Enclosed are five (5) copies of the 401 permit application for stream impacts to an unnamed tributary to Zacks
Fork Creek in Lenoir, North Carolina. The permit application and application fee was originally submitted to
DWQ on January 28, 2011. The project was placed on hold due to a change in the location of the driveway.
Per a conservation and email from Linda Wiggs, the project could be placed on hold until April 15, 2011 without
repaying the application fee. The impact will consist of fill and a culvert with dissipation for a driveway (NWP
39). The total impact to the stream is 75 If.
Brushy Mountain Builders plans to develop the site as restaurant and/or retail space. Chick-fil-a is purchasing
the northern parcel and plans to develop it once the proposed driveway is constructed. The new driveway
access is necessary for two reasons. The primary reason is Chick-fil-a is requiring the new entrance from
Highway 321 as part of the condition of the sale of the property. They do not want the traffic that will be going
to the other parcel to the south of the new driveway once it is developed through their property and have made
the new driveway a condition of the sale. The second reason is the City of Lenoir will not allow the use of
Woodland Drive as a primary access to the site (see enclosed letter from City of Lenoir).
One copy of the permit application has been submitted to the US Army Corps of Engineers. If you have any

The City of Lenoir is in receipt of the driveway plans for the above property. The plans indicate
the use of an existing driveway access to US Highway 321 adjacent to Blowing Rock Boulevard, a second
"right-in/right-out" access to US 321 to be located between the existing access and Hospital Avenue,
and a proposed access to Woodland Street NW. The purpose of this letter is to document that approval
of the plan as submitted is conditioned upon the creation of the second access to US Highway 321. The
proposed Woodland Street access cannot serve as a primary point of ingress and egress as this would
generate unsafe traffic volumes at the intersection of Woodland Street and Hospital Avenue.

• Scaled stormwater BMPs must also be indicated as required by DWQ rules and policies
• In certain cases (see Section E of PCN form), final stormwater management plans must
also be provided (see Stormwater Management Plan Checklist)
® Proposed Impacts - All impacts to jurisdictional and non jurisdictional wetland, stream,
water features, and State regulated buffers must be shown and labeled on the site plans at
a scale no smaller than 1" = 50'. All excavation, fill, flooding, stabilization, and other impacts
that will be conducted in or near jurisdictional and non-jurisdictional wetland, stream, water
features, and State regulated buffers must be indicated. Please provide cross sectional
details showing the provisions for aquatic life passage (burial of culvert 20% for culverts <_ 48
inches, and 1-foot for culverts > 48 inches).

This delineation/determination has been conducted to identify the limits of COE's Clean Water Act jurisdiction for the
partricular site identified in this request. The delineation/determination may not be valid for the wetland conservation
provisions of the Food Security Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation
in USDA programs, you should request a certified wetland determination from the local office of the Natural Resources
Conservation Service, prior to starting work.
Placement of dredged or fill material within waters of the US and/or wetlands without a Department of the Army permit may
constitute a violation of Section 301 of the Clean Water Act (33 USC § 1311). If you have any questions regarding this

The site contains stream channels located on the property that exhibit indicators of ordinary high water marks. The stream
channel on the property is known as an unnamed tributary to Zack's Creek which flows into Lower Creek which flows into the
Catawba and ultimately flows to the Atlantic Ocean through the Gulf of Mexico.
