PROJECT DESCRIPTION: The project site is located at 118 Aqua Drive (Lot 65) and 208 North Channel Haven Drive (Lot 66), adjacent to the Channel Haven subdivision canal and Masonboro Sound, in New Hanover County. To locate the properties of interest from the Wilmington Regional Office (WiRO), travel southwest on Cardinal Drive Extension until you reach Eastwood Road. Turn left at Eastwood Road and travel east approximately 2.0 miles until you reach Military Cut-Off Road. Turn right on Military Cut- Off Road and continue onto Oleander Drive for approximately 3.3 miles until you reach Pine Grove Drive. Turn left onto Pine Grove Drive and travel south for approximately 2.0 miles until you reach Masonboro Loop Road. Turn right onto Masonboro Loop Road and travel south approximately 2.5 miles until you reach the Channel Haven subdivision, which would be located on the left. Turn left onto Channel Haven Drive South and then turns left onto Channel Haven Drive North. Turn left onto Aqua Drive and then turns right onto Channel Haven Drive North. The properties of interest would be located on the right. The applicants own the two contiguous lots, which total 0.66 acres with 160 linear feet of shoreline along the canal. The properties are located between two residential properties with existing single-family residences. The lots average approximately 10 feet above normal high water (NHW) and are vegetated with lawn grasses, pine trees and shrubbery. The applicants maintain a two story single-family residence on Lot 65, which is located facing Aqua Drive. Lot 66 is undeveloped, which faces Channel Haven Drive North. A storage shed is located on the eastern portion of the lot. There is drainage ditch between the property and Channel Haven Drive North that appears to connect to a drainage pipe within a 10 foot drainage easement along the Lots 65 and 66. The outfall drainage pipe is located and elevated above an existing 160 linear foot dilapidated wooden bulkhead that is located along the entire shoreline of these lots. During an on-site reconnaissance, it was observed that the drainage pipe was discharging clear water into the canal. There is a sharp transition of elevation from the highground to the shoreline along these properties. The soil between the highground and the existing wooden bulkhead appears to have been eroded due to the lack of maintenance of the bulkhead. This is evident due to the exposed tie-back anchor system and the waterward bow within the bulkhead alignment, especially on the eastern portion of the property. It appears that the lack of maintenance is currently allowing for the NHW boundary to occur approximately 10 feet landward of the bulkhead; further, the lack of maintenance of this bulkhead has allowed an area of coastal wetlands to colonize in an area of approximately 226 sq. ft. on the landward side of the most easterly end of the bulkhead, consisting primarily of smooth cordgrass (Spartina alterniora). Other vegetation in this same area includes sea oxeye (Borrichia frutescens) and other potential Section 404 type vegetation. The remaining area on the landward side of the bulkhead is void of coastal wetlands. The bulkhead currently ties into existing bulkheads located on the adjacent properties on the upstream and downstream portion of the property. The adjacent property owner to the east (Park, 212 Channel Haven Drive North) has recently constructed a new vinyl bulkhead and new docking facility along their property within the last year or so through a CAMA General Permit No. 53955 that was issued on 9/10/2009. Located on the highground portion of lot 65 is an uncovered platform, measuring 10 feet in length by 11 feet in width. An access pier, measuring 29 feet in length by 3 feet in width extends waterward from this platform across the property boundary to lot 66. This pier terminates onto a fixed platform, measuring 6 feet in length by 9 feet in width, which is located over open water. An access ramp leads onto a floating dock, measuring 21 feet in length by 6.5 feet in with that runs parallel to the existing bulkhead. Located on the landward side of the existing bulkhead within the central portion of lot 66 are an existing uncovered platform, measuring 37 feet in length by 14 feet in width and a 12 in length by 14 feet in width that are accessed from wooden steps. On the eastern side of this platform is an enclosed building, measuring 14 feet in length by 14 feet in width. The pilings under this building are leaning waterward as well, which appears to be due to the loss of soil behind the failing bulkhead. Waterward and accessed from the platforms is another uncovered platform, measuring 21 feet in length by 8 feet in width located over open water. Two access ramps lead to existing floating docks that run parallel to the bulkhead, one measuring 21 feet in length by 8 feet in width, and the other measuring 61 feet in length by 8 feet in width. DCM could not locate a previous CAMA Permit for the existing structures aforementioned. Based on aerial photography review, it appears that water dependent structures have been in place at this location since 1978. The existing docking facility could potentially accommodate up to four (4) vessels (See Sheet 1 of 3, 3 of 3 and photographs 1-14). In the project area, the waters are classified as SA by the NC Division of Water Quality, and they are CLOSED to the harvest of shellfish. These waters are designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. Jewell Page 3 PROPOSED PROJECT: The applicants proposes to construct a new bulkhead waterward of existing dilapidated wooden bulkhead, perform maintenance excavation and reconfigure existing fixed platforms and floating docks within the Channel Haven subdivision canal in Masonboro Sound. The application states that a new 160 linear feet vinyl bulkhead would be located just waterward of the existing dilapidated bulkhead in a straightened alignment. The applicants also request to perform maintenance excavation within the existing slips to bring back the water depth, which were authorized through Channel Haven POA CAMA Major Development Permit No. 141-90. The proposed maintenance dredging limit would be 160 feet in length by 15 feet in width to a final project depth of -4.0 feet at normal low water (NLW). The application states that 177 cubic yards of material would be mechanically removed and placed onto the applicants' highground at least 30 feet from NHW during the de-watering process. The material would be stabilized with proper silt fencing. The area between the new bulkhead and the highground would be filled with the excavated material once it has de-watered and any additional fill material from an upland source would be brought it to bring the final grade up approximately 5 feet above existing grade level to top of new bulkhead. The application states that the existing enclosed building and a section of the uncovered platform would be removed and the building would be located onto highground outside the 30 foot coastal shoreline buffer. The existing lower platform that is located over open water would be raised up to the same elevation as the upper platform as well. The application sates that the existing floating docks would be brought back into their previous locations. The existing access pier and fixed platform on the western portion of the shoreline would remain as well (See Sheets 2 of 3 and 3 of 3). 10. ANTICIPATED EWPACTS The proposed new bulkhead would incorporate approximately 1,760 sq. ft. of Estuarine Waters in the area landward of the dilapidated wooden bulkhead, and 240 sq. ft. of Public Trust Areas. The proposed bulkhead would also incorporate 226 sq. ft. of Coastal Wetlands that primarily consist of smooth cordgrass (Spartina alterniflora) and sea oxeye (Borrichia frutescens), which appears to have colonized on the landward side of the existing bulkhead due to the lack of maintenance. The bulkhead would disturb approximately 640 sq. ft. of highground for the associated backfill and tie-back anchor system. The proposed maintenance excavation would disturb approximately 2,400 sq. ft. of shallow bottom that has been previously disturbed through CAMA Major Development No. 141-90 (Channel Haven POA). The mechanically removed material would be placed onto highground and would disturb approximately 240 sq. ft. of Estuarine Shoreline. The proposed floating docks and platform re- configuration would incorporate approximately 921 square feet of Estuarine Waters and Public Trust Area. Minor increases in turbidity should be expected during construction. The structures would extend approximately 12 feet into a waterbody which measures approximately 48 feet across. As proposed, some of these structures would continue to encroach into the adjacent riparian property owners' 15 foot setback requirement; however, the applicants have received waivers from each adjacent riparian property owners to allow for the encroachment. Box 7363 Wilmington, NC 28403 910.791.4319 sconway@earr.com John and Susan Jewell Bulkhead Project Narrative Southeastern Coastal Construction Company has been contracted by John and Susan Jewell of 118 Aqua Drive to install a new straight bulkhead and improve the appearance of the existing structures in front of their properties at 118 Aqua Drive and 208 North Channel Haven. On paper the existing situation does not look all that bad but when you view the pictures and visit the site you will understand why they need to improve the situation which they inherited when they purchased the property. The previous owner through lack of maintenance probably let this property evolve into what you see now. John and Susan Jewell have spent the past few years saving up funds to return this property back to its original condition. Starting from the West end of the property and working my way Eastward, I will describe the existing conditions. Pictures 1- 4 show a storm drain pipe which comes out on the other side of a small deck and the lack of soil behind the existing bulkhead. We have inspected the drain pipe and there is no evidence of any problems with the flow of water through it or leaks other than that of the water pouring out of the end of the pipe as it should. The main issue with this property is the soil has been leeching through the wood wall for years into the channel such that the current soil height is 2 ft. 6 in. below the top of the existing wall. This has left all of the tiebacks exposed to the elements which have helped increase the rate of corrosion (see picture 5). Pictures 6 -9 denote the two different deck heights. The 21 X 7.9 ft. deck is approximately about 2 ft. lower than the 37 X 14 ft. deck. My clients would like to raise the lower deck to match the upper deck height. However, the main issue to address in this picture is where the wall is failing and starting its long and continuous bow which gradually extends out 2 ft. from its original placement. The failure is largely due to the corrosion of the exposed tiebacks. Another cause according to the previous owner is that a tree fell on the wall and further assisted the outward push of the wall. Another concern is the leaning storage building that has also shifted with the dirt and wall (see pictures 10-13). The building is probably not stable enough to make it through another hurricane. Therefore, the Jewells are willing to relocate this non-conforming structure to the top of the hill behind the 30 ft. coastal shoreline buffer setback line. In addition, my clients are willing to remove a 12 X 14ft. section out of the existing 37 X 14ft. upper deck so that the new bulkhead can extend from West to East in a straight line. Next, see pictures 14 andl5 and reference back to pictures 12 and 13. Due to this wooden bulkhead failing and the loss of soil from behind the existing bulkhead, there is about 226 sq. ft. of colonized smooth cord grass that has come up behind the old bulkhead within the last 4 years due to the removal of canopy which removed the shading. The Jewells would like their new vinyl bulkhead to run in a straight line from West to East which would mean that the new vinyl bulkhead would run in front of the old wooden bulkhead as close as possible until about where the steps from the upper deck extend to the lower deck. At that point the new vinyl bulkhead will be placed behind the old wooden bulkhead and once finished the old wooden bulkhead will be removed. This will establish a straight line and allow the existing floating docks which dimensions will remain the same to be moved closer to the wall and opening up the channel by 1 ft or more. Once the new vinyl bulkhead is in place they would like to dredge in front of the new bulkhead for a length of 160 ft. out 15 ft. to bring the water depth to negative 4 ft. at low tide as per permit 141-90 Channel Haven POA. We are seeking a favorable decision on this matter because in our opinion the environmental impact of completing this project far outweighs the impact of doing nothing for several reasons. First, during high tide if any marine life finds its way through the existing wooden bulkhead it will probably suffer when the water recedes and the marine life is left to suffocate and overheat in the sun because it cannot find its way back out from behind the existing wooden bulkhead. Secondly, if the existing wooden bulkhead is left in place it will continue to allow dirt to filter through it thus filling up the channel with sediment. Also, the exposed tiebacks will continue to corrode and fail one by one thus allowing the wall to push the docks further into the channel. As a concession for backfilling behind the new vinyl bulkhead, including the 226 sq. ft. of colonized smooth cord grass, the Jewells are willing to give up 364 sq. ft. of their existing structure. This includes the nonconforming storage building and a 12 X 14 ft. section of their upper deck. In addition, the dredging will help open the channel for easier boating access and increase the flow and flushing of water in that channel during tide changes. Along with these improvements, the new grasses and plants that will thrive in the dirt behind the new bulkhead will help increase water quality from surface water runoff for the marine environment. All of these reasons will create a much more environmentally friendly coastal habitat for marine life along this channel which has so many environmental concerns.
