I have received the comments in the letter dated Mazch 16, 2011 from Roger C. Edwazds. The tract of land is listed as 33.5 acres. This tract was purchased with the intent of development. The development plans have changed over the past two yeazs due to the economic recession. A developer was negotiating with Mr. Fortner on the construction of cabins on the property; however, those negotiations have ceased and the developer has pulled out. An erosion control plan for this original development was submitted to the Jackson County Erosion Control office on May 22, 2007. I have enclosed a copy of this erosion control plan with the impact of this permit noted on the plan for information purposes only. Mr. Fortner is currently seeking a new developer. Therefore, the next phase of the tract and subsequently the number of lots or the type of development is still undetermined. The construction of a good entrance onto the property will not only make the tract accessible but also potentially attract a new developer to the property. The tract has an existing grass road system that was constructed at an earlier date. This road system is not correctly depicted on the erosion control plan. There aze fewer roads existing than shown on the plan. There are no current plans to revise the location of the existing roadbeds. This would be a part of the next phase to be determined by a potential developer. Any changes in the lot layout and building footprints will be permitted and sent to the appropriate agency at that future time. Upon a site visit on March 30, 2011, an additional unnamed tributary to Soco Creek was noted. The approximate location of this stream along with the approximate length and location of four existing culverts has also been noted on the erosion control plan. These culverts appeaz to be of sufficient length that additional future permits are not anticipated. Cherokee Mountain Club There are no additional impacts anticipated beyond the current permit request in the development of the property. The access to the property at this location is necessary because the adjacent land owner removed the original access to the property with the placement of a mobile home. Access to the property would require a permanent easement on private property and would encroach on the required setback of the mobile home from the roadway. The property is further landlocked on the north by Soco Creek. The minimum construction standards for a residential collector for Jackson County require an 18' roadway with 4' shoulders. The minimum fill slope is 1 '/Z:1 and the minimum radius of curvature is 120' for horizontal curves. The new access will connect to the existing roadbed on the west bank of the creek. The construction of a horizontal curve is the best fit for the existing alignment with the creek. Utilizing the minimum construction standards, the plan has been revised to reduce the impacts to 581inear feet. The width of the roadbed and shoulders is 26' along the centerline of the creek due to the curvature of the road. As stated previously, the next phase is undetermined until a new developer has been identified; therefore, proposed building footprints, driveways, etc cannot be properly placed on the plan or accounted for in a storm water management plan. This application is solely for the construction of the property access. The access will be covered with a minimum of 6" of aggregate base course for erosion control purposes.
