On behalf of our client, Highwoods Properties Inc, we request an appeal of the buffer determination
performed by Ms. Deborah Edwards (NCDWQ) for the Lofts at Weston Site. Ms. Edwards determined.
that feature A (see attached packet) on the property that is depicted on the Wake County Soil Survey and
~TSGS is subject to the Neuse River Buffers approximately at flag SO1. S&EC does not believe this
feature should be buffered under the current conditions. Please accept this letter as an official appeal
request. We are only appealing the determination of feature A. We concur with the other determinations
throughout the property. Your help in clarifying the status of this feature is greatly appreciated.

Dear Mr. Clark;
On June 26, 2Q03, at your >~equest I conducted as on-e~ite determination to review three featurrss
located on die subject property for applicability to the Nevae Bu#fer Rules (1SA NCAC 2B
.0233). The foahurs are labeled as "A, B and C" on the attached map initialed by me on October
26, 2004,
The Divlslon of Water Quality (DWQ has determined that the surface water labeiod as iiA
and C" on the attached maps are subject to the Neese Btriter Rule. Feature A bas bean
delineated in the field and Its orlgla is ldentifled as flag #SOI. Feature C has not beep
contested, it is Crabtree Creek and is subject to the Neese Butter Role. However, feature B
is an ephemeral drainage and is not snb,~erwt to the Neese BaPfer Rude. These features and
their associated buffers should be identified on a:zy future plans for this property. The owner (or
future owners) should notify the D'WQ (and other relevant agencies) of this decision in any
future correspondences caaee>'ning this property. This on-site determination shall expire five (S)
years from the date of this letter.
Landowners or affxte;d parties that dispute a determination made by the DWQ or Delegated
Local Authority that a surface water exists and that it is subject to the bu#l'er rule may request a
determination by the Director. A request for a determination by the Director shall be referred to
the Director in writing c% robe Dorsey, DWQ Wetlaads/401 Unit, 2321 Crabtr+x Blvd.,
Raleigh, NC 27'6042260. Individuals that dispute a determination by the DWQ or Delegated
Local Authority that "exempts" a surface water from the buffer rule may ask for an adjudicaWry
hearing. 'X'ou must pot within 60 days of the date that you receive this letter. Applicants are
hereby notified that the 60-day statutory appeal time dons not start until the affected party
(including downstream and adjacent landowners) is notified of this decision. DWQ recommends
that the applicant conduct this notification in order to be certain that third party appeals are made
