There is approximately 1,000' of sfiote'.ine adiacent tt? tl., rionib of Bid; Creek.
Big Creek is greater than 1,600' across at this location. Immediate offshore water depths
reach -2' below the normal water level (nwl). The existing boat basin is approximately 110'
long and 60' wide. The existing access channel is 20' wide and 1.00' long. Existing depths
within the basin are approximately -3' nwl deep. This basin can support up to four boat
slips.
The current vegetation on the tract mainly consists of upland grasses and wetlands. There
are approximately 1.2 nacres of CoastalWetlands on the tract. There is no submerged
aquatic vegetation (SAV), .ear the vicinity of the prcji"t area. The elevation of the tract is
+5' n.v l along this high bluff shoreline. 'The property is currently developed with a single
family dwelling, two out buildings, a boat basin stabilized with a bulkhead, a boat ramp
into the Basin, and a side••to dock in the basin.
The Carteret County Laud Use Plan classifies the project area as Rural, with LAMA
AFC's classified as Conservation. These waters of the mouth of Big Creek are not
designated as Primary Nursery Area, but are open to shellfish harvesting. These Estuarine
Waters carry a water quality classification of SA; IIQW, NSW. The bottom substrate is
firm without shell. There are no Cultural Resource sites noted along this stretch of.

1-0. Proposed Development:
The request is to construct a 1-slip-dockiaag facility, replace an existing wooden bulkhead
with vinyl around the existing boat basin, expand the side-to dockage within the basin,
perform maintenance excavation of the existing basin and its access channel, and new
excavation to expand the length of the access channel.
The proposed private residential docking facility will be constructed on the eastern
shoreline of the property, approximately 150' east of the existing residence. The main
access pier will be 5' wide and 159' long. There will be a "T" platform at the waterward
terminus of the access pier. This platform will be 6' wide and 60' long. There will be an

18'-wide, side-to wet slip outside of the platform. This boat slip will be supported by three
clusters of dolphin tie pilings. This docking facility will extend 170' waterward of the nwl.
The proposed bulkhead will encompass three sides of the basin. The new vinyl bulkhead
will be installed 2' waterward of the existing wooden bulkhead. This new bulkhead will be
190' long. Side-to dockage is proposed immediately waterward of the new bulkhead and
within the existing basin. This dockage will be 6' wide and 165' long, in total. This
dockage within the basin supports four boat slips.
The proposed maintenance excavation will take place within this existing boat basin and
access channel. This excavation will return the boat basin and access channel to the
original (permittad,in 1983) depth of -5' nwl. Due to natural shoaling offshore, the
proposed new excavation will lengthen the access channel to connect to the existing -5' nwl
contour in Big Creek. The new access channel extension will be 20' wide and 100' long.
This will involve an average removal of -2' of material within the footprint of excavation.
The permanent spoil disposal area will be contained on site, located approximately 150'
west of the boat basin. It will be contained by silt fence entirely on high ground. This spoil
area will encompass 10,000 square feet. The work to be performed will utilize traditional
marine construction methodologies (i.e. "bucket to barge," vibrating pile driver, etc.).
11. Anticipated Impacts:
The proposed new and maintenance excavation will involve the removal of 455 cubic yards
of sandy/silt material. The existing access channel will be extended another 100' out into
Big Creek. The new bulkhead will fill 380 square feet of shallow bottom within the boat
basin. Any turbidity created as a result of this proposal will be short lived. The spoil area
will fill approximately 10,000 square feet of high ground.
The new 1-slip docking facility will usurp 10,200 square feet of Public Trust Area. It will
shade 2,285 square feet of Estuarine Waters. This docking facility will extend
approximately 150' waterward, and will not pose a hazard to navigation. The proposed
dockage is greater than 200' from the adjacent riparian property line. There will be a total
of five boat slips, four existing in the basin and one proposed at the new docking facility.
This proposal does not necessitate review under the State Environmental Policy Act
(SEPA) because the new access channel is within 100' of the shoreline. This project is
subject to the NCDWQ Neuse River Basin Riparian Buffer Rules. These waters of Big
Creek are not designated as Primary Nursery Area, but are open to shellfish harvesting.
These waters carry a water quality classification of SA; HQW, NSW. There are no SAVs
in the project area. There are no Cultural Resource sites along this area of the Big Creek
shoreline.

The following is my assessment and consequent recommendations of the above referenced
proposal: This proposal involves the filling of 10,000 square feet of high ground. The boat
basin and access channel will excavate 8,950 square feet of shallow bottom. The private
residential docking facility will incorporate 2,235 square feet of Public Trust Waters. The
bulkhead will impact 380 square feet of shallow bottom. The waters of Big Creek are open to
shellfish harvest. This section of the waterbody is not a Primary Nursery Area. There is no SAV
in the nearby_ vicinity of the project area. There are no Cultural Resource sites in the proposed
work area., Assuming that state and federal agencies concur with the proposal and that the
NCDWQ determines this project to be consistent with the Neuse River Riparian Buffer Rules, I
recommend the project be authorized as proposed, contingent upon the following conditions:
1) A pre-construction meeting must be scheduled with a DCM representative at least thirty
days prior to the initiation of any construction activities;
2) Excavation will not exceed -5.0 feet belm4, +he normal water level. In no case shall the
depth of excavation exceed the depth of connecting waters;
3) In order to protect water quality, runoff from the construction must not visibly increase
the amount of suspended sediments in adjacent waters;
4) No vegetated wetlands/marsh grass will be excavated or filled;
5) The temporary placement or double handling of excavated or fill materials within waters
or vegetated wetlands is not authorized;
6) The Division of Coastal Management shall be notified in writing at least two (2) weeks in
advance of any -maintenance work authorized by this permit, and such notification shall
include:

C. A copy of the original permit plans with cross-hatching indicating the area to be
maintained, the area to be used for spoil disposal, and the estimated amount of material to
be removed. The location, design and holding capacity of the spoil disposal site must be
approved by a representative -of the Division prior to the initiation of any maintenance
dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original
plan;
7) All excavated materials will be confined above mean high water and landward of
.regularly or irregularly flooded marsh behind adequate dikes or other retaining structures
to prevent spillover of solids into any marsh or surrounding waters;
8) No spoil material is to be placed within 50 feet of the normal water level or the landward
edge of the Coastal Wetlands, except that which will be used to backfill the area behind
the permitted bulkhead;
9) The proposed bulkhead will not extend waterward more than 2 feet from the normal
water level at any point along its alignment at the time of construction;
10) The'proposed bulkhead must be constructed prior to any backfilling activities;
11) This permit authorizes a maximum of 5 boat slips. At no time shall more than 5 vessels
be moored or docked at the facility. The restriction of the number of vessels shall apply
to all marine vessel types, including but not limited to motorboats, sailing vessels and
personal watercraft;
12) Appropriate sedimentation and erosion control devices, measures or structures must be
implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses
and property (e.g. silt fence, diversion swales or berms, sand fence, etc.);
13) Any development or land disturbing activity that is considered non-water dependent is
not authorized within 50 feet of the normal water level unless specifically exempted by
Environmental Management Commission (EMC) Neuse River buffer regulations in
place at the time of such development.
NOTE: Future development of the permittee's property may require a modification of this
permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement
of any such activity for this determination.

Dear Mr. Connell:
On behalf of Mr. Steve Smith, please find enclosed a.AMEN permit application requesting
authorization to conduct development activities at and adjacent to his property located in the
community of South River, Carteret County. The property is specifically located at 227 Tosto Road
and adjacent to Big Creek, a tributary of South River. A portion of Big Creek upstream of Mr. Smith's
property has been designated as a primary nursery area.
Mr. Smith's property consists of three tracts of land totaling approximately 27.5 acres in size. The
waterfront tract, which is the subject of this permit application, is approximately 8.7 acres and has an
existing residence and several outbuildings located on the property. The majority of this tract is
vegetated with lawn grasses and trees with elevations of approximately 8' above mean sea level. Along
the water's edge, a fringe of coastal wetlands exists.
In 1977, a former property owner obtained the required state and federal permits (Dredge and Fill
Permit No. 73-77) to excavate an access channel through this wetland area and to also excavated an
upland boat basin. In 1983, another property owner obtained the necessary permits (LAMA Permit No.
40-83) to conduct maintenance excavation and to expand the existing upland basin. All of the
excavation projects were to a depth of -5' normal water level (nwl). Over the years, previous land
owners have installed a wooden bulkhead, a concrete boat ramp and constructed a dock within the boat
basin area. A CAMA general permit has also authorized the placement of riprap in front of the wetland
fringe to protect this area from -cosion.
Mr. Smith has recently acquired this property and now wishes to undertake maintenance and new
development activities at this property. They include:
- Restoring the water depths in the boat basin and the access channel to a -5' nwl depth.
Excavation will be accomplished by a barge mounted excavator with the spoil material being
placed in a disposal area in the applicant's yard approximately 150' landward of the basin;
- Replacing the existing bulkhead with a new vertical wall structure. The new wall will not
exceed 5' (with an average distance of 2') waterward of the existing bulkhead;
- Construct a 6' wide dock around a portion of the boat basin. A section of the new dock will
replace an existing deteriorated one. The dock will located over the water on the north and west
side of the basin but over high ground on the south side;
- Construct a new pier into Big Creek which will extend into the water for a distance of 159'.
The pier will be 5' wide and will provide access to a 6' wide x 60' long "T" platform. Off shore
of this platform will be three dolphin clusters which will be 18' from the "T" platform and will
provide a dockage area for a deep draft vessel. Water depths between the platform and dolphins
are approximately -5 1/2' nwl deep. According to detailed measurements made by Mr. Smith,
this proposed pier will not exceed the established pier length for similar uses along the same
shoreline. Upstream of this property, an existing pier and adjacent mooring pilings extend into
the waters of Big Creek for a distance of 183'.
