Pate, Inc. would like to request the withdrawal of the discharge permit application for the Oxendine School Road Mine. Since the actual mined area is a fraction of the size permitted, dewatering is not needed for the excavation of the mining material. As we discussed over the phone, Z.V. Pate, Inc. had planned to have that additional mining area available for excavation as an option , so to minimize any impact to the ground water (wide rather than deep). I have contacted our Central Office staff about the process for withdrawing the Notice of Intent application for coverage under the NCG020000 discharge permit. They responded back asking that I go ahead and conduct a site visit to confirm that mining activities have ceased. I will probably do the site visit next week. They also asked that you send an e-mail summarizing the reasons why the application should be returned/withdrawn. The mining permit (Permit Number 78-51) for the site was issued on 1/7/2020. As discussed, if all mining activities at the site have been completed, then final reclamation per the approved reclamation plan is to be completed within two years from when mining ceased. Once final reclamation has been completed, a Release Request Form should be completed and submitted in order to release the site from the mining permit. The erosion control plan that was initially approved for the 5-acre single source borrow area (Project ID: ROBES-2020-001) is still active in our database, but will be closed out once the mining permit has been released.
