Location Carolina North is a 947 acre property, with approximately 643 acres located within the Town of Chapel Hill and approximately 304 acres located within the Town of Carrboro. The parcel is bounded by Martin Luther King, Jr. Boulevard (North Carolina I lighway 86) to the east, Homestead Road (State Route 1777) to the north. single family residences Fronting on Cobblestone Drive to the west and F.stes Drive Extension (State Route 1780) to the south. It is divided on the north/south axis bN Seawell School Road (State Route 1843) and the Norfolk Southern Railroad line, in Orangc County. North Carolina. The geographic coordinates (in decimal degrees) for the site are 35.9351 N. and -70.0647 W (NAD83/WGS84). Existing Site Conditions The primary current use ofthe Carolina North property is the Horace Williams Airport. Until 1973, approximately 40 acres of the site, was also used as a municipal landfill. From 1973 to 1979, a one-quarter acre portion of the site, known as the Airport Roar[ Waste Disposal area. was used to dispose of the chemical waste from the university's research activities. That material has now been removed and on-going groundwater renlediation and monitoring continues in the area between the Airport Road Waste Disposal area and Crow Branch Creek. Most of the remainder of the property is undeveloped upland forested areas, although some of the lorested areas were previously runways associated with the airport, some were logged as recently as the 1970's and some were active farmland into the 1970'x. Within the 947 acre Carolina North property boundary, there are approximately 21 stream channels that total approximately 29.079 linear feet. These stream channels include Bolin Creek and 12 unnamed tributaries, Crow Branch and 5 unnamed tributaric? and l unnamed tributary to Booker Creek. Additionally, there are approximately 34 wetland areas that total approximately 10.4 acres. Most of these wetlands are adjacent to Crow Branch, Bolin Creek or unnamed tributaries to these streams. There is also one impoundment of Crokv Branch ?N ithin the property boundary. All streams. wetlands and waters on are in the Cape Fear River Basin (8-Digit Cataloging Unit 03030002). Site inspections have been made for the jurisdictional determination: however, a final jurisdictional determination has not been completed for the project. Applicant's Stated Purpose The applicant's staled purpose for the project is to expand the existing University of North Carolina-Chapel Hill (UNC-CH) campus to accommodate existing and new academic, research, service and outreach programs in support of t1NC-CI I's mission. Project Description The activity involves the expansion of the existing UNC-CH CanlpuS. The 111ain campus is nearing its responsible building capacity and the few remaining building sites there are constrained by existing development. The Carolina North Plan proposes to develop approximately 9 million square feet on 228 acres over 50 years. The master plan 2 prioritizes already disturbed land for the development of Carolina North. Plans submitted with the application show the placement of fill material permanently impacting approximately 552 linear feet of'stream channel, permanently impacting 2.412 acres of, wetlands and temporarily impacting 70 linear Iect ol'strcam channel. This includes all roadways. utility lines. and building lots. Construction ol'the project is proposed in two (2) phases. Impacts proposed for Phase I will include 0.005 acre ofpermanent wetland impacts and 10 linear feet of temporary stream impacts. All the remaining impacts described above are proposed for Phase II. To mitigate for the anticipated impacts. the applicant has proposed a payment into the North Carolina Lcosystem Enhancement Program (NCI:EP). Other Required Authorizations This notice and all applicable application materials are being forwarded to the appropriate State agencies for review. The Corps will generally not make a final permit decision until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 ofthe Clean Water Act (1'1, 92-500). The receipt of the application and this public notice combined with appropriate application Ice at the North Carolina Division of Water Quality central office in Raleigh will constitute initial receipt of an application for a 401 Water Quality Certification. A waiver will be deemed to occur if the NCDWQ fails to act on this request for certification within sixty days of the date of the receipt ofthis notice in the NCDWQ Central Office. Additional inlormation regarding the Clean Water Act certification may be reviewed at the NCDWQ Central Office, 401 Oversight and Express Permits Unit, 512 North Salisbury Strect, Raleigh, North Carolina 27604. Essential Fish Habitat This notice initiates the Essential Fish Habitat (F.FI1) consultation requirements of the Magnuson-Stevens Fishery Conservation and Management Act. The Corps" initial determination is that the proposed project will not adversely impact EFI I or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. Cultural Resources The Corps has consulted the latest published version of the National Register of l iistoric Places and is not a«-are that any registered properties, or properties listed as being eligible for inclusion therein are located within the project area or will he affected by the proposed work. Presently, unknown archeological, scientific, prehistoric, or historical data may be located within the project area and/or could be affected by the proposed work. Endangered Species The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural I leritage Database. Based on available information, the Corps has determined pursuant to the Endangered Spccics Act of] 973. that the proposed project will have no effect on federally listed endangered or threatened species or their formally designated critical habitat. Evaluation The decision whether to issue a permit will be based on an evaluation of the probable impacts. including cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization ol' important resources. The benefit which reasonably may he expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the CUIlllllaliyc cllects thereof:. among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values.. flood hazards, flood plain values (in accordance with Executive Order 11998), land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety. lood and fiber production, mineral needs, considerations ol'property ownership. and, in general. the needs and welfare of the people. For activities involving the discharge of dredged or fill materials in waters of the United Statcs. the evaluation of the impact of the activity on the public interest will include application of'the hrrvironnlental Protection Agency's 404(b)( I ) guidelines. Commenting Information The Corps of Engineers is soliciting comments from the public: Federal. State and local agencies and officials, including any consolidate State Viewpoint or written position of, the Governor; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, continents are used to assess impacts on endangered species. historic properties, water quality, general environmental cfTects and the other public interest factors listed above. Comments are used in the preparation ofan Environmental Assessment (EA) and/or an Environmental Impact Statement (I'.Is) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Any person may request, in writing, within the comment period specified in this notice, that a public hearing be held to consider the application. Requests for public hearings shall state, with particularity, the reasons Im holding a public hearing. Requests for a public hearing shall be granted. unless the District Engineer determines that the issues raised are insubstantial or there is otherwise no valid interest to be served by a hearing.
