For comment 7, we stated that, in many cases, the NC Division of Land Quality will require
dissipation pads as part of the total sediment and erosion control plan. They may not. A
lot depends upon what the applicant proposes.
We provided this comment so that you can check to see. If you do end up needing to install
dissipation pads we generally assess impacts as follows:
If the pads are designed and built so that the top of the rip rap is level with the existing
stream bed, then we consider it as a permanent impact, but generally don't require
compensatory mitigation. If we do require mitigation, the ratio would be half of what we
established during the site inspection. For example, if we decided the stream required 2:1
mitigation, then for the length impacted for a dissipation pad, the ratio would be 1:1.

We're in the process of creating our responses to the remarks that you sent us earlier in the
week.

I have 2 questions that we need your help with:
1. For the comment below, should we assume that the comment means that we
should review the remarks that were provided? Or are there plans that need changes?
2. For the dissipator pads discussed in comment # 7, if we plan to bury the rip rap so that
it's level with the existing grade, does the Corps count this as an impact? If so, would it
be considered temporary or permanent? And does it require mitigation?
I'll be glad to follow up with a phone call about the above if that would be helpful.

determine which, if any, dissipation pads or other methods are needed. Sally Hoyt will also
follow up with Randy Boyd at NCDOT about the culverts with baffles.
