quarry this morning and confirmed that it would actually be closer to 100ft in length. Therefore the fee should be the
$240 we have already paid. Amy advised us to update the impact sheet and send it along to you - it is attached. We
apologize for the confusion. Please let us know if you have any other questions.

Amy,
Yes, we are requesting written concurrence from DWQ. We are going to be delivering the package to the Raleigh Office
this afternoon.
The drawing shows what is currently onsite and what is proposed. The dam, which has been in place in one form or
another since the 1930s, has already been significantly lowered and is just a couple feet shy from meeting the 1015
elevation requirement. So while the water level will be much lower and they plan on just working off of the rocks of the
berm (in the dry), we can't say for sure it will be totally "dewatered". NCGC is proposing to use stones from the existing
dam and washouts, and place them in a small low height loosely packed arrangement that is laid out parallel to river
flow (i.e. create a small berm). This berm would route river flow to the quarry's intake structure. This effort will be
further enhanced by removing some of silt that has built up. The berm would be created by traveling on top of the
existing dam and placing stones on the river bed to form a path for an excavator to travel on to the upstream extent of
the proposed berm. Once the upstream end has been reached, the excavator would travel downstream on the stone
path towards the dam consolidating and removing excess material. Upon arriving at the dam, additional material would
be removed to lower the height of the dam across the river starting at the far bank and working back to NC Granite
property.
Additionally, NCGC plans to recover as much material as possible that is already in the river channel from previous dam
wash outs and lowering of the dam. It is estimated that any additional fill, consisting of clean discrete granite stones
ranging in size from 1.5 feet in diameter up to 3 feet in diameter, would total at a maximum 15 to 20 cubic yards.
We are working quickly to develop a permanent solution, but just don't believe it feasible to have it designed, permitted,
and constructed in two months. We believe a realistic expectation is 4 months.

planning to dewater to place the fill. If not, I need to know why. Also, I need your best estimate for
how long the structure will be in the water. Finally I'm assuming the drawing is showing the existing
dam, which spans the width of the river. Is that true? Its going to be very difficult to get you a permit
by Monday. I know the Quarry is in a pinch, due to the need to comply with the order by the USACE
to reduce the water level. Our Raleigh office needs to receive and process the PCN before I can
issue it, if you need written concurrence. I would suggest hand delivering it today.

As you are aware, the NCGC has been ordered to reduce the elevation of the dam in Ararat River such that the water
surface elevations at flap gates 2 and 3 of the Renfro Levee do not exceed 1015 NGVD 29. This must be completed by
April 25, 2011.
Until the long-term proposal can be permitted and implemented, reducing the height of the dam to the required level to
meet the April 25, 2011, deadline will seriously impact the continued operation of the NCGC. As such, NCGC is
requesting a permit for temporary fill in the Ararat River to temporarily divert flow towards the intake structures, a
measure that is expected to allow the quarry to continue to function while complying with the 1015 foot NGVD 29
requirement.
Please find the attached PCN form and associated documents necessary for the Nationwide Permit #33. Please let us
know if you have any questions or need any additional information to facilitate the processing of this application.
