Approval of 3"d Modification to 401 Water Quality Certification (3641)
Dear Mr. Benjamin:
You have our approval to impact Zone I of the Neuse Riparian Buffer, within a lawn area, to establish a slope of 4:1
approximately 115 linear feet in length, reestablish ground cover, and construct 6' wide by 10' long section of walkway
to pass through existing riprap. Also construct an additional 25 foot sheet pile groin next to the proposed boat ramp,
three (3) pilings to create an 18' by 32' boat slip, and add a mooring to accommodate 64 foot vessels. These impacts
are in addition to impacts approved by this Office in a General Certification #3641 issued to you on May 8, 2009 and
modified on March 28, 2011. The previously approved impacts consist of 0.039 acres of wetlands, 5,514 square feet
(ft) of shallow water impacts to construct the proposed residential boat dock, bulkhead, boathouse, and pool as
described in your application submitted to this Office on April 29, 2008.
This Certification can also be found on line at: http://h2o.enr.state.nc.us/ncwetlands/certs.html. You are authorized to
proceed with your project as proposed under General Water Quality Certification (WQC) # 3641 (enclosed). This
Certification allows you to use the CAMA Major Permit when the Division of Coastal Management issues it. Written
concurrence is required from the Division of Water Quality (DWQ) and you are required to meet all of the conditions
of the General Water Quality Certification.
If at anytime during construction of your project you determine that you cannot meet these conditions or if there are
any additional impacts to wetlands or water quality not described in your application, you must contact this office
immediately. If you have any questions concerning this matter, please do not hesitate to call Roberto Scheller in the
Washington Regional Office at (252)-948-3940.
