Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The proposed corridor is primarily wooded. Property surrounding the corridor is also primarily wooded, however existing residential subdivisions, existing individual residential lots and some office/institutional developments are also in the area. 3b. List the total estimated acreage of all existing wetlands on the property: There is approximately 0.0008 acres of wetland within the easement corridor. 3c. List the total estimated linear feet of all existing streams (intermittent and perennial) on the property: The proposed sewer line parallels Cates Creek and one UT to Cates Creek with 3 proposed stream crossings. 3d. Explain the purpose of the proposed project: The proposed project is the construction of a sanitary sewer outfall. The proposed sanitary sewer outfall will provide the Town of Hillsborough sanitary sewer service from existing sewer lines immediately north of 1-85 south to I-40 along Cates Creek. During recent survey activities, it was noted that a single stream crossing was missed (see attached revised maps depicting new temporary stream crossing No. 12). Additionally, further study of the proposed sewer extension has necessitated the upgrade of the existing pump station. The new pump station will be built on top of the existing pump station. This connection and upgrade will result in a minor amount of temporary wetland impact (see attached revised maps depicting Impact No. 13); this is necessary in order to collect the gravity flows from the east side of the Waterstone development and then pump back to the Cates Creek outfall located within Waterstone Drive. 3e. Describe the overall project in detail, including the type of equipment to be used: The proposed sanitary sewer line includes 3 stream crossings and one wetland impact which will be temporary in nature. The permanent maintenance corridor also necessitates protected Neuse River Riparian Buffer impacts. Heavy machinery typically used for sanitary sewer outfalls will be used for this project. In 1999, a 404 Nationwide Permit (Action ID#199921039 & 200020177) and a 401 Water Quality Certification (DWQ Project #990813) were issued for this sewer line. The corridor permitted at that time had much greater impact to the streams, wetlands and buffers than the currently proposed corridor. The wetlands and streams within and adjacent to the current corridor were delineated in February of 2005 and re-evaluated/surveyed in February 2006 to further avoid impacts. In 2006, the NC DWQ re-authorized the proposed sewer line (DWQ Project #99-0813, Ver2.); the project was also statutorily approved by the USAGE in 2006 (see attached USAGE AID 2006205220). On Nov. 30th and Nov. 23`d 2010 the USAGE and NC DWQ (respectively) re-authorized the Cates Creek Sewer Extension (see attached USAGE AID SAW-2010-01940 and NC DWQ Project No. 99-0813, Ver. 3). 6. Total buffer impacts 15,684 36,767 6i. Comments: The Neuse River Riparian Buffer impacts proposed for the sewer line installation include the temporary construction corridor as well as the permanent, 30-foot wide maintenance easement. Buffer Impact #1 proposes an increase to buffer impacts originally permitted in this location. This is due to the need for a temporary construction easement that was not accounted for in the original permit requests. Impact #2 proposes an increase to overall Buffer impacts for the same reason. Impact #3 requires a 30-foot wide construction easement due to the steep topography on the right side of the proposed sewer line and conflicts with the DOT right-of--way (ROVI~ for Old NC Highway 86. DOT does not allow parallel construction encroachments within their ROW. Impact #4 shows a reduced construction easement (10-foot wide) due to adjacent property owner negotiations (i.e. no encroachments and/or equipment on property). Impact #6 (sheet 5) proposes a 30-foot wide construction corridor, however, this corridor has been pushed closer fo the stream necessitating an increase in Buffer impacts. This is due to the proximity of a residence on the adjacent property, agreements with the adjacent property owner requiring equipment and any construction activities be off property and the necessity to avoid the adjacent property owner's septic line and associated leech field. Impact #5 (sheet 6) proposes only minimal impacts to the riparian buffer as there was flexibility in placing the construction corridor and the permanent maintenance corridor as far from the stream buffer as was possible. The majority of the proposed buffer impacts are associated with the necessary stream crossing to connect to the existing manhole. Impacts #7 & 8 propose buffer impact only to Zone 2. The applicant was only able to acquire easements in this particular location. It should be noted that grading and revegetation within Zone 2, provided Zone 1 of the buffer is not harmed, is an "allowable" activity per the Neuse Buffer Rules. The majority of the buffer impact in this area will only be for the temporary construction corridor and will not be part of the permanently maintained easement. Impact #9 proposes minimal impacts to Zone 2. These impacts are part of the permanent maintenance corridor and cannot be removed or avoided. Impact #10 proposes a 10-foot wide construction easement that is necessary due to the steep slopes in the area which prevents equipment from being located up on the hillside during construction and excavation on the uphill side of the slope is not feasible. Impact #10 is necessary due to the deep depth of the existing upstream manhole that this sewer line will tie into. This depth triggers the need for the additional width of the temporary construction easement. The newly proposed Impact No. 12 (sheet 5) requires a 30-foot wide construction easement corridor due to topography issues and the location of the sewer above and below this crossing. Additionally, the sewer line conflicts with the DOT right-of-way (ROW) for Old NC Highway 86. DOT does not allow parallel construction encroachments within their ROW. Page 8 of 13 D. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant recognizes that the proposed temporary impacts for the sewer line installation will be for the minimum period of time required to complete the activity and that the stream areas must be returned to pre-impact conditions. Directional drilling and/or boring is not feasible at the two proposed stream crossings due to topography (i.e. shallow depth of the sewer line) and the sewer line corridor easement width (i. e. the pits required to directionally drill/bore would exceed the allotted easement width). The proposed sewer line construction corridor as well as the proposed permanent easement corridor is only 30 feet wide (i. e. does not exceed 40 feet in width). The proposed sewer line is not anticipated to interfere with navigation nor is it proposed to be aerial in nature. The proposed sewer line corridor does not incur any wetland impacts. No rip-rap is proposed at either stream crossing for the proposed sewer line installation. The increased amounts for the riparian buffer impacts were discussed previously in Section 6i. To summarize, the buffer impacts proposed are the minimum amount required in order to install the sewer line. Temporary construction easements are in some cases located primarily in Zone 2 due to topography issues and/or adjacent property owner agreements (i.e. construction activities and equipment must be off property). The majority of the permanent maintenance corridor for the sewer line is outside of the riparian buffer area. As mentioned previously, this proposed sewer line was approved in 1999, however it was not constructed. The project was reauthorized in 2006 and construction started, however, only half of the sewer line was completed prior to the verification expiration and the expiration of all Nationwide Permits in 2007. The economic downturn within the area also put a hold on further construction activities and/or permit renewals until now. The newly proposed sewer line crossing at Impact No. 12 (sheet 5) was inadvertently missed during the previous permitting and approval processes. The increase in buffer impacts at this location was discussed previously in Section 6i. Further study of the sewer line has resulted in the proposed connection and upgrade to the existing pump station. This has become necessary in order to collect the gravity flows from the east side of the Waterstone development and then pump back to the Cates Creek ouffall located within Waterstone Drive. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Orange protective silt fencing will be placed outside of the impacted sewer line corridor to ensure protection of the non- impacted riparian areas. It is the intent of this plan for construction impact to take place during the dryer months of the year and the proposed temporary impacts for the sewer line installation will be for the minimum period of time required to complete the activity. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State ^ Yes ®No Mitigation for temporary stream impacts associated with sewer line installations is typically not required. Mitigation for the temporary wetland impacts should not be required either, as this wetland is more than likely the result of adjacent 2a.
