I have reviewed your request and I do agree that the more of the 1.00 acre area can be
included in the preservation easement. I propose the following:
Total wetlands area: 16.90 acres
Area to be disturbed: 3.90 acres
Total area to be preserved: 13.00 acres
Area to be placed in preservation easement: 12.71 acres Area not in preservation easement:
0.29 acres EEP credits to be purchased: 4.0 acres This places an additional 0.71 acres in
permanent preservation.
I will forward information concerning the restrictive covenant vs.
declaration of restriction when I get a response from the owner's attorney.

Good Morning Neil,
I just wanted to follow up our phone conversation on Monday morning with an email summarizing
it. We are concerned that the proposed mitigation is not sufficient for the project. When we
spoke about the mitigation in November, we explained the purchasing a 1:1 ratio to EEP while
preserving the remaining wetlands would be suffice. The remaining 13 acres of wetlands on
site (especially the 1.0 acres to remain unpreserved) have great value in that they are in
demonstrable threat of later being developed which is why we are excepting this for the
remaining 1:1 ratio of the 2:1.
However, once reviewing the documents sent it, noticing that you were going to leave 1.0 acre
of wetlands unpreserved, and trying to justify it in our EA that the wetlands were being
mitigated for sufficiently. We need to try and get back to the original discussion from
November or try and change the mitigation a bit. Can you lessen the area not being preserved
down to the maximum area needed for a road to go through? If not, we would like to see at
least a 1.5:1 ratio purchased from EEP as well as preserving the 12 acres.
We also discussed why a restrictive covenant was used verses a declaration of
restriction- which you said you would get back to me about as well. I will be in the office
all day today and out the rest of the week.

What is our status with this project? The consistency review deadline is April 8, 2011. Do
we need to extend again?
If so, I will toss out Tune 3, 2011 as a candidate deadline date. You are free to propose
any suitable alternative date as a deadline date.
Please be aware, that if the application for the IP permit from the Corps has "died", the
consistency review process automatically terminated too.

The consistency review deadline has been extended to April 8, 2011. We will strive to

You should receive a copy of our response to NC Wildlife Commission by email today. It is our
understanding that we have satisfied NCDWQ and Army Corps requirements with one exception. We
are preparing a map that shows the areas to be disturbed and areas to be preserved as
requested by Christy Wicker. We do not anticipate NCDWQ will issue its certification by
January 21, 2011. We concur with the consistency review deadline being extended to April 8,
2011.
However, we hope this project is "wrapped-up" within a couple of weeks.

Mr. Staley: The consistency review deadline for this project is February 4, 2011. Since this
date will soon be upon us, I have a couple of questions.
1. What is the status of this project?
2. Will the NCWQ issue its water quality certification in the near
future? (Before January 21, 2011)
3. If the Application to the Corps has been terminated/withdrawn, the
consistency submission "dies" automatically.
4. I don't believe we received a response to the comments made by the
NC Wildlife Resources Commission. Please provide a response.
5. If this proposed project cannot be "wrapped-up" by January 21, 2011;
I would recommend that the consistency review deadline be extended to April 8, 2011. You may
recommend an alternative date that you believe is reasonable. The deadline can be further
extended as needed. All we need is written concurrence for a specific date.
