Dear Ms. Chapman: On March 11 th DWQ Staff and LBG staff conducted a site visit to the parcel on the corner of Tryon Road and SE Cary Parkway in Cary, North Carolina to discuss activities to be undertaken within the riparian buffer and any possible impacts. Specifically, the following was proposed by the Client via the LBG and agreed upon by DWQ: • The client proposes to completely disturb the outer 20' (Zone-2) of the buffer and replant with low growing vegetation, • The client proposes prune the inner 30' (Zone-1) per DWQ guidance (to be directed by a licensed arborist), • The client proposes to remove invasive and exotic species within the riparian buffer zones, and • Maintenance of the existing sewer easement and power line easement will not change. Berger will notify the DWQ when the activities are to occur. It was the DWQ's determination that the activities discussed were exempt from the Neuse Buffer Rules (15A NCAC 2B.0233) or allowable if done per the DWQ pruning guidance. LBG would like to pass this information along to our Client. Would you please provide us with a letter confirming the information discussed on site? Thank you in advance. Sincerely, Michael O'Rourke The Louis Berger Group, Inc. MAR 2 4 2011 KI' MDS AND STORMWATER BRANCH
