9. PROJECT DESCRIPTION:
The project site is located at 123 Sound View Drive North, adjacent to the AI W W, in Hampstead, Pender
County. To get to the site from Wilmington take US Hwy 17 N to Country Club Road (approximately
13.5 miles from the Wilmington Regional Office). Turn right onto Country Club Road and continue
approximately 2, 18 miles before turning right onto S. Belvedere Drive. Continue along S. Belvedere
drive until it dead ends at Sound View Drive. At the intersection, turn left onto Sound View Drive and the
property will be located along the right at house number 123.
The property consists of a 039-acre parcel that is situated on land that is approximately 0-8 feet above
mean high water (MHW) and is vegetated primarily with lawn grasses. The property contains a residential
dwelling, bulkhead/retaining wall, and private pier and platform (consisting of an approximately 5' x 110'
access pier and 16' x 20' platform, both authorized under CAMA general permit 74227-D, issued on
4/23/19). The shoreline (approximately 107' as measured along the Mean High Water line) is stabilized
by bulkhead/retaining wall. Coastal Wetlands and 404-type wetlands transition from the bulkhead to the
waters edge. Smooth Cordgrass (Spartina alterniflora), along with Glasswort (Salicornia spp.) and Sea
Lavender (Limonium carolinianum), span along the intertidal mud flat a distance of approximately 480'
before reaching the open water area of the AIW W. The width of the waterbody in the vicinity of the
project site measures approximately 610' from marsh to marsh.
The waters of the AIW W are classified SA by the Division of Water Quality. The project area IS
designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and is OPEN to
the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to extend the existing walkway and construct a new three (3) slip docking facility.
According to the application package, the applicant would utilize the existing walkway and platform, and
add an additional 6' x 494' section at the terminal end, as well as a new 18.5' x 20' covered gazebo, 8' x
24' floating dock and two new 12' x 13' boatlifts.
The pier extension would originate along the terminal end of the existing platform and would span toward
the east, crossing an open water mud flat. Several established oyster beds and small marsh islands are
located in the vicinity of the proposed pier extension, and some would be crossed according to the project
design. A narrow channel (naturally created) meanders through the flat and according to the application
package, it's near shore location is approximately 60' beyond the edge of the existing platform. At this
location, the applicant proposes to elevate the proposed walkway a height of 6' above the normal high
water line, and maintain that height a distance of approximately 16'. This would be done to ensure that
smaller, upstream vessels could navigate the area free of obstruction. Please refer to sheet 3 of 4 for the
exact location of the proposed walkway elevation and dimensions.

At a distance of approximate 425' beyond the edge of the existing platform, the marsh terminates and
becomes open water. In this area of the waterway, the width of open water is approximately 610' in
width. The applicant proposes to extend the pier and docking facility a distance of 138' beyond the edge
of the marsh, into the Atlantic Intracoastal Waterway (AIWW). At the terminus, the applicant proposes to
install an approximate 18' x 20' fixed platform (part of which consist of a 3' x 20' "step down" along the
outer edge). On either side of the covered platform, the applicant proposes to install a 12' x 13' boatlift.
According to the site plan drawing, the boatlift pilings would align with the outer pilings (waterward)
supporting the platform. Lastly, an 8' x 24' section of floating dock would be located along the northern
side of the northern most boatlift. The floating dock would run perpendicular to the shore (parallel with
pier) and would be positioned just inshore of the pier head alignment. According to the application, water
depths in the vicinity of the proposed floating dock and boatlift(s) range from -3.10' to -4.6' at normal
low water.
According to the application package, the proposed platform, boatlifts and floating dock would terminate
inshore of the pier -head alignment, federal channel setback, and within the limits based on the '/4 width
limitation.
In order to meet the square footage criteria (based on shoreline length), the applicant is proposing to
reduce the size of the existing 16' x 20' platform from 320 sq. ft. to 294 sq. ft. The dimensions of the
reduction are not specified in the application package, but no new configuration has been proposed.
Based on the work plan drawings, the applicant's proposal would be located outside of the 15' riparian
corridor setback of both adjoining property owners. As a result, the applicant did not require a waiver
from neither neighbor for the proposed development.
A review of aerial imagery (taken from Pender County's GIS as well as Google Earth) shows a history of
Submerged Aquatic Vegetation (SAV) along the shoreline bordering the AIW W at this location, and
while no visible beds were observed during DCM's site visit, there exist the possibility that SAV is
present along the landward side of the proposed docking facility. However, based on DCM's findings, it
does not appear that the boatlifts, platform or floating dock would impact any areas of SAV.
10. ANTICIPATED IMPACTS
The proposed pier, platform and three (3) slip docking facility would result in the incorporation of
approximately 3,838 sq. ft. of estuarine and public trust area. Although no Submerged Aquatic Vegetation
(SAV) was observed within the project area during the 10/27/20 site visit, conditions are favorable for
existence and the NC Division of Marine Fisheries has designated a portion of this shoreline as SAV
"habitat". Furthermore, the applicant has provided an SAV survey that shows several areas of SAV inland
of the proposed docking facility. Based on this information, in combination with DCM's site visit on
10/27/20 (at low tide), it is staff s opinion that the proposed project area is void of any established beds of
SAV.
The proposed development would be located outside of the 15' riparian corridor setbacks on both sides,
would be constructed within Y4 of the width of the waterbody and outside of the federal channel setback.

Mr. Thomas Kaznowski is requesting that a Major Permit be issued for the modification and
extension of her pier, covered platform, floating dock, and two boat slips at 123 Sound View
Drive North, Hampstead, NC 28443. This stricture would be for the recreational use of the
homeowner.
There exists on the property a 5' x 120' finger pier and a 256 sqft platform. The proposed
project would facilitate the addition of a 6'x574' finger pier, a 16'x20' platform (324 sqft
covered), two dry slips, and one wet slip. The existing platform would be reduced in size to 220
sqft.
The pilings would be set using a barge, water -jet, and vibratory hammer to reach the rated
capacity (approximately 8-10' deep). Construction materials would be stored on dry land of
approximately 1000 sqft.

The Division of Coastal Management hereby acknowledges receipt of your application, requesting
authorization under the Rules of the N.C. Coastal Resources Commission for development activities 123
Sound View Drive, adjacent to Topsail Sound, in Hampstead, Pender County. It was received as complete on
December 21, 2020, and appears to be adequate for processing at this time. The projected deadline for
making a decision on your permit application is March 6, 2020. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a final
action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter will
be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from December 21, 2020, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and
shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card to a
telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-
of-way where a private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing if
you wish to receive a copy of my field report and/or comments from reviewing agencies.

Good afternoon Mr. Penny/Kaznowski,
The Division of Coastal Management's Wilmington Regional office received a CAMA Major Permit application from you
on November 19, 2020, requesting approval for development activities at the subject address. In reviewing your
application, we have discovered that additional information is needed to complete the review process. Accordingly, I am
requesting that you submit the following additional information to this office:
• Please provide water depths measurements in the area surrounding the proposed docking facility as well as
water depth measurements in the area of the "slough" or finger channel where the proposed pier is to be
elevated. Water depths should be collect at normal low water (0.0' low tide) and should be referenced as such
on the site plan and application package.
• Based on information observed using Google Earth satellite imagery, it appears the width of water body in the
location of the proposed docking facility is approximately 600', as measured from the edge of marsh on one side
to the edge of marsh on the opposing side of the waterway. Please confirm the measurements described in the
application package and revised the drawings and application package accordingly.
• On the site plan drawing, please show the location of the federal channel setback, the ''/< width limitation and
any existing pier head line.
• Please provide a revised cross section drawing that shows the waterbody, coastal wetlands, normal high water,
normal low water, slough, edge of marsh, proposed dock, pier, boatlift and gazebo.
• All workplan drawings must be accurately drawn to an engineers scale (1"-200' or less) (example 1"=30'), 1"=50',
1"=60', 1"=100', etc.). The scale must be indicated on the drawings. Please re -scale any drawings that were not
originally drawn to an engineer scale.
In accordance with the Department of Environment and Natural Resources regulations, we note that the partial
application, as submitted on August 25, 2020, is incomplete for processing. Upon submission of the requested
information, a local decision will be made in 150 days, provided this period is not extended as provided by law. Please
contact me at 910-796-7221 if you have any questions. Due to the amount of deficiencies, your application package is
being returned in its entirety.
