SUBJECT: Proposed Replacement of Bridge No. 139 over Beaverdam Creek on SR 1314 (Artee Road)
in Cleveland County, TIP No. B-1135, DWQ #11-0044
Dear Mr. Summers:
The Division of Water Quality (DWQ) has reviewed your submittal for a 401 Water Quality Certification for the
aforementioned project. Review of your application, in association with a site visit, revealed it is lacking the
necessary information required for making an informed permit decision. The permit application was deficient in
the following areas:
• The application states that the stream width is between 30 feet and 32 feet: Based on a site visit, it
appears that the stream width is approximately 10 feet. Please clarify.
The application indicates that a 14' x 10' double box culvert will be installed in the stream. Based on the
width of the stream (approximately 10 feet), the installation of the culvert will overwiden the stream by more
than double the stream width. The profile drawing depicts what may be a "sill" in one of the culvert barrels,
however, it is not labeled as such. Floodplain benches currently exist along the right bank of the stream,
both upstream and downstream of the bridge. DWQ will require the construction of floodplain benches on
one of the culverts in order to maintain the existing stream dimension. Please provide drawings depicting
the construction of floodplain benches on both the inlet and outlet of the proposed structure. Additionally,
the benches must be constructed of materials that will not migrate downstream during large rain events.
DWQ recommends the use of shot rock or large Class II riprap on the waterward face of the floodplain
bench to provide stability and the use of coir fiber matting on the top of the bench to stabilize the material
used for bench construction.
• The cover letter submitted with the application (dated September 13, 2010) requests 67 feet of permanent
stream impact with no temporary impacts. The application (received January 10, 2011) requests 55 feet of
permanent impact and 43 feet of temporary impact (causeway fill). Please clarify.

• The plans depict Class I riprap bank stabilization both upstream and downstream of the proposed culverts.
If riprap bank stabilization is proposed it must be included in the application as an additional impact.
• Grass swales are depicted on the plans. Please provide information and/or a drawing depicting how the
grass swales will tie into the stream (i.e., will riprap be used at the stream tie in?)
Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we
are supplied with the necessary information. You have 21 days to respond in writing with the requested
information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this
office has not received this information in writing, we will assume you are withdrawing your application and it
will be returned.
Furthermore, until the information is received by the NC Division of Water Quality, we request, by copy of this
letter, that the US Army Corps of Engineers place the permit application on hold.
