PROJECT SUMMARY: The applicant proposes to construct 17 piers (13 new and 4 repair/ replace) to access proposed water quality monitoring stations. PCS Phosphate Company, Inc. Creek Monitoring Piers Beaufort County Express Permit Review Program Project setting Jeff Furness with PCS Phosphate Company, Inc., has requested the attached application be processed under the Express Permit Review Program, for the installation of 17 piers to access proposed water quality monitoring stations. The project sites are located around the PCS Phosphate, Inc. plant site near the Town of Aurora on Tooley, Porter, Duck, Little, Jacks, Drinkwater, Jacobs, Long and Durham Creeks as well as sites identified as PA2, DCUT11 and DCUT19, in Beaufort County, North Carolina. PCS Phosphate Company, Inc. (PCS) is a mining and refining industry located near the Town of Aurora in Beaufort County, North Carolina. PCS has extensive land holdings in the county bordering the Pamlico River, Pungo River, South Creek and their tributaries. PCS received a permit from the US Army Corps of Engineers (USACOE) on 10 June 2010 (Action ID 200110096) for impacts to 404 wetlands as part of a proposed mine advance. Part of the permit conditions require PCS Phosphate to conduct water quality monitoring on surrounding creeks in the area for pre and post project analysis. The proposed sites are vegetated with various species of coastal wetlands including SSpartina cynosuroides, Juncus romerianus, Spartina patens, Cladium aamaicense and Typha spp.. Other vegetation on the sites includes mixed hardwoods, pines, wax myrtle, Phragmites, palmetto, vines, and various species of wetland vegetation. The site elevations vary from 0' to 4' above normal water level (NWL) and the water body widths vary at each site location and individual walkway/pier dimensions are summarized in Table 1 of the application. Tooley, Little (downstream), Jacks, Drinkwater (downstream), Jacobs (downstream), PA2 (midstream) and Long (upstream and downstream) Creeks are all classified as SA,HQW,NSW, by the Environmental Management Commission. Porter, Duck (upstream and downstream), DCUT 11, DCUT 19 and Durham (midstream) Creeks are all classified as SC, NSW by the Environmental Management Commission. Little (upstream), Drinkwater (upstream) and Jacobs (upstream) Creeks are all classified as C,NSW by the Environmental Management Commission. Tooley, Porter, Duck, Jacks, Drinkwater and Jacobs Creeks are all designated as Primary Nursery Areas (PNAs) by the Wildlife Resources Commission. South Creek is classified as a Special Secondary Nursery Area by the Marine Fisheries Commission. None of the project sites are open to shell fishing. Project description The applicant proposes to construct 13 - 2' wide access walkways and repair/replace or add to 4 existing piers with monitoring stations as follows: PCS Phosphate Company, Inc. Tooley Creek upstream - construct 32' of new walkway/pier over Coastal Wetlands to uplands and replace the existing 3' wide by 42' long walkway/pier that projects 11' into the creek with a 2' wide by 42' long walkway/pier. 2. Porter Creek downstream - construct 24 of walkway/pier with 20' projecting into the creek. 3. Duck Creek upstream - construct 72' of walkway/pier with 22' over Coastal Wetlands and 40' over wooded wetlands and 10' projecting into the creek. 4. Anticipated impacts The project as proposed will result in the shading of 352 ft2 creek bottom associated with the monitoring piers. Approximately 914 ft2 of wetlands (±818 ft2 of Coastal Wetland and ±96 ft2 of wooded wetland) will be shaded by the walkways. Approximately 82 ft2 of uplands will be shaded by the walkways. The project will result in localized turbidity as a result of the construction activities. David W. C ,M" AW Appli S{onave Narrative PCS Phosphate Monitoring Piers Corps of Engineers 404 Permit No. 200110096 and DWQ401 Water Quality Certification No. 3771 requires that PCS Phosphate monitor area creeks to assess the effects of reduction in watershed size due to mining activities. Creeks that have the potential to be impacted and control creeks will be monitored. Salinity and water level measurements are required to be frequently collected (approximately hourly), and water quality samples collected and analyzed twice per month. To accomplish this monitoring, a small pier needs to be constructed (or in a few cases a pier replaced) in 17 locations within 12 area creeks. Each pier will extend from higher ground to each creek channel in order to reach approximately two feet of water at normal water level. Therefore, each pier will be a different length. In no case will any pier exceed more than 25% of the width of the channel. All piers over marsh will be constructed such that the distance from the marsh substrate to the bottom of the decking will be a minimum of 36 inches. An automatic salinity and water level monitor will be mounted at the end of each pier. Twice per month the data from the monitor will be downloaded, and a grab water sample will be collected for analysis. All piers will be located on PCS Phosphate property, and are designed to be as narrow as possible (two feet wide) and still allow safe access.
