Attn: Mr. Ian McMillan

Dear Mr. McMillan,
MAR .3 7 20q l
This letter is with reference to the North Carolina Division of Water Quality's (DWQ) correspondence of
March 14, 2011 regarding DWQ Project #09-0229 Ver. 2 and will also address the U.S. Army Corps of
Engineers' letter of March 16, 2011, Action ID No. SAW 2009-00051, Frisco Community Church.
As currently designed, the proposed project will result in +/- 36, 124 square feet of impervious surfaces
which will result in approximately 41% lot coverage. The applicant is aware that a Stormwater
Management Plan is required for the current project. However, since the project depends upon fill in
Corps' jurisdictional wetlands, numerous agencies are involved in the Section 404 and Section 401 review
process.
The applicant requests relief from the current request to undertake costly stormwater design until the
comments from the other agencies involved in the review process can be incorporated into the final design
of the site improvements. The applicant can then address the stormwater features that are appropriate for
the design which has resulted from the various comments.
Please accept the applicant's request to maintain an active status of the application and receipt of the
requested stormwater design upon completion of the final site improvements which reflect the various
agency comments.
Sincerely,

Dear Mr. Pelletier,
This letter is with reference to the U.S. Army Corps of Engineers' response of March 16, 2011 made with
reference to Action ID No. SAW-2099-00051 regarding sequencing pursuant to the Memorandum of
Agreement of February 6, 1990 between the Department of the Army and the US Environmental
Protection Agency. Environmental Professionals, Inc. (EPI) has been actively engaged with Frisco
Community Church to improve their property to allow for a church campus.
An application for impacts to wetlands was tendered to the Corps on March 18, 2009 for the purposes of
improving the site as the church campus. This request anticipated the need to fill 1.00 acres of Corps'
jurisdictional wetlands in order to support the church building and two free-standing structures (fellowship
hall and youth facilities) as well as required parking and sewage disposal and repair areas. The agencies
requested a consideration of avoidance, minimization, and compensatory mitigation for that proposal. This
application was subsequently retired by the DA letter of June 17, 2009.
The church has since been reconsidering the anticipated needs which resulted in the November 30, 2010
application. The revised application incorporates the inclusion of the fellowship hall and youth facilities
within the two-story structure now proposed. Also considered in the new proposal is the construction of a
retaining wall rather than a sloping fill section. Even though this will result in a substantial increase in cost
for site improvements, it does allow for stabilization of the foundation of the now two-story church. The
fill area on the east side of the parking lot will provide the necessary outdoor area for the much needed
youth recreational facilities. These considerations resulted in the reduction of impacts to .85 acres of fill at
the site. This represents a significant reduction of the request of 2009 yet allows the church ample room to
achieve its goal of providing for its members (both young and older members).
With the consideration of avoidance and minimization, the church requested mitigation credits from the
North Carolina Ecosystem Enhancement Program and was informed on January 11, 2011 that the program
was willing to accept payments for the anticipated impacts (see attached letter from NCEEP).
Thank you for the opportunity to provide you with information regarding the church efforts over the last
two years to seek a plan that will meet their mission while avoiding, minimizing, and adequately
compensating for the loss of wetlands.
I remain available to answer any further questions regarding this matter.
Sincerely
Environmental Professionals, Inc.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will
be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these
agencies to determine if payment to the NCEEP will be approved.

This acceptance is valid for nine months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following
table.
River
Basin CU
Location Stream (feet) Wetlands (acres)
- Buffer I
(Sq. Ft.) Buffer tI
(Sq. Ft.)
Cold Cool Warm Riparian -Non-Riparian Coastal Marsh

Credits Tar-Pamlico 03020105 0 0 0 0 Up to 3.4 0 0 0
Upon receipt of payment. EEP will take responsibility for providing the compensatory mitigation. If the regulatory agencies require
mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the
applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed
in accordance with the N.C. Department of Environment and Natural Resources' Ecosystem Enhancement Program In-Lieu Fee
Instrument dated July 28, 2010.
